AN ORDINANCE GRANTING GULF REFINING COMPANY, ITS SUC-
CESSORS AND ASSIGNS THE RIGHT AND PRIVILEGE TO CONSTRUCT,
MAINTAIN AND OPERATE A PIPE LINE AND PIPE LINES, NOT TO
EXCEED TWO (2), IN GILLAHAM ROAD AND IN ROBERTS CUT-OFF
ROAD IN THE CITY OF FORT ADRTH; PROVIDING THAT THE GRANTEE
SHALL INDEMNIFY THE GRANTOR AGAINST LASS OR DAMAGE; AND
NAMING AN EFFECTIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTICN 1.
That Gulf Refining Company, its successors and assigns is
hereby granted the right and privilege to construct, maintain, and
operate a pipe line for the conveyance or transportation of oil, gas,
water, steam or any other material or substance which can be conveyed
through a pipe line along the following streets located in the City
of Fort Worth, Texas:
Gillaham Road Route
BEGINNING at a point in the Gillaham Road, where said
road changes its direction from an Easterly-Westerly direction
to a Northerly-Southerly direction and at the place where Gulf
Refining Company's present pipe line crosses such road, said
point being 6 feet southwest of the east or north edge of said
road;
THENCE in a Northerly direction along and with the
East edge of Gillaham Road approximately 1100 feet, crossing
Meandering Ebad, to the South boundary line on the West side
of the Amon G. Carter property in the N. H. Carroll Survey,
A 26,4, Tarrant County, Texas.
Roberts Cuty0ff Road
BEGINNING at a point on the North boundary line of
property belonging to the City of Fort Worth, at the inter-
section of Roberts Cut-Off Road and Biway Hoad;
THENCE in a Northeasterly directions which is approxi-
mately N. 19 deg. 44 min. E., across Roberts Cut-Off Road to
the Northwest corner of this intersection on the West edge
of Biway Road.
SECTION 2,
The Grantee, Gulf Refining Company, shall have the right to
construct, maintain and operate said pipe line and one (1) additional
line, along and across said streets as described in the foregoing
section hereof, at such grade or grades as it may elect to use and as
may be approved by the City Engineer of the City of Fort Borth, and it
is expressly provided that the Grantee, its successors and assigns
shall construct and conform said pipe line or any part thereof to the
proper grade of said streets; and it is further provided that in the
event of any change in the grade of the streets or any parts thereof
the Grantee shall adjust at its own expense its pipe line to conform
to such change in street grade, so that at all times said pipe line
will not interfere with the improvement and maintenance of the above
enumerated streets.
SECTION 3.
The said Grantee, Gulf Refining Company, its successors and
assigns, does agree to indemnify and save the City of Fort North harmless
from any and all damages, claims, judgments and other costs and expenses
recovered against or paid by the City of Fort North by reason of injury
or damage to any persons or property approximately caused by or arising
from and out of the construction, maintenance and operation of said
pipe line or pipe lines upon and along said streets.
SECTION 4,
This ordinance shall take effect and be in force from and
after the date of its paussp.
