HomeMy WebLinkAboutOrdinance 7868 { ORDINANCE NO. /> V AN ORDINANCE AUTHORIZING AND DIRECTING EXECUTION OF AN AMENDMENT TO THE "CONTRACT BETWEEN TARRANT COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NUMBER ONE AND THE CITY OF FORT WORTH RELATING TO: CONSTRUCTION OF CEDAR CREEK DAM, RESERVIOR, PIPELINE AND OTHER FACILITIES, AND TO THE SUPPLYING OF RAW WATER THEREFROM TO THE CITY OF FORT WORTH"; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the Mayor of the City of Fort Worth is hereby authorized and directed, for and on behalf of the City, to execute an Amendment to the "Contract between Tarrant County Water Control and Improvement District Number One and the City of Fort Worth Relating to: Construction of Cedar Creek Dam, Reservior, Pipeline and other Facilities, and to the Supplying of Raw Water therefrom to the City of Fort Worth" (identified as City Secretary Contract No. 4200, as amended, on file in the office of the City Secretary of the City of Fort Worth) in sub- stantially the form and substance attached hereto and made a part hereof for all purposes. SECTION 2. That, upon its execution, said Amendment shall be binding upon the City and the District for all purposes. SECTION 3. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdicition, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sections or parts of sections of this ordinance, which provisions shall be, remain and continue to be in full force and effect. SECTION 4. That this ordinance shall be and is hereby declared to be cumulative of the provisions of all prior ordinances of the City of Fort Worth and amendments thereto, except in those instances where the provisions of this ordinance are in direct conflict with such prior ordinances, in which instances said conflicting provisions of such prior ordinances are hereby repealed. SECTION S. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: City Att rney ADOPTED- EFFECTIVE• -2- v City of Fort 'Worth, Texas d BICARDI Mayor and Council Communication ERCHERT AILIfF DATE REFERENCE SUBJkCT: Authorization for Execution PAGE NUMBER of Amendatory Water Supply Contract 1 WITH 1/9/79 C-4485 Between TCWCID #1 and City of Fort Worth for Due to area growth there is an increasing demand for delivery of water from ICON the Cedar Creek Reservoir to supply Fort Worth and our customer cities, Arlington and the Trinity River Authority's customer cities in Tarrant County. To meet this demand it is necessary that the Tarrant County Water Control and Improvement District No. 1 proceed with the construction of additional pumping facilities on the Cedar Creek pipeline system. The present pump stations will deliver 80 million gallons per day, but it is essential that two additional pump stations and ground storage units be built and equipped to deliver 160 MGD to meet anticipated requirements in the near future. It is estimated that the cost of all of the improvements, including engineering, equipment and construction, will not exceed $10,000,000. The Tarrant County Water Control and Improvement District No. 1 proposes to finance these improvements through the issuance of revenue bonds, which will require the establishment of reserve funds to insure timely payment of principal and interest on presently outstanding bonds as well as the proposed additional bonds. An amendatory contract between the City and the TCWCID #1 relating to the treatment of these reserves and their impact on the City's cost of water is necessary before revenue bonds can be marketed. The City Attorney has reviewed and approved as to form and legality the proposed amendment and has prepared an ordinance authorizing and directing the Mayor to execute the proposed amendment. Recommendation It is recommended that an ordinance be adopted authorizing and directing the Mayor to execute an amendment to City Secretary Contract No. 4200, as amended, styled the "Contract between Tarrant County Water Control and Improvement District No. 1 and City of Fort Worth Relating to: Construction of Cedar Creek Dam, Reservoir, Pipeline and other facilities, and to the Supplying of Raw Water therefrom to the City of Fort Worth"; and enabling the establishment of appropriate reserve funds as required to allow the District to issue revenue bonds in a value not to exceed $10,000,000 to be used to increase the pipeline supply capability from Cedar Creek Reservoir from 80 MGD to 160 MGD.
