AN' ORDINANCE AMENDING CHAPTER 26, "MOTOR VEHICLES
AND TRAFFIC," OF THE CODE OF THE CITY OF FORT
WORTH (1964) , AS AMENDED, BY AMENDING SECTION
26-115 THEREOF, BY AMENDING THE CHARGES FOR MAIN-
TENANCE AND REGULATION OF WADING ZONES; PROVID-
ING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL PROVISIONS OF ORDINANCES AND OF SUCH CODE
AFFECTING MOTOR VEHICLES AND TRAFFIC, PROVIDING
FOR REPEAL; PROVIDING A SAVINGS CLAUSE; PROVID-
ING A SEVERABILITY CLAUSE; PROVIDING A PENAL
CLAUSE; AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 26-115 of Division 2 of Article VI of
Chapter 26 of the Code of the City of Fort Worth (1964) , as
amended, be and the same is hereby amended to read as follows:
"The City Traffic Engineer or such officer
or employee as he may designate is hereby au-
thorized to establish such loading zones as are
necessary for the conduct of business and to
properly sign and mark such zones. The charges
for maintenance and regulation of such loading
zones shall be as follows:
For loading zones located within any me-
•teted area or within that area cir-
cumscribed by and including the follow-
ing streets and/or their respective
projections:
Bluff, Henderson, Lancaster and Pecan --
One Dollar ($1.00) per linear foot per
month or fraction thereof
For loading zones in all other areas --
Fifty Cents (5011) per linear foot per
month or fraction thereof
"If the use of such loading zone is restricted
by the City to any period less than twenty-four
(24) hours per day, the charge for maintenance
and regulation of such loading zone shall be de-
termined by multiplying an above applicable rate
by that fraction consisting of the number of hours
of permitted loading zone use divided by twenty-four
hours."
SECTION 2.
That this ordinance shall be cumulative of all provi-
sions of ordinances and of the Code of the City of Fort
Worth (1964) , as amended, affecting motor vehicles and
traffic, except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances
and such Code, in which event such conflicting provisions of
such ordinances and such Code are hereby repealed.
SECTION 3.
That all rights or remedies of the City of Fort Worth,
Texas, are expressly saved as to any and all violations of
the provisions of Chapter 26 of the Code of the City of Fort
Worth (1964) , as amended, and of any other ordinance affect-
ing motor vehicles and traffic which have accrued at the
time of the effective date of this ordinance; and, as to
such accrued violations and all pending litigation, both
civil and criminal, whether pending in court or not, under
such chapter and/or other ordinances, same shall not be af-
fected by this ordinance but may be prosecuted until final
disposition by the courts.
SECTION 4.
That it is hereby declared to be the intention of the
City Council that the sections, paragraphs, sentences,
clauses and phrases of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this
ordinance shall be declared void, ineffective or unconstitu-
tional by the valid judgment or final decree of a court of
competent jurisdiction, such voidness, ineffectiveness or
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by
the City Council without the incorporation herein of any
such void, ineffective or unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION 5.
That any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor, and each
such person shall be deemed guilty of a separate offense for
each day or portion thereof during which any violation of
any of the provisions of this ordinance is committed, con-
tinued or permitted, and each violation shall be punishable
by a fine not to exceed Two Hundred Dollars ($200.00) .
SECTION 6.
That this ordinance shall be in full force and effect
from and after the date of its passage and publication as
required by law, and it is so ordained.

Some months a,go, the City Council expressed a desire to have the rates
for loading zones evaluated. Staff is in the process of finalizing a
'> report which evaluates not only loading zone rates, but all parking
Lry activity and demand in the downtown area. The entire report should
be published within the next few weeks; however, since loading, zones
3 ` are billed concurrent with the fiscal year, it is desirable to present
the findings and recommendations of the report dealing with the subject
of loading zones prior to October 1.
Currently, the rates charged .for loading zones are $7 per linear foot per
annum in metered areas, and $4 per linear foot per annum in all other
areas. These rates equate to an annual charge of $140 per year per space
in a metered area and $80 per year per space in an unmetered area.
The City staff has determined that the actual cost to the City of pro-
viding a loading zone is approximately $12.84 per linear foot per year
in the central business district, and $7.84 per foot in outlyin'; areas.
The computation of cost includes expenses of signing, marking, policing,
street improvement and maintenance, land, etc. Based upon these figures,
and future anticipated on-street narkinp, demand, the attached ordinance
which provides the following revised loading zone rates is recommended:
$1.00 per linear foot per month or fraction thereof ($12 per
linear foot per annum) within any metered area and within
the downtown area bounded by Henderson Street, Lancaster
Avenue, Pecan Street, and Bluff Street.
$.50 per foot per month or fraction thereof ($6 per linear
foot per annum) in any other area.
In addition, provision for a rate adjustment is suggested for those loading
zones restricted during certain hours of the day (i.e. , 7-9 a.m. , 4-6 p.m.) .
This rate adjustment would be a reduction computed from a ratio of the
number of restricted hours per day to twenty-four. In other words, the
charge for a loading zone restricted between the hours of 7-9 a.m. and
4-6 p.m. would be reduced by four twenty-fourths (4/24) of the normal rate
or $2 per foot per annum in a metered area, and $1 per foot per annum in
any other area.
Recommendation
It is recommended that the City Council approve the attached Ordinance
which amends Section 26-115 of the Code of the City of Fort Worth.
