No An ordinance requiring Steam Railway and Street Railway Companies to maintain suitable culverts, crossings and bridges on all pudic Lhe .ughfares, where their tracks intersect any such tbQrouAhfares in the City of Fort Worth, providing penalties for the violation of same and repealing all ordinances and parts of ordinances in confli0t here- with. - Y "BE IT ORDAINED Bi THE BOAR OF COnISSIONERS OF THE CITY OF FORT WORTH." Section 1:-All Steam Railway and Street Railway Companies whose tracks now, or may hereafter, enter or pass through the corporate limitsrof the City of Fort Worth, shall respectively repair, keep and maintain good, safe and sufficient culverts, crossings and bridges, with good, aeXs-and easy approaches thereto on all public Al le s streets and highways wh-- their,respective tracks pass under, across or over any alley, street:^ highway within said city, whether notified to do eo or not. Section 23-Any Steam Railway and Street Railway Company violating the provisions of Section 1 hereof shall be deemed guilty of a misdemeanor, and upon conviction shall be fined in any sum not exceed- ing One Hundred dollars. Section 3:-In the event prosecutions are instituted for violations of this ordinance, the Clerk of the Corporation Court, upon complaint duly and legally made, shall issue a a.,rlr:nn, w, ich F;haTl son= tain the corporate name of the offending company, the nature and character of the offense, giving the day and date thereof and commanding such company to be and appear through its duly authorized agent before the Corporation Court of said city, upon a day and date not earlier than three days from the service of said summons which shall be served by any qualified police officer of the city, upon the manager, superintendent S � � Y or any 'local agent representing such Steam Railway or Street Railway Company in the City of Fort Worth, or by leaving a copy of the same at the principal office of such company during office hours and the officer making such service shall make his return showing the way and manner in which service was had and such return shall be sufficient proof of service. In the event such company shall fail to appear, the Clerk of the Corporation Court shall enter a plea of not guilty for such M company, whereupon the Court shall hear the teetizgony and proceed to judgment. In the event a judgment imposing a finne is rendered against any such company and the same is not appealed from within the time prescribed by law, the Clerk of the Oorporation Court, upon order of the City Recorder, shell issue execution to collect the amount of said fine, together with all coste, the same to be directed to the chief of police and to be levied and executed in the same manner that executions are from the District and County Court and the said chief of police in levying on and selling the property of any such company shall have like power and authority as the sheriff in executions issued from the District or ,County Court and the laws of the State of Texas, so far as applicable shall applk to and be in full force and effect as to the N execution issued from the said Corporation Court' Section 41-All ordinances and parts of ordinances in conflict herewith, especially Seobi wrd -•oodTf'igrr'bp William D.
