WHEREAS, the City of Fort Worth (City) and Teague Nall & Perkins,
Inc. (Engineer) made and entered into City Secretary Contract No.
29059, (the Contract) which was authorized by the City Council by M&C
C-19729 on the 26th day of August, 2003; and
WHEREAS, the Contract involves engineering services for the
following project:
Walsh Ranch Sanitary Sewer Extension, Phases IVA and IVB
WHEREAS, it has become necessary to execute Amendment No. 1 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I, of the Contract is amended to include a additional
engineering services specified in M&C C-21724, adopt by the City
Council on September 26, 2006, and further amplified in a proposal
letter dated July 11, 2006, copies of which are both attached hereto
and incorporated herein. The cost to City for the additional services
to be performed by Engineer total $42,292.00.

Article II, of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid
by the City for all work and services shall not exceed the sum of
$304,392.00.

amended herein shall remain in full force and effect.

Fee Proposal for Contract Amendment No. 1
Dear Mr. Conlon:
Teague Nall and Perkins, Inc. is submitting this fee proposal for Amendment No. 1 to the contract
for the above referenced project based on additional services requested. The following is a brief
description and cost for the additional services provided on this project:
1. Realignment of Sanitary Sewer Main Across Cramer Property
In order for the City of Fort Worth to acquire the easements to construct the Walsh Ranch
Phase IVA sewer main across the Cramer property, approximately 1,600 feet of the sewer
main has to be redesigned to follow a new route. A letter dated July 26, 2005 from TNP to
the City summarizes the events leading to the alignment change. In addition to the
engineering effort associated with the alignment change, it was also necessary to perform
topographical surveys and revise the easement documentation. A summary of the
additional engineering and surveying costs is presented below:
Sewer Main Redesign: = $ 12,500
Topographical Survey: = $ 7,000
Easement Documentation: = $ 1,300
Subtotal for Item 1: = $ 20,800
2. Additional Right-of-Way Acquisition Services
The original contract included three hours for appraiser testimony at a special
commissioners hearing. Any time beyond the three hours was to be included as additional
services. The original contract did also not include update appraisals in the scope. The
Cramer easement acquisition went to condemnation and required an updated appraisal and
additional hours for the appraiser and right-of-way agent to prepare for the hearings. The
Lost Creek Golf Club was scheduled to go to condemnation, but it was avoided through
extensive negotiations conducted by the right-of-way agents. An updated ra'sal was
also conducted for the Lost Creek Golf Club property. A summary of the additior akservices

Authorize Execution of Amendment No. 1 to Engineering Agreement with Teague Nall & Perkins,

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execut mendmen No. 1 to City
Secretary Contract No. 29059 with Teague Nall & Perkins, Inc., in the amount of$42,292.00, provide for
additional engineering services, thereby increasing the contract amount to $304,39 .
DISCUSSION:
On August 26, 2003, (M&C C-19729) the City Council authorized an engineering agreement with Teague
Nall & Perkins, Inc., in the amount of $262,100 for Walsh Ranch Sewer Main Extension, Phases IVA and
IVB.
Amendment No. 1 will provide compensation for the following:
• Additional design for the realignment of the project sewer main across private property. The owner of
the property had initially agreed to the original alignment but later objected. In order to expedite construction
of the project, staff agreed to redesign the route of the sewer main.
• Additional effort involved with easement acquisition beyond the original project scope.
The project will be located in COUNCIL DISTRICT 7 and pending the completed annexation for the project,
Mapsco 71 S, T, W and X.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Commercial Paper—Sewer Fund.
