RECEIVED AMENDMENT NO - 4 CONTRACTNO. 13q),3'A DEC 2 7 2019 CITY OF FORT WORTH TO CITY SECRETARY CONTRACT CITY SECRETARY WHEREAS, the City of Fort Worth (CITY) and Parsons Water & Infrastructure, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 43923, (the CONTRACT) which was authorized by M&C C-25877 on the 25th day of September, 2012 in the amount of $391 , 453. 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount $206, 797 .00 which was authorized by M&C C- 26229 on 7tn day of May, 2013 and Amendment Number 2 in the amount of $43, 929 .00 which was approved administratively on the 1st day of May 2015 and Amendment No. 3 in the amount of $52 , 133 .00 which was approved administratively on the 3rd day of March 2019; and WHEREAS, the CONTRACT involves engineering services for the following project: Little Fossil Creek Interceptor Improvements at Various Locations within the Little Fossil Creek Drainage Basin; and WHEREAS, it has become necessary to execute Amendment No. 4 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 27, 2019 a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $145,919.00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $840,232 . 00 . Senior Professional Engineer City of Fort Worth - Water Department 200 Texas Street Fort Worth, Texas 76102 Subject: Request for Amendment 4 for Additional Level of Effort (LOE) for Little Fossil Creek Interceptor Rehabilitation Project Dear Walter, This letter supports Parsons' request for Amendment 4 for the increased level of effort (LOE) for updating and producing two (2) bid packages for the above-referenced project as follows: - Part 2A: Location 1 (Stand-alone Bid Package) - Part 2A: Location 2 (Stand-alone Bid Package) The Little Fossil Creek Interceptor Rehabilitation Project entails approximately 17,000 linear feet(LF) of pipeline rehabilitation at five locations. It was originally intended to be bid as one construction package. Pursuant to direction from Fort Worth Water Department (FWWD), Parsons separated the above-referenced project into multiple bidding packages, including the two listed above. The first bidding package, Part 1, encompasses the enlargement (pipe bursting) of over 5000 linear feet (LF) of existing 18-and 21-inch pipeline to 24-inch, manhole replacement, and open cut repairs. Part 1 was advertised in September 2014, with the bid opening in October 2014, construction completed with As-Builts accepted by the City on 10 March 2016. The second bidding package, Part 2 (Locations 1, 2, 3, 4&5A), encompasses nearly 12,000 LF of improvements to 18-to 48-inch pipe, including CIPP and spiral-wound rehabilitation, removal and replacement, rehabilitation and replacement of manholes, rehabilitation of an existing meter station structure, construction of new sewer pipeline and meter station, and connection structure to the Twin 90-inch interceptors. Part 2B - Locations 4A, 4B, and 4C was designed and provided to BHB Inc., to include in their Contract 1A which has been advertised to bid with closing date of June 20, 2019. Part 2A- Locations 1, and 2 are a priority now for the City and the rehabilitation status of the pipeline sections is shown in the below table. City requested to convert the meter station to Solar power. Part 213 - Location 4A,413, Parsons submitted final design package to BHB to include in BHB's Contract 4C 1A. Project was advertised for bid.(Part of Parsons Amendment 3) Location 3 Awaiting City's Direction - Drawings&Specifications - at 90%-Not included in Amendment 4 Proposal. Location 5A Awaiting City's Direction - Drawings &Specifications - at 90%-Not included in Amendment 4 Proposal. Parsons requests approval for the additional work associated with preparing the bid packages related to Part 2A- Location 1 and Location 2, including additional design services associated with splitting the plans into distinct segments,final design submittals;services during bidding associated with non- simultaneous and separate contracts;and construction phase services.This amendment includes site visit to two FWWD meter stations, and meeting with FWWD and Facilities Group, additional hours to update the plans to accommodate Haltom City permit requirements, converting the meter vault to operate completely on solar power using solar panels and batteries, structural modifications of the meter station vault. Permitting requirements were developed in meetings with Haltom City and were not part of the original LOE and support the City of Ft. Worth with obtaining permits for TXDOT and the Railroad.The attached spreadsheet for Amendment 4 provides the level of effort required to advance the project from the current phase and then through construction to record drawing submittal. On 26 June 2019, Parsons team visited two meter stations and participated in a meeting with City of Fort Worth Water Department, and Facilities Division. The meter stations visited were located at Bethesda Wastewater Ashford Park subdivision,and another under construction meter station located on Minnis Drive, within Haltom City limits. Based on the comments provided for the Location 1 design and inputs received during the meeting resulted in changes to the design of Meter Station proposed for Location 1. In this Amendment 4, please note the following: 1. Task No. 4.1, (Meter Station Modification - Structural Design)- Parsons received City's comments, inputs from meeting, required significant changes which are being addressed and reflects the LOE required to bring the documents for City's final review. 2. Task No. 4.5 (Final(100%) Plans and Specifications)-this LOE is to address City's comments on the Final Draft and prepare the drawings for bid. 3. Task No. 5.1 and Task 5.2 (Redesign to convert to Solar, and Final Draft (100%) Plans, Specifications, and Cost Estimate)-this LOE is required to convert the existing electric powered facility to operate on solar power which includes the review of the options available, and meters that are compatible to operate on solar power. 4. Tasks 6.0, 7.0, & 10.0 (Bid Phase, Construction Phase, & Permitting)-the LOE is included based on having to interact with multiple entities similar to Location 4A, 413, &4C, and to address comments. 5. Criado &Associates' Survey fee for Part 2A - Location 2 is included in this Amendment 4, due to loss of marker, along with fees to advance Location 2 to 100% design, Bid Phase, Construction Phase, and Record Drawing submittal. This amendment and spreadsheet does not include the LOE to advance Location 3 and Location 5A to 100%, Bid Phase, Construction Phase, Easement services, Survey, or associated Permitting. Parsons will complete the changes to advance the Locations 1, and 2 drawings, specifications, and proposal workbook to Bid Phase, and Construction Phase Services. Attached is a spreadsheet with the level of effort (LOE) for completing the design, including solar power, splitting the bid packages, construction phase services, and for project locations and tasks as noted above. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$145,919.00 transferred from available funds within the Water and Sewer Fund;and 2. Authorize execution of Amendment No.4 to City Secretary Contract No.43923,an Engineering Agreement with Parsons Water and Infrastructure, Inc., in the amount of$145,919.00 for a revised contract in the amount of$840,231.00 for the Little Fossil Creek Interceptor Improvements at Various Locations Within the Little Fossil Creek Drainage Basin (City Project No.C01960). DISCUSSION: On September 25,2012 Mayor and Council Communication(M&C C-25877),the City Council authorized the execution of an Engineering Agreement with Parsons Water and Infrastructure, Inc.,in the amount of$391,453.00 for the preparation of plans and specifications for the Little Fossil Creek Interceptor Improvements at Various Locations Within the Little Fossil Creek Drainage Basin project.The agreement was subsequently revised by Amendment No.1 in the amount of$206,797.00 authorized by M&C C-26229 on May 7,2013,Amendment No.Zin the amount of$43,929.00 administratively authorized on May 1,2015 and Amendment No.3 in the amount of$52,133.00 administratively authorized March 25,2019. Amendment No.4 will provide for converting the project meter station from electrical power to solar power as requested by the City,structural modifications to the meter station vault,additional design services to create two separate projects to expedite construction,additional coordination with various agencies for necessary permits and additional design survey services.
