AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE OF THE
CITY OF FORT WORTH (1964) , AS AMENDED; BEING AN ORDI-
NANCE CONCERNING PARKING METERS: PROVIDING FOR THE
ESTABLISHMENT OF PARKING METER ZONES, MAXIMUM PARKING
TIME AND FEES THEREFOR; PROVIDING FOR THE HOURS OF
PARKING METER OPERATION AND FOR CERTAIN INFORMATION
TO BE SHOWN UPON PARKING METERS; PROVIDING FOR THE
INSTALLATION AND OPERATION OF PARKING METERS; PROVID-
ING FOR THE METHOD OF EMPLOYMENT OF PARKING METERS
AND PARKING SPACES ADJACENT THERETO; PROVIDING FOR
THE ILLEGALITY OF OVERTIME PARKING; PROVIDING FOR
PRIMA FACIE EVIDENCE OF OVERTIME PARKING; PROVIDING
FOR THE ILLEGALITY OF EXTENDING THE MAXIMUM PARKING
TIME; PROVIDING FOR THE MANNER OF PARKING; PROVIDING
FOR THE MARKING OF SPACES AND THE PARKING WITHIN SAME;
PROVIDING FOR THE ILLEGALITY OF THE USE OF SLUGS IN
PARKING METERS; PROVIDING FOR THE ILLEGALITY OF TAM-
PERING WITH PARKING METERS; PROVIDING FOR THE PROOF
OF PARKING METER LOCATION AND TIME LIMIT; PROVIDING
A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULA-
TIVE OF OTHER ORDINANCES AND PROVISIONS OF THE CITY
CODE; REPEALING ALL ORDINANCES OR PROVISIONS OF THE
CITY CODE IN CONFLICT HEREWITH; PROVIDING A SAVING
CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT Division 2 of Article VI of Chapter 26 of the Code of
the City of Fort Worth (1964) , as amended, be and the same is
hereby amended to read as follows:
"Division 2. Parking Meters
"Sec. 26-103. Establishment of zones and maximum park-
ing time therein; establishment of fees.
"There are hereby established Parking Meter Zone
No. 1, Parking Meter Zone No. 2, Parking Meter Zone
No. 3, and Parking Meter Zone No. 4.
"The traffic engineer is hereby authorized to desig-
nate such parking meter zones upon any street or portion
of any street where it is determined, upon the basis of
an engineering and traffic investigation, that the instal-
lation of parking meters shall be necessary to aid in the
regulation, control or inspection of the parking of vehi-
cles in the exercise of the police power of regulating,
operating or controlling the operation of vehicles using
the public streets. The parking of vehicles in such park-
ing meter zones shall be controlled and regulated by park-
ing meters, installed and maintained by the traffic engi-
neer, and located upon the curb immediately adjacent to
the individual parking spaces.
"In the zones so established, the traffic engineer
shall designate the maximum parking time for each park-
ing meter, basing his designation upon the investiga-
tion above set forth.
"The fees for parking meter zones so established
shall be as follows:
"Parking Meter Zone No. 1: Fifteen (15) minutes for
the depositing in the
meter of a five (5) cent
coin of the United States
of America; thirty (30)
minutes for the deposit-
ing in the meter of a ten
(10) cent coin of the
United States of America;
and one (1) hour for the
depositing in the meter
of a twenty-five (25)
cent coin of the United
States of America.
"Parking Meter Zone No. 2: Thirty (30) minutes for
the depositing in the
meter of a five (5) cent
coin of the United States
of America; one (1) hour
for the depositing in the
meter of a ten (10) cent
coin of the United States
of America; and two (2)
hours for the depositing
in the meter of a twenty-
five (25) cent coin of the
United States of America.
"Parking Meter Zone No. 3: Thirty (30) minutes for
the depositing in the
meter of a five (5) cent
coin of the United States
of America.
"Parking Meter Zone No. 4: One (1) hour for the de-
positing in the meter of
a five (5) cent coin of
the United States of
America.

"Sec. 26-104. Hours meters to operate; information to
be shown on meters.
"Parking meters in the established zones shall regu-
late the parking of vehicles between the hours of 8:00
A.M. and 6:00 P.M., unless otherwise specified by sign,
of any day, except Sundays and such other days as shall
be specifically designated by the city council; or when
parking is specifically prohibited by street signs.
"Each parking meter shall bear thereon a legend indi-
cating the days and hours when the requirements to deposit
coins therein shall apply, the value of the coins to be
deposited, and the lawful period of time permitted for
parking by meter actuation in the parking meter zone in
which such meter is located.
"Sec. 26-105. Installation and operation.
"The city traffic engineer or such other officer or
employee of the city as he may select is authorized to
install or place parking meters in such parking meter
zones established by the traffic engineer. Each parking
meter shall be placed upon the curb alongside of or next
to an individual parking space, such space to be desig-
nated as hereinafter provided.
"The city traffic engineer or such other officer or
employee above referred to shall provide for the installa-
tion, regulation, control, operation and use of the park-
ing meters provided for in this division and shall main-
tain such meters in good operating condition. Parking
meters shall be capable of being operated, either auto-
matically or mechanically, upon the deposit therein of a
designated coin or coins of United States currency, for
the full period of time for which parking is lawfully
permitted in any parking meter zone.
"Each parking meter shall be so designed, constructed,
installed and set that upon expiration of the time period
registered by the deposit of one or more coins as pro-
vided herein, such meter will indicate by an appropriate
signal that the lawful parking meter period has expired;
and that during such period of time and prior to the ex-
piration thereof, such meter will indicate the interval
of time which remains of such period.
"Sec. 26-106. How parking meter and space to be used.
"No person shall park a vehicle in any parking space
upon a street alongside of and next to which a parking
meter has been installed during the regulated time ap-
plicable to the parking meter zone in which such meter
is located, unless a coin or coins of United States cur-
rency of the appropriate denomination shall have been
deposited therein, or shall have been previously de-
posited therein for an unexpired interval of time, and
such meter has been placed in operation.

"Sec. 26-107. Parking overtime - unlawful.
"It shall be unlawful for any person to permit a vehi-
cle to be parked, to remain or to be placed in any park-
ing space alongside of or next to which is located any
parking meter during the restricted and regulated time
applicable to the parking meter zone in which such meter
is located while the parking meter for such space indi-
cates by signal that the lawful parking time in such
space has expired. This provision shall not apply to
the act of parking or the necessary time which is re-
quired to deposit immediately thereafter a coin or
coins in such meter.
"Sec. 26-108. Same - Expired meter prima facie evidence.
"The displaying of a signal by any parking meter in-
dicating illegal parking while a vehicle is parked in a
parking space adjoining such parking meter shall be prima
facie evidence that such vehicle has been parked overtime
and beyond the period of time established for the particu-
lar parking meter zone in which said parking space and
said meter are located.
"Sec. 26-109. Same - Extension by another deposit.
"It shall be unlawful for any person to deposit or
cause to be deposited in a parking meter a coin for the
purpose of extending the parking time beyond the maxi-
mum parking time established for the particular parking
meter zone in which said meter is located.
"Sec. 26-110. Manner of parking.
"Any vehicle parked in any parking space in any park-
ing meter zone shall be parked with the hood of such vehi-
cle alongside of or next to the parking meter alongside
of such parking space in parallel parking spaces; and
with the front of the vehicle at the meter in diagonal
parking spaces; and, in either event, shall be parked
within the lines marked on the street for such parking
space, as provided hereinafter.
"Sec. 26-111. Marking of spaces; parking within.
"The traffic engineer or such other officers or em-
ployees of the city as he shall select shall place lines
or marks on the curb or on the street about or alongside
of each parking meter to designate the parking space for
which such meter is to be used. Each vehicle parked
alongside of or next to any such parking meter shall park
within the lines or markings so established. It shall be
unlawful to park any vehicle across any such line or mark,
or to park such vehicle in such way that the same shall
not be within the area so designated by such line or
marking.

"Sec. 26-112. Use of slugs, etc. , in meters.
"It shall be unlawful to deposit or cause to be
deposited in any parking meter any slug, button, device,
substance or substitute for a coin of United States cur-
rency.
"Sec. 26-113. Injuring or tampering with meters.
"It shall be unlawful for any person to deface, in-
jure, tamper with, open or willfully break, destroy or
impair the usefulness of any parking meter installed
under the terms of this division.
"Sec. 26-121. Proof of parking meter location and time
limit.
"When any person is charged with having committed an
offense under this division, proof that a parking meter
was located at the parking space in connection with which
the offense was committed shall constitute prima facie
evidence that the parking meter was installed and the
space laid out by order of the traffic engineer, and that
the location and maximum parking time of such space were
lawfully designated by the traffic engineer.
"Sec. 26-122. (Reserved) "
SECTION 2.
THAT it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this ordinance shall
be declared void, ineffective or unconstitutional by the valid
judgment or final decree of a court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections hereof,
since the same would have been enacted by the City Council
without the incorporation herein of any such void, ineffective
or unconstitutional phrase, clause, sentence, paragraph or
section.

SECTION 3.
THAT this ordinance shall be and is hereby declared to be
cumulative of the provisions of the Code of the City of Fort
Worth, and amendments thereto, regulating parking meters, ex-
cept in those instances where the provisions of this ordinance
are in direct conflict with such Code, in which instances said
conflicting provisions of such Code are hereby repealed.
SECTION 4.
THAT all pending litigations and existing violations, both
civil and criminal, whether pending in court or not, under
Chapter 26 of the Code of the City of Fort Worth and amendments
thereto superseded by this ordinance, shall not be affected by
this ordinance but may be prosecuted until final disposition
by the courts.
SECTION 5.
THAT any person, firm, association of persons, company or
corporation or their agents, servants or employees who violate,
disobey, omit, neglect or refuse to comply with any provision
of this ordinance shall be punished by a fine of not exceeding
two hundred dollars ($200.00) , and each day that a violation
exists is hereby declared to be a distinct and separate offense
and punishable as such, all as provided for in Section 1-5 of
Chapter I of the Code of the City of Fort Worth (1964) , as
amended.
SECTION 6.
THAT this ordinance shall become effective and be in full
force and effect from and after its passage and publication as
required by law, and it is so ordained.

Parking meter rates in the core area of the Central Business District
are -5� for 30 minutes. -In the fringe area -of downtown the rate is
5 cents for one hour. With these rates it is less expensive for a downtown
worker to leave his car in parking tester areas for his entire work day than
to place it in an off-street parkin lot. Many workers are 'now parking on
the City streets all day and depriving the shoppers desiring, short time park-
ing from the use of the parking meter areas.
The present meters are single coin operated (nickels only) which causes many
complaints from the public in that they may have to go some distance to get
change and many receive a ticket during this period. The present parking
meters are a minimum-of 20 years of age, Well worn and replacement parts are
not readily available.
It is proposed that the City purchase 1885 new type manual operated parking
meters to replace the majority of the meters in the downtown area. These
meters will be multiple coin operated capable of receiving a nickel, dime or
quarter.
It- is also proposed that a new parking meter ordinance be adopted. The major
provisions are listed as follows;
1. The Traffic Engineer is authorized to designate parking meter
rate zones on streets on the basis of an engineering and
traffic investigation.
2. The fees for parking meter rate zones' so established-shall be
as follows:
Parking Meter Zone No. 1
Fifteen (15) minutes for the depositing in the meter of a five (5)
cent coin; thirty (30) minutes for the depositing in the meter of
a ten (10) cent coin; and one (1) hour for the depositing in the
meter of a twenty-five (25) cent coin.
Parking Meter Zone No. 2
Thirty (30) minutes for the depositing in the meter of a five (5)
cent coin; one (1) hour for the depositing in the meter of a ten
(10) cent coin; and two (2) hours for the depositing in the meter
of a twenty!-five cent coin.
Parking Meter Zone No. 3
Thirty (30) minutes ,for the depositing in the meter of a five (5)
cent .coin.

One (1) hour for the depositing in the meter of a five (5) cent
coin.
The new meter rates in the core area will allow parking for 20C per hour
compared with the average parking lot rate of 50C per hour. For 9 hour park-
ing the parking meter charge would total $1.80 compared to an average of
$1.25 per day on parking lots. The proposed rates should discourage all day
parking in the meter zones and provide more economical parking in the meter
zones for short time shoppers.
The proposed purchase of 1885 new meters will replace all meters in the
downtown area with the exception of approximately 50, which are expected to
be serviceable for several years.

The Traffic Engineering Department analyzed the bids and compared-the-meters
submitted as to specific features and City specifications. The Duncan Parking
Meter Model # 60-1 (base bid at $76,323.65) meets City of Fort Worth specifica-
tions. The Duncan alternate bids # 2, 3 and 4 fail to meet specifications.
The Rockwell Meter Model S does not meet the City of Fort Worth's specifica-
tions in the following respects:
A. Mechanism. The entire meter operating mechanism including the
clock mechanism is not constructed as a completely assembled
lift-out unit. It cannot be removed or replaced as a whole
from the meter mechanism compartment.
B. The cap or door on the meter housing does not include vents to
prevent condensation and fogging both in the dome and the
mechanism.
C. The meter is not equipped to prevent the insertion of an additional
coin when the meter is in an out-of-order condition.
ALTERNATE BID ON DUNCAN METER # 60-1 INCLUDING WIPE-OFF FEATURE AND DUNCAN
CHANGE LOCK
The wipe-off feature on the alternate bid is a distinct advantage but was not
included in the original specifications because both companies submitting bids
at that time could not furnish this feature. The feature provides after
inserting a coin a person only partially turning the handle wipes off all
existing time on the meter until the handle is turned completely, at which
time the residue time is returned and the additional time purchased added to
it. This feature will benefit the public by indicating a violation unless
the handle is turned to completion.
The Duncan meter has an estimated life of 20 years and the annualized addi-
tional cost of the wipe-off feature is minor.
Recommendation
It is recommended that:
1. The purchase of the Duncan Model 60-1 with wipe-off feature
and change lock be made from Duncan Industries, Division of
Qonaar Corporation, on its alternate bid number one meeting
specifications in the amount of $83,863.65 net, f.o.b. Fort
Worth; and
2. The City Council adopt the new parking meter ordinance provid-
ing for establishment of parking meter zones and rates.
