HomeMy WebLinkAboutOrdinance 6167 + t s ' ORDINANCE NO, `y 1 ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF CANNON STREET AND PORTIONS OF SUNDRY OTHER STREETS, 41VENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH GENERAL CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with General Construction Company for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in .said City, to-wit: 1. CANNON STREET From the east line of Bryan Avenue to the west line of Crawford Street, known and designated as Unit No. 11 Project No. 104-24000-178. 2. BSRENTWOOD STAIR ROAD From the east line of Muse Street to the east property lines of Lot 6R, Block 6, and Lot 1R, Block 3, Ryanwood North Addi- tion, known and designated as Unit No. 2, Project No. 104-24000-178. 3• VERBENA STREET From the east line of New York Avenue to the west line of Bransford Street, known and designated as Unit No. 3, Project No. lo4-24000-178. 4. BINKLEY STREET From the north line of Bideker Street to the south line of Burchill Road South, known and designated as Unit No. 4, Project No. 104-24000-178. 5. WHITSON STREET From the north line of East Lancaster to the north property lines of Lot 10, Block 8, and Lot 1, Block 9, Interurban Addition, 2nd Filing, known and designated as Unit No. 5, Project No. 104-24000-178. 6. NEW YORK AVENUE From the north line of Cantey Street to the south line of Judd Street, known and designated as Unit No. 6, Project No. 104-24000-178. 7. NEW YORK AVENUE From the north line of Judd Street to the south line of Morningside Drive, known and designated as Unit No. 7, Project No. 104-24000-178. 8. W POI }1 B':-s F VqgTf C l ;- jump parc-aryL go r WHEREAS, by sundry proceedings heretofore 5= s&d by the City Council of the city of Fort Worth, Texas, including Ordinance No. , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the city of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance Nos. 5995 & 6012 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THIS CITY OF FORT WORTH, TEXAS, THAT.- I® The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; .and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the city Secretary is directed to attest same and impress thereon the corporate seal of the city, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows. zII. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the. appropriate Ordinance Records of said City. DATE REFERENCE SUBJECT: Final Payment - Assessment PAGE 9/22/69 NUMBER Paving at 12 Locations on 2 FP-661 the Southeast Side of �e_ Minor variations between quantities estimated in the contract specifications and quantities measured and used at the job site resulted in additional savings of $5,048.80, making a total under-run of $20,578.10. Compliance with Specifications During testing on this project,- 35 corings were made with the following results: Exceeds Even with Under Specs But Below Specs Specs Within Tolerance Tolerance Pavement 17 10 8 0 Lime Stabilized Sub-grade 10 25 0 0 On the entire project with the exception of Unit 2, Brentwood Stair Road, the average thickness of the hot mix asphaltic concrete was 6.12 inches as compared to the 6 inches specified, and the average thickness of the lime stabilized sub- grade was 6.07 inches as compared to the 6 inches specified. On Brentwood Stair Road where 7 inches of hot mix asphaltic concrete was required over a 6 inch lime stabilized sub-grade, one core was made. This one core disclosed that the hot mix asphaltic concrete was 7.25 inches thick and the lime stabilized sub- grade was 6 inches thick. Tests made during the constructioxl of sub-grade and pavement show that materials used were in compliance with contract specifications. Recommendation It is recommended that an Ordinance be adopted accepting the above project and that final payment of $9,316.54 be authorized to General Construction Company.
