ORDINANCE NO. -7 5
AN ORDINANCE VACATING, ABANDONING AND CLOSING
HARVEY STREET IN THE 1500 BLOCK A WIDTH OF 35'
AND A LENGTH OF 172.3' FROM THE EAST LINE OF
LOT 7, BLOCK 7, BELMONT ADDITION (SAID POINT
ALSO BEING THE EASTERN LIMITS OF A PORTION OF
HARVEY STREET PREVIOUSLY VACATED BY ORDINANCE
NO. 2465) EASTWARD TO THE WEST RIGHT-OF-WAY
LINE OF SOUTH RIVERSIDE DRIVE ADJACENT TO TRACT
B, HIGHLAND PARK ADDITION AND LOTS 1 AND 6,
BLOCK 7, BELMONT ADDITION; AND VACATING, ABAN-
DONING AND CLOSING THE NORTH/SOUTH ALLEY A
WIDTH OF 15' AND A LENGTH OF 250' FROM HARVEY
STREET SOUTH TO POWELL STREET ADJACENT TO LOTS
1 THROUGH 5, 6 AND 16, BLOCK 7, BELMONT ADDITION;
PROVIDING FOR THE REVERSION OF THE FEE IN SAID
LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH AND PROVIDING THAT THIS ORDINANCE SHALL BE-
COME EFFECTIVE IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Harvey Street in the 1500 Block a width
of 35' and a length of 172.3' from the east line of Lot 7,
Block 7, Belmont Addition (said point also being the eastern
limits of a portion of Harvey Street previously vacated by
Ordinance No. 2465) eastward to the west right-of-way line of
South Riverside Drive adjacent to Tract B, Highland Park
Addition and Lots 1 and 6, Block 7, Belmont Addition and the
north/south alley a width of 15' and a length of 250' from
Harvey Street south to Powell Street adjacent to Lots 1
through 5, 6 and 16, Block 7, Belmont Addition, be and the
same are hereby vacated, abandoned and permanently closed as
a street or public thoroughfare and as an alley.
SECTION 2.
That the fee to the land in the hereinabove described
street right-of-way and alley is hereby released and will
revert to the adjacent owners as provided by law, SAVE AND
EXCEPT that easements are reserved therein for any and all
existing utilities including existing water, sewer, gas
and telephone facilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

Lone Star Scrap Metals Company (with consent of all abutting owners) has re-
quested that the City vacate Harvey Avenue in the 1500 block a width of 35
feet and a length of 172.3 feet from the east line of lot 7, Block 7, Belmont
Addition (said point also being the eastern limits of portion of E. Harvey
Street vacated by Ordinance No. 2465) eastward to the west right-of-way line of
S, Riverside Drive adjacent to TR.B Highland Park Addition and Lots 1 & 6,
Block 7, Belmont Addition and to vacate the north/south alley a width of 15
feet and a length of 250 feet from Harvey Street south to Powell Street adjacent
to Lots 1-5, 6 & 16, Block 7, Belmont Addition, as shown on the attached map.
The subject alley right-of-way is unpaved and unusable for access. The subject
street right-og-way is primarily unpaved but usable in its eastern portion.
Subject right-of-way contains water, sewer, gas and telephone facilities. The
agencies responsible for these facilities request that easements be retained.
The City Plan Commission has reviewed this request and recommends that the
subject right-ef-way be vacated as requested provided that the vacated right-
of-way is replatted with adjoining property. The Plan Commission also required
that easements are retained for existing utilities, the street is physically
closed with standard curb and gutter or reduced to a driveway approach at
Riverside Drive, and that the alley is physically closed with standard curb and
gutter at Powell Street when street improvements are made. These requirements
have now been satisfied.
Recommendation
It is recommended that an ordinance be adopted vacating the subject right-af-
way as requested.
