AN ORDINANCE AMENDING SECTIONS 204 AND 205 OF
ORDINANCE NO. 4155, WHICH IS THE BUILDING CODE
OF THE CITY OF FORT WORTH, BY INCREASING THE
MEMBERSHIP OF THE BOARD OF APPEALS FROM THREE
(3) TO FIVE (5) MEMBERS; PROVIDING THAT THREE
(3) MEMBERS SHALL CONSTITUTE A QUORUM; PROVID-
ING A SEVERABILITY CLAUSE; MAKING THIS ORDI-
NANCE CUMULATIVE OF OTHER ORDINANCES OF THE
CITY OF FORT WORTH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 204 of Ordinance No. 4155, which is the Building
Code of the City of Fort Worth, be and the same is hereby amended
so that the same shall hereafter be and read as follows:
Sec. 204. Board of Appeals. In order to provide
for reasonable interpretations of this code and to
determine the suitability of alternate materials and
types of construction, there shall be and is hereby
created a Board of Appeals consisting of five (51
members. One member shall be a Registered Architect,
one member shall be a Registered Structural Engineer,
one member shall be a General Contractor and one
member shall be selected at large from thebuilding
industry, all of whom Should be qualified by experience
and training to pass upon matters pertaining to build-
ing construction. The other member of the Board shall
be a representative of the Insurance Industry, know-
ledgeable in the influence which various types of
building construction and materials will have on the
fire insurance rates. The Board of Appeals shall be
appointed by the Mayor and the members shall be
appointed for a two (2) year term.
SECTION 2.
That Section 205 of Ordinance No. 4155, which is the Building
Code of the City of Fort Worth, be and the same is hereby amended
so that the same shall hereafter be and read as follows:
Sec. 205. Quorum, By-Laws, Records, A quorum
for the transaction of business of the Board of Appeals
shall consist of three (3) members. The Board of
Appeals shall select a Chairman who shall act
as presiding officer of the Board and who shall
be responsible for the management and operation
of the Board of Appeals. The Board of Appeals
shall select a Secretary who shall be responsi-
ble for the keeping of minutes of the meetings
and records, and the City of Fort Worth shall
provide such secretarial assistance as may be
required. The Board of Appeals shall conduct its
business in a manner consistent with this Code
and shall make such rules of procedure as it
deems necessary.
SECTION 3.
That if any section, subsection, sentence, clause or phrase
of this ordinance is for any reason held to be unconstitutional,
such holding shall not affect the validity of the remaining por-
tions of this ordinance, and all of the remainder of this ordi-
nance not so held to be unconstitutional shall continue to be in
full force and effect.
SECTION 4.
That this Ordinance shall repeal every prior ordinance of
the City of Fort Worth regulating the construction, reconstruc-
tion and maintenance of buildings and structures in conflict
herewith but only to the extent that the portion of such prior
ordinance or provision shall be in conflict, and as to all other
ordinances and provisions of the Building Code not in direct con-
flict herewith, this ordinance shall be and is hereby made cumu-
lative.
SECTION 5.
That this ordinance shall become effective and be in full
force and effect from and after the date of its passage and it
is so ordained.

The Building Code of the City of Fort Worth (Ordinance No. 4155) provides for
a Board of Appeals consisting of one registered architect, one registered
structural engineer, and one general contractor who are qualified by experience
and training to pass on matters pertaining to building construction.
The duties of the Building Code Board of Appeals consist of the hearing of
appeals of decisions of the Building Official and the review and approval of
new materials and designs which are being introduced in the construction
industry. It is important that this board be so` constituted as to provide
the service which it is intended to give at reasonable and frequent intervals.
It has become increasingly difficult due to the work load and length of the
meetings to obtain a quorum, which results in loss of time to builders,
contractors and owners alike.
The Board has recommended and the staff concurs that the membership of the
Building Code Board of Appeals be increased in number from three to five with
three members constituting a quorum. It is further recommended that one of
the additional two members be a representative of the insurance industry,
knowledgable in the influence which various types of building construction
and materials will have on fire insurance rates, and that the other member
be at large from the building industry.
Recommendation
It is recommended that the attached ordinance be adopted amending Section 204
and 205 of Ordinance No. 4155, which is the Building Code of the City of
Fort Worth, by increasing the membership of the Board of Appeals from three
to five members, and providing that three members shall constitute a quorum.
