AN ORDINANCE VACATING, ABANDONING AND CLOSING A
5 FOOT WIDE UTILITY EASEMENT ALONG THE SOUTH
LINE OF LOT 2-R, BLOCK 5, FACTORY PLACE ADDITION,
A LENGTH OF 143 FEET FROM CONCRETE STREET EAST-
WARD TO A POINT 5 FEET WEST OF THE EAST LINE OF
LOT 2-R, AS RECORDED IN VOLUME 388-42, PAGE 42
OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS;
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a 5 foot wide utility easement along the south line
of Lot 2-R, Block 5, Factory Place Addition, a length of 143 feet
from Concrete Street eastward to a point 5 feet west of the east
line of Lot 2-R, as recorded in Volume 388-42, Page 42, of Plat
Records of Tarrant County, Texas, be and the same is hereby
vacated, abandoned and permanently closed as a utility easement.
SECTION 2.
That the fee to the land in said utility easement is
hereby released and shall revert to the adjacent owners as provided
by law, SAVE AND EXCEPT that easements are retained for any and all
existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage and it is so
ordained.

R. D. Moses, dba/Ajax Glass Company, owner of all abutting property,
has requested that the City vacate the five foot wide utility easement
along the south line of Lot 2-R, Block 5, Factory Place Addition a length
of 143 feet from Concrete Street eastward to a point five teet west
of the east line of Lot 2-R, as recorded in Volume 388-42, Page 42,
P.R.T.C.T. and as shown on the attached map.
This easement, required by dedication, is not in use. Private utility
companies and City departments have reviewed this request and have no
objections to abandonment as requested.
Recommendation
It is recommended that an ordinance be adopted vacating subject easement
as requested.
