HomeMy WebLinkAboutOrdinance 7268 ORDINANCE NO. :Z Z Ig_ AN ORDINANCE PROVIDING THAT THE 15 FOOT UTILITY EASEMENTS APPROXIMATELY 203.5 FEET AND 126.5 FEET IN LENGTH LOCATED ADJACENT TO LOT 6, BLOCK 10, WILLOW LAKE ADDITION AND BEING PARTLY IN TRACT 1, J. HOWARD SURVEY AND LOT 2, BLOCK "D", OVERTON WEST ADDITION BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described 15 foot utility easements situated in the J. Howard Survey, Abstract No. 693, City of Fort Worth, Tarrant County, Texas, said easements being across a portion of a tract of land conveyed to Equitable Savings Association by deed recorded in Volume 5479, Page 225, Tarrant County Deed Records, and the centerline of said easements being more particularly described by metes and bounds as follows: BEGINNING at a point in the West property line of Phase 1, Willow Lake Addition, as recorded in Volume 388-99, Page 01, Tarrant County Deed Records, said point being North, 97.5 feet from the North right-of-way line of Westdale Drive; Thence West, 25.0 feet to a point of intersection in said centerlines from which another centerline extends North, 27.5 feet and South, 99.0 feet; Thence South, 82 degrees 0 minutes West from said point of intersection 178.5 feet to the end of said easement, be and the same are hereby extinguished, vacated, closed and permanently abandoned as easements for public utilities. SECTION 2. That the fee to the land in the above described easements is hereby released and will revert to the adjacent owners as provided by law, save and except that easements are reserved for any and all existing utilities. SECTION 3. All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. Subject easement, acquired by dedication, is in use and contains sanitary sewer facilities. The Water Department notes that relocation of these facilities and provisions for another easement has been accomplished by the Applicant. Reviewing City departments and private utility companies have no objections to this request provided a satisfactory replat of the property is provided to City Staff. The City Plan Commission has reviewed this request and recommends that an ordi- nance be adopted vacating subject easement as requested. A satisfactory replat has been provided City Staff. Recommendation It is recommended that an ordinance be adopted vacating subject easement right- of-way as recommended by the City Plan Commission.
