AN ORDINANCE CORRECTING AN ERROR IN THE ASSESSMENT
PROCEEDINGS FOR THE PAVING AND IMPROVEMENT OF CAPPS
STREET IN THE CITY OF FORT WORTH, TEXAS, BETWEEN ITS
INTERSECTION WITH THE EAST LINE OF COLLEGE AVENUE AND
ITS INTERSECTION WITH THE EAST LINE OF THE M.S.&T.
R-O-W AG6INST THE OWNERS OF PROPERTY ABUTTING THEREON
AND THEIR PROPERTY,
BE IT ORDAINED,ADNDGED AND DECREED BY TEE BOARD OF COMMISSIONERS
OF THE CITY OF FORT WORTH, TEXAS, THATs
WHEREAS, on March 25th, 1913, the said Board of Commissioners of the
City of Fort Worth, Texas, passed and ordinance, levying, assessing and de-
creeing against the property owners and their property abutting on Capps
Street in the City of Fort Worth, Texas, between its intersection with the
east line of College Avenue and its intersection with the east line of the
M.H. 4 T. r-o-w, and fixed a lien on their property for the respective
assessments against each owner and their said property, and
WHEREAS, in said proceedings a clerical error occurred wherein the
name of Jake Stein was erroneously placed and written as the owner of Lot 13,
Block 1. South Hemphill Heights Addition instead of that of Capps Land Company,
who was then the legal owner of said property, and
WHEREAS, all other resolutions and proceedings with reference and per-
taining to the improvement of said portion of said Capps Street are in regular
due order, the said error is hereby corrected, as of the date of said assess-
ment, and the said Capps Land Company is adjudged and decreed and there is
assessed against it the said amount as shown in said assessment, and the name
of the said Capps Land Company is ordered placed in said original assessment
instead of that of Jacob Stein, and the said as made and shown in said asses-
meat proceedings and decree shall have the same force and binding effect
against the said Capps Land Company as though the error had not occurred
including all the provisions, requirements as stated in said ordinance.
It is further ordered that the Secretary of the City of Fort worth make
the eorr8ction in the said proceedings to comply herewith.
This ordinance and decree to take effect from its passage with the
effect of correcting the error in the original assessment as of the date of
the passage of the same, as above stated.
