AN ORDINANCE GRANTING THE MISSOURI-KANSAS-TEXAS RAIL- ROAD COMPANY OF TEXAS THE RIGHT, PRIVILEGE AND FRAN- CHISE TO CONSTRUCT, MAINTAIN AND OPERATE A SPUR TRACK IN, UPON AND ACROSS AN ALLEYWAY IN BLOCK 1, SOUTH SIDE ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND A SPUR TRACK IN, UPON AND ACROSS BOLT STREET IN THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND TO OPERATE ITS TRAINS, ENGINES AND CARS THEREON BE IT ORDAINED BY THE CITY COUNCIL" OF THE CITY OF FORT WORTH: Section 1. That the Missouri-Kansas-Texas Railroad Company of Texas, its successors and assigns, be and it is here- by granted the right and privilege to construct, operate and maintain a spur track in, upon and across a portion of an alley- way in Block 1, South Side Addition to the City of Fort Worth, Tarrant County, Texas, J. F. Ellis Headright, the location of said crossing being more specifically described as follows: Beginning at the northeast corner of Lot No. 28, Block No. 1, at the point of intersection of the south line of a 12-foot alley, running east and west through said Block No. 1, with the west line of a 10-foot alley running north and south along the east side of said Block No. 1 and adjoining the westerly right of way line of the Missouri-Kansas-Texas Rail- road Company of Texas' Fort Worth Division main track; Thence westerly along said south line of said 12-foot alley 21.9 feet to a point; Thence deflecting an angle of 61 degrees 57 min- utes to the right northwesterly 13.6 feet to a point on the north line of said 12-foot alley; Thence easterly along the north line of said 12- foot alley 23.73 feet to a point; Thence deflecting an angle of 65 degrees 31 min- utes to the right southeasterly 50.49 feet to a point on the westerly right of way line of the Missouri- Kansas-Texas Railroad Company of Texas' Fort Worth Division main track distant 50 feet westerly from the center line of said main track; Thence southerly along said westerly right of way line, parallel with and 50 feet westerly from the center line of said main track, 68.0 feet to a point; Thence deflecting an angle of 165 degrees 27 min- utes to the right northwesterly from the tangent to curve of said right of way line 39.6 feet to a point on the west line of said 10-foot alley; Thence northerly along the west line of said 10- foot alley 65.0 feet to the point of beginning; Containing an area of 956 square feet, more or less. Section 2. That the Missouri-Kansas-Texas Railroad Company of Texas, its successors and assigns, be and it is hereby granted the right and privilege to construct, operate and maintain a spur track in, upon and across a tract or parcel of land 19 feet wide, being 9.5 feet on either side of the fol- lowing described center line of said spur track where it crosses Bolt Street in the City of Fort Worth, Tarrant County, Texas, the location of said center line being more specifically de- scribed as follows: Beginning at a point on the south line of Bolt Street distant 60.2 feet measured westerly along said south line of Bolt Street from the northeast corner of Lot 1, Block 1, of the South Side Addition to the City of Fort Worth out of the J. F. Ellis Headright; Thence northwesterly by arc of curve to the right of 535.67 feet radius, tangent to said curve being at an angle of 79 degrees 03 minutes measured northwesterly to the right from said south line of Bolt Street, a distance of 73.8 feet to a point on the north line of Bolt Street distant 79.7 feet meas- ured westerly along said north line of Bolt Street from the southeast corner of the Texasteel Manufac- turing Company's property at the point of intersec- tion of the Missouri-Kansas-Texas Railroad Company of Texas' Fort Worth Division main track westerly right of way line with the north line of Bolt Street; Containing an area of 1402 square feet, more or less. Section 3. It is provided that said track as con- structed along and in the route aforesaid shall be upon such grade as shall be approved by the City Engineer of the City of Fort Worth, and the top of each rail of each and every part of the said track and the spacing between the rails shall be kept level with the street, and the track and all other equipment used in such track shall be of standard quality and so con- structed and maintained that travel on said street shall not be unnecessarily impeded, obstructed or endangered at any place, and all construction and maintenance work shall be subject to the approval of the City Engineer and the City Council. Section 4. The Missouri-Kansas-Texas Railroad Company of Texas, its successors and assigns, shall, at its own cost and expense, pave and repave, or otherwise surface and resurface, and keep constantly in good order, repair and condition with the - 2 - same material with which the street on the outside is paved or surfaced, all that part of the street occupied by it and that which lies between the rails of said track occupied by it and for eighteen (18) inches on each side thereof; and the grantee, its successors and assigns, shall conform its track or any part thereof to the proper grade of said street and change the level of said track as often and whenever the grade of said street is changed so that every part of said track shall always be kept at the duly established grade line or as near thereto as the surface of the grade of the street outside thereof will permit. Section 5. Said Railroad Company, its successors and assigns, shall save the City of Fort Worth harmless from all damages, or claims for damages, resulting from the construction, maintenance and operation of said track constructed hereunder or resulting from any operation of cars thereon. Section 6. This ordinance shall take effect and be in force from and after its passage. Passed and approved this day of May, A. D. 1950.
