' w t • a Z s ORDINANCE NO. 1 ORDINANCE CLOSING HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST OF IMrROVRING A PORTIO14 OF EAST BERRY ST. EXTENSION TH, TEA. AND PORTICNS OF SUNDRY CTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING CHANGES AND LIENS AGAINST ABUTTING PROPERTY THEREO:', AND AGAINST THE OWNERS THEREOF; PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS AND THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF; RESERVING UNTO THE CITY COUNCIL THE RIGHT TO ALLOW CREDITS REDUCING THE AMOUNT OF THE RESPECTIVE ASSESSMENT TO THE EXTENT OF ANY CREDIT GRANTED; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SXt11E IN THE MINUTES OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE ORDINANCE IF THE GRDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be improved by raising, grading, or filling same and by constructing thereon: 1. East Berry Street, Unit No. 2: 7" Reinforced Concrete Pavement on 60' roadway width. 2. Vaughn Blvd., Unit No. 3: *0 Hot-Mix Asphaltic Concrete Surface on 8" Compacted Crushed Limestone Flexible Base on 40* roadway width. 3. Miller Street, Unit No. 4: 7" Reinforced Concrete Pavement on 60' roadway width. together with combined concrete curbs and gutter on proper grade and line where same are not already so constructed, together with storm drains and other necessary incidentals and appurtenances; all of said improvements are to be so constructed as and where shown on the plans and in strict accordance with the plans and specifications therefor; and contract has been made and entered into with Texas Bitulithic Co. for the making and construction of such improvements; said portion of streets, avenues and public places being as follows, to-wits On East Berry Street Extension. From the westerly line of Vaughn Blvd., easterly on Richardson St. to the easterly line of Lot 3, Block 2, Brandt's Subdivision, thence northeasterly to the intersection of Bright St. and Tarrant Rd., thence easterly on Tarrant Rd. to Miller St., thence southeasterly on Tarrant Road to Edgewood Terrace, thence easterly on Tarrant Rd. to the easterly line of Crouch Avenue, known and desig- nated as Unit No. 2. On Vaughn Blvd.: From the southerly line of Berry Street to the southerly line of Lot 12, Block 6, Meadowlawn Addition, known and designated as Unit No. 3. On Miller Street: From the southerly line of Burton Street (to the east from Miller Street) to 100' south of the north line of Tract 11G2, Burton Heights Addition, known and designated as Unit No. 4. WHEREAS, estimates of the cost of the improvements of each such portion of treet, avenu8, and public place were prepared and filed and approved and adopted by the City incil of the City, and a time and place was fixed for a hearing to the proper notice of time and place fixed therefor, to-wit, on the 2nd Day of July, 1962, 9:30 A.M., in the it Chamber in the City Hall in the City of Fort Worth, Texas, and at such hearin the zng protests and objections were made, to-wit; CFI•ICIAL RECORD ti CITY SECRETARY s ry 1 -1- [T 11ir IT4. 9 T w . t . THE CITY CLE=ZIL .r HE CITY UP rGHT WRTH, `LE NS, THAT; I. Said 'nearing be, and the same is hereby, closed and the said protests and objections, and any and all other protests and objectio s, whether herein enumerated or not, be and the sar.,.e are hereby, overruled. II. The City Council, from the evidence, finds that the assessments herein levied should be male and levied against the respective parcels of property abutting upon the said portions of streets, avenues and public places and against the owners of such property, and that such assessments and charges are right and proper and are substantially in proportion to the benefits to the respective parcels of property by means of the improve- ments in the unit for which such assessments are levied, and establish substantial justice and equality and uniformity between the respective owners of the respective properties, and between all parties concerned, considering the benefits received and burdens imposed, and further finds that in each case the abutting property assessed is specially benefited in enhanced value to the said property by means of the said improvements in the unit upon which the particul4r property abuts anc for which assessment is levied and charge made, in a sum in excess of the said assessment and charge made against the some by this ordinance, and further finds that the apportionment of the cost of the improvements is in accordance with the la: in force in this City, and the proceedings of the City heretofore had with reference to said improvements, and is in all respects valid and regular. III. There shall be, and is hereby, levied and assessed against the parcels of property herein below mentioned, and against the real and true owners thereof (whether such owners be correctly named herein or not), the sums of ;coney itemized below opposite the descrip ticn of the respective parcels of property and the several a=n-ts assessed against the same, and owners therec°, as far as such owners ar:a known, being as follows: -3- I V. here more than cne erson, firm or corporation owns an interest in any property above described, each said person, firm or corporation shall be personally liable only for its, his or her pro rata of the total assessment against such property in proportion as its, his or her respective interest bears to the total ownership of such property, and its, his or nor respective interest in such property may Y released frcm the assessment lien upon rayment of such proportio=te sum. V. The several sums above mentioned and assessed against the said parcels of property, and the owners thereof, and interest thereon at the rate ._f six per cent (W) per annun, tcgeLiher with reasonable attorney's fees .nd costs of collection, if incurred, are hereby declo.red to be and ore mace alien upon the respective parcels of property against which the same are assessed, and a ?arsonal liability and charge against the real and true owners of such property, whether such owners be correctly named 'herein or not, and the said liens small be and constitute the first enforceable lien and claim against the property on which such assessments are levied, and shall be a first and paramount lien thereon, superior to all other liens and claims, except State, Gotnty, School District and City ad valorem taxes. The sums so assessed against the abutting property and the owners thereof shall be and become due and Aayaale as fellows; to-wit: in five (5) equal installments, due respectively on or before thirty (3C) days, one (1), two (2), thr,e (3), and four (4) years from the date of completion and acceptance of the improvements i" the respective unit, and the assessments against the property abutting upon the remaining units shall be and become due and payable in such installments after the date of the cclapletion and acceptance of suci,, respective units, and shall bear interest from saia date at the rate of six per cent (Ss) per annu; , payable annually .:ith each installment, except as to the first installment, which shall be Ke and payable at the maturity thereof, so that upon the completion and acce;tance of she ingrovements in a p.rticulL2 unit, assesmacKs against the property anuttiog upon such completed and accepted unit small be and become due and yajaWn in such installments, and with interest frcnh the date of such completion and acceptance. PROOIDED FURTHER, that the City attorney is hereby empowered to authorize payments of said sums of lesser installments and/or over a longer period of ti e in cases fir. which the Director of Public works has previously detcrhined that an extreme finrncial hardship upon the property owner will otherwise rasult; and. Althoug : the aforementioned charges have een fixed, levied, unc assessed in the respective amounts hereinabovc stated, the City Council does hereby reserve unto itself the right to reduce the afcre.entioAed assessments by allowing credits tc certain property .�nsrs where Koe co a;prcp-ii te. notwithstanding the City Council has herein r_served the right tc issue credits, it shall nut be required to issue credits, ano will not A so, if same :'could result in any inequity and/er unjust discrivination. The principal amount of cock of the several assessment certificates to :he issued the City of 'Port -orth, Texas, as hereinafter provided, shall be fixed rind determined by deducting from the amount of any assessment hereinabcve levied such amount or amounts, if any, as may hereafter be allowed by the City Cooncil as a credit against the respective assessments. IX. For the purpose of evidencPg the several sums assessed against the re- spective p,rcels of abutting prcAerty ano the owners thereof, and the time and terms of payment, and to aid in the enforcement and collection thereof, assignable certificates in the principal amount of the respective -assessments less the amount of any respective credit allowed Vereon, shall :z issued by the City of Fort Yicrth, Texas, upon completion and acceptance by the City of the improvements in e.;ch unit of improvement as the work in such unit is completed and accepted, whicA certificates shall ')e executed by the Layer in the name of the City and attested by the City Secretar;, with the corporate seal of tho City impressed thereon, and shall be payable to the City of Fort .4orth, or its assigns, and shall declare the said amounts, time and terms of payment, rat_ of interest, ano the date of the completicn and -acceptance of the improvements abutting upon such property fur which the certificate is issued, and hall contain the name of tke cwner or owners, if known, uescriptioa, of the property by lot ano Mock nuMer, or front feet thereon, or other such description as may otheMse identify the same; ant if the said property shall in o'.-ned by an estate, then the description of same as so owned small be sufficient and no error or mistake in describing any property, or in giving the nave of the owner, shall involiOte or in anywise impair such certificate, to the asses meats levied. The certificates shall provide substantially that if sane shall act be paid promptly upon maturity, then they sahll !a collectable, with reasenable attorney's fees and costs of collection, if incurred, Ana steal' pro,:ioe substantially that the amounts evidenced thereby shall be paid to the Assessor and Collector of lands of the City of Fou:t Arth, Texas, who shall issue his receipt therefor, whic.i shall evidence of such payment on any degand for the same, ano the Assessor and Collector of Taxes shall deposit the sums so received by Ya'im forthwith .Pit_, the City Treasurer to be kept and held by 'him in a separate fund, and when any payment small b.; :.lade to the City the Assessor ana Collector of Taxes upon such certificate shall, upon presentation to him of the certificate by the holder thereof endorse said ;payment therncn. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Treasurer the amount paid upon the pre- sent_.tion to hi;; of such certificate so endorsed ano cre&ited; ant such endorsement ano credit shall by the Treasurer's W- rant for making such payment. Such payments icy the Treasurer shall be receipted for the holder of such certificate innriting and by surrender thereof when the principal, together wits accrued interest ano all costs of collection aw reasonable attc"ney's fees, if incurred, have been paid in full. Said certificates shall further recite substantially that the proceedings with reference to making the Improvements have been regularly had i• ccmyMnce with the la, , ant that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners tiieceof have been per::ormed, ano such recitals shall b•c prima facie evidence of ail the matters recited in such certificates, and no further pyocf thereof small be required in any court. -5- Said certificates may have coupons attached thereto in evidence of each or any e£ the several installments thereof, or may have coupons for each cf the first four installments, leaving the main certificate to serve for the fift'n installment, ohich cou_ons may be , aya5le to the City of _art ;J:rth, or its assigns may be signed with the facsimile signatures of the sayor and City Secretary. Said certificates shall further recite that the City of Fort 'north, Texas, shall exercise all of its lawful powers, wKen recues0 d so to do, to aid in the enforcement and collection thereof, and may contain recitals substantially in accoruance with the a1_ove and other additional recitals pertinent or appropriate thereof, and it shall not be necessary that the recitals be i- the exact form above set forth, but the substance thereof shall be sufficient. The fact that such improvements may be omnitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessments upon other ;remises. A. Full powsr to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof, is, in acccrda ;ce with the law in farce in this City, vested in the City. XI. All assessments levied are a personal liability and charge against the real and true owners of the premises described, notwithstanding such owners may not be named, or may be incorrectly named. Mi. T'_e assessments so levied are for the improvements in the particular unit upon Oich the property described abuts, and the assessments for the improvements in any unit are: in noise affected by the improvements or assessments in any other unit, anc in making assessments and in holding said hearing, the amounts .Assessed for im*_rovzne nts in any one unit have been in nowise c nnected with the improvements or the assessments therefor in any other unit. XIII. Tile assessments levied are made and levied under and by virtue of the tarms, ;cs;ars and 1;rcvisions of an Act passed at the First Celled Session of the Fortieth Legislature of the State of Texas, known as Chanter 106 of the Acts of said Session and now shown as ;article 1105b of Vernon's Texas Civil Statutes, :+hick tact has been adopted as an amendment to and shade a part of the Charter of the City of Fort 6orth, Texas. X I'J. The City Secretary is hereby dirocted to engross and enroll this ordinance by copying the caption of same in the iInute kook of the City Council of Tort Wrth, Texas, and by filing the complete Ordinance in the appropriate Crdinance Aecvrds of said City. Of the portion of the project now under consid- eration by the Council, 82 per cent of the cost is to be paid by the City-at- large from bond funds. Only 18 per cent is proposed to be assessed against adjacent property owners. The only assessments against residential property are in cases where the property owner has never participated in the cost of street improvements in front-of-hia-property, and the present street is not to-. proper line and grade. This is in accord with the current standard policy of the City Council for assessment paving. There is attached a summary of the Administrative Hearing, breakdown by units, distribution of cost, and other pertinent data.
