AN ORDINANCE AMENDING SECTIONS 19-47 THROUGH
19-49 OF CHAPTER 19 OF THE FORT WORTH CITY
CODE (1964) , WHICH CHAPTER REGULATES HEALTH
AND SANITATION IN THE CITY OF FORT WORTH BY
REQUIRING EVERY PERSON WHO HANDLES FOOD IN
THE CITY TO HAVE IN HIS POSSESSION A HEALTH
CERTIFICATE RENEWED ANNUALLY; PROVIDING AN
ANNUAL FEE OF $4.00; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING
ALL ORDINANCES AND PROVISIONS OF THE FORT
WORTH CITY CODE IN CONFLICT HEREWITH; PRO-
VIDING A SEVERABILITY CLAUSE; PROVIDING A
PENALTY; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Section 19-47. Food handlers - Health certificate
required, of Chapter 19 of the Fort Worth City Code (1964)
is hereby amended and, after having been so amended, shall
hereafter read as follows:
"Sec. 19-47. Food handlers - Health certificate
required.
"Every person who handles food in any way
shall have in his possession at all times a
certificate of health issued by the director
of the department of public health stating that
such person does not have or is not a carrier
of any communicable disease. Health certificates
shall be renewed annually. No person who operates
any food establishment shall employ any person
to work in such food establishment who does not
have in his possession a health certificate is-
sued by the director of the department of public
health, which certificate has been issued within
the twelve months next preceding. The director
of the department of public health may cancel a
health certificate of any person when, after ex-
amination, such person is found to have some com-
municable disease or is a carrier of such disease.
The director of the department of public health
may, at his discretion, require the re-examination
of any food handler at any time.
SECTION 2.
That Section 19-48. Food handlers - Fee for examination
and issuance of certificate, of Chapter 19 of the Fort Worth
City Code (1964) is hereby amended and, after having been so
amended, shall hereafter read as follows:
"Sec. 19-48. Food handlers - Fee for examina-
tion and issuance of certificate.
"Every person who handles food in any way
and is required to have a certificate of health
issued by the director of the department of pub-
lic health shall pay to such department the sum
of four dollars for such examination and the is-
suance of such certificate of health."
SECTION 3.
That Section 19-49. Food handlers - Duration of certif-
icates; fee required on renewal, of Chapter 19 of the Fort
Worth City Code (1964) is hereby amended and, after having
been so amended, shall hereafter read as follows:
"Sec. 19-49. Food handlers - Duration of certif-
icates; fee required on renewal.
"All health certificates shall be valid for
a period of twelve months from the date of their
issuance unless sooner revoked. The fee of four
dollars as herein provided for shall be paid upon
the issuance of each new certificate or any annual
renewal thereof."
SECTION 4.
That this ordinance shall repeal every prior ordinance
and provision of the Fort Worth City Code in conflict here-
with but only insofar as the portion of such prior ordinance
or provision shall be in conflict, and as to all other ordi-
nances or provisions of the Fort Worth City Code not in direct
conflict herewith, this ordinance shall be and is hereby made
cumulative.

SECTION 5.
That if any section, part of a section or provision of
any section of this ordinance shall be held to be void, in-
effective or unconstitutional by a court of competent juris-
diction, the holding of such section, part of a section or
provision of any section to be void, ineffective or unconsti-
tutional for any cause whatsoever shall in no way affect the
validity of the remaining sections and provisions of this
ordinance, which shall remain in full force and effect. The
City Council would not have passed any sections, parts of
sections or provisions of any section of this ordinance that
were unconstitutional, void or ineffective if it had known
that they were unconstitutional, void or ineffective at the
time of adopting this ordinance.
SECTION 6.
That the violation of any provision of this ordinance
or of the Fort Worth City Code relating to health and sani-
tation shall be deemed an offense and punishable by a fine
not exceeding Two Hundred Dollars ($200) , and each violation
thereof, and each day on which there is a failure to comply
with the terms of this ordinance shall be and is hereby deemed
to be a distinct and separate offense and punishable as such.
SECTION 7.
That this ordinance shall be in full force and effect
from and after its passage and publication as required by law.

The Fort Worth City Code provides that "Every person who handles food in
any way shall have in his possession at all' times a certificate of health
issued by the director of the department- of-public health stating that
such person does not have or is not a carrier- of any communicable disease".
Provision is currently made that such health- certificates shall be renewed
semiannually and a fee of $2 has been established for each renewal. A
renewal of a health certificate requires a process consisting of a blood
test and x-ray examination at the Public- Health Department-
For reasons stated below, it is recommended that health certificates for
food handlers be renewed on an annual basis rather than semiannually and
that the fee for each renewal be established at $4.
1) An annual renewal and examination by the Public Health Department
would reduce the total time required for this process by the
Public Health staff. This should result in a substantial cost
savings.
2) Since chest x-rays are given to applicants for a health certifi-
cate, an annual examination would reduce the amount of x-ray
exposure to food handlers, while still providing adequate safe-
guards as far as the public health is concerned.
3) The annual cost for renewal of health certificates to those per-
sons who are permanent residents of Fort Worth would be the
same ($4), although the cost to the transient or temporary
food handler in the area would be increased since a health
certificate obtained for a short period of employment would
cost $4 instead of $2. The net result should be that the
annual revenue received for renewal of health certificates will
be increased.
Recommendation
It is recommended that the City Council adopt an ordinance amending the
Fort Worth City Code as described above. The effective date of the pro-
posed amendments will be upon approval by the City Council and following
publication as required by law, although it is anticipated that approxi-
mately two weeks will be allowed before implementation so that major em-
ployers of food handlers can be notified of the changes.
