HomeMy WebLinkAboutOrdinance 2367 ORDINANCE N0. AN ORDINANCE ORDERING A SPECIAL HOM-HULE ELECTION IN THE CITY OF FORT WORTH, TEXAS, TO BE HELD ON TUESDAIS THE 17TH DAY OF DECFMR, A. D. 1946, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY, FOR ADOPTION OR RE- JECTION, PROPOSED AMENDMENTS TO THE SgISTING CHARTER OF THE CITY OF FORT WORTH, INCLUDING IN SAID PROPOSED AMEND- IMTS THE ANNEXATION OF ADJACENT AND CONTIGUOUS TERRITORI, THE POVMR AND AUTHORITY OF THE.CITY COUNCIL TO ANNEX AD- JACENT AND CONTIGUOUS TERRITORY BY ORDINANCE, PROVIDING FOR THE SELECTION OF THE TRUSTEES AND OFFICERS FOR THE DEPARTMENT OF PUBLIC LIBRARIES, INCREASING THE TAX LEVY FOR THE DEPARTMENT OF PUBLIC LIBRARIES, AND INCREASING THE TAI LEVY FOR THE DEPARTMENT OF PUBLIC RECREATION; DESIGNATING THE PLACES AT MICH SAID ELECTION IS TO HE HELD; APPOINTING PRESIDING OFFICERS THEREOF; AND DECLARING AN EMEH( NCY. WHEREAS, on the 9th day of October, A. D. 1946, an ordinance was drily passed by the City Council of the City of Fort Worth, Tessa, giving das notice, in strict compliance with the statutes of the State of Tessa and other applicable laws, of its intention to pass an ordinance provid- ing for the submission to the cptalified voters of said City of Fort Worth of proposed amendments to the existing Charter; and, WHERVAS, notice of intention to submit such charter amendments was duly given by publication in The Fort Worth Press. a newspaper published daily in the City of Fort Worth and the official newspaper of said City, which notice was published for ten (10) days, the date of the first pub- lication thereof being not leas than twenty (20) days next preceding the date of the adoption of this ordinance; and, 1HEREAS, the City Council of the City of Fort Worth, in the exer- cise of the discretion reposed in it by the Constitution and the laws of this state relating to the amendment of city charters by cities having more than five thousand (5,000) inhabitants, doom it wiae and necessary to submit the proposed amendments to the existing Charter of said City, hereinafter set forth, at a special election to be held in said City on Tuesday, the 17th day of December, A. D. 1946; and# MHO=, it appears that no regular municipal election will be held in said City within ninety (90) days after the passage of this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TSXAS: SECTION 1. That a special election be held in the City of Fort Worth, Texas, on Tuesday, the 17th day of December, A. D. 1946, for the purpose of sub- mitting to the qualified voters of said City, for adoption or rejection, the following proposed amendments to the existing Charter of the City of Fort Worths AM12MU NP N0. I. Shall Chapter X%IY of the existing Charter of the City of Fort Worth, which chapter sets forth and defines the present corporate bound- aries of said City by metes and bounds, be amended by adding thereto Section 2 (b), which reads as follows: Section 1 (b). The corporate boundaries of the City of Fort Worth, Texas, shall be changed so as to annex certain adjacent and contiguous territory to said City by extending said boundary lines as follows: The area embracing the Fort Worth Army Quartermaster Depot, %sty Lake Area, and Major Airport Site west of Bvernan, situated in Tarrant County, Tozas: Beginning at a point in the present city limits, said point being the southeast corner of Block 42, Seminary Hill Addition; thence south-to a point; thence east crossing James Avenue, and continuing east along the south boundary line of the Fort Worth Army Quartermaster Depot to a point 300 feet west of the westerly right of way line of U. S. Highway No. 81; thence in a southerly direction 300 feet west of and parallel to the westerly might of way line of said U. S. Highway No. 81 to a point west of the southwest corner of the G. W.' Main Survey; thence east passing the southwest corner of said G. W. Main Survsy'and continuing east along the south line of said Main Survey to its south- east corner; thence north along the east line of said Main Survey passing its northeast corner, same being the southeast corner of the J. Bursey Survey, and continuing north along the east line of the J. Bursey Survey to the southwest corner of Block No. 4, Shelby County School Lund; thence east along the south line of said Block No. 4, Shelby County School Land, and continuing east along the south line of Block No. ll, Shelby County School Land, to a point in the present city limit line of the City of Ehersnan, said point being 1710 feet west of the southeast corner of Block No. 11, Shelby County School Land; thence north 1710 feet west of and parallel to the east line of said Block No. 11 passing the north- west corner of the Sherman city limita to the north line of said Block No. nand the south line of Block No. 12, Shelby County School Land; thence east along the south line of Block No. 12 and the north line of Block No. 11, Shelby County School Land, to the south- west corner of the Isaac Griffith 21.36 acre tract in the east portion of said Block No. 12; thence north along the west -line of said Griffith 21.36 acre tract to the northwest corner of said tract in the north line of Block No. 12, Shelby County School Land, and the south line of Block No. 13, Shelby County School Land; thence west along the south line of said Block No. 13 to the southwest corner of the I. AMMDMW NO. II. Shall Chapter I M of the existing Charter of the City of Fort North, which chapter sets forth and defines the present corporate boundaries of said City by mates and bounds, be amended by adding thereto Section 2 (b), which reads as follows: Section 2 (b). The corporate boundaries of the City of Fort Worth, Texas, shall be changed so as to annex certain adjacent and contiguous territory to said City by a4endtzig said boundary lines as follows: The area embracing both sides of the West Fork of the Trinity Rivers including Greemrood Cemetery, Brookside Acres, and the area lying between the West Fork of the Trinity River and the easterly, southerly and westerly city limit lines of the City of River Oaks, situated in Tarrant County Texans Beginning at a point in the present city limit line of the City of Fort Worth, said point being in the southeasterly line of State Highway No. 183, 350 feet northerly from the *enter line of the Jacksboro Highway (State Highway No. 1"); thence southwesterly along the southeasterly line of State Highway No. 183 to a point in the south- westerly line of the Jackaboro Highway (State Highway No. 1"), said point being a corner in the present city limit line of the City of River Oaks; thence southwesterly along the southeasterly line of State Highway No. 183, being the present city limit line of the City of River Oaks, and continuing southerly, westerly and northerly with the present city limit line of the City of River Oaks to its intersection with the north line of the Lake Worth Dam Road or meandering Road in the N. The corporate boundaries of the City of Fort Worth, Texas, shell be changed so as to annex certain ad4acent and con- tiguous territory to said City by extending said boundary lines as follows: The area embracing Boas Park, Alta More Addition, Highland Homes Addition, Golf Hills Addition, Z. Boas Country Place Addition, Ridglea Hills Addition, a portion of Ridglea Addition, and Bidglea Golf Course, situated in Tarrant County, Texas: Beginning at a point in the present city limits, said point being in the north line of the Old Stage Coach Bead (Calmont Avenue) 50 feet north and 50 feet west of the northwest corner of Block 4, Ridglea Addition; thence west along the north line of the Old Stage Coach Road (Calmont Avenue) to the east line of the Grafa-Maryla Creek Fbad; thence south along the east line of said Grafa4fary's Creek Road to its intersection with the westerly line of U. The corporate boundaries of the City of Fort Worth, Texas, shall be changed so as to annex certain adjacent and con- tiguous territory to said City by extending said boundary lines as follows: The area embracing the south portion of Bluebonnet Hills Addition, a portion of the S. C. Inman Surrey, F. G. Beasley Survey, S. Swarthout Survey, B. B. B. & C. R. R. Co. Surrey, J. Howard Survey, portion of T. B. Taylor Survey and Be Soutberland Survey, portion of T. McCann Sur- vey, J. P. Weddington Surrey, portion of J. Jennings Survey and Trinity Addition, situated in Tarrant County, Texas: Beginning at a point in the present city limits, said point being in the east line of Rogers Avenue at its intersection with the north bank of the Clear Fork of the Trinity River; thence westerly along the north bank of said river with its meanders to its intersection with the west line of the F. G* Beasley Survey; thence south along the west line of said Beasley Survey, crossing said river and continuing south along the west lines of the F. G. Beasley Survey, the B. B. B. & C. R. R. Co. The corporate boundaries of the City of Fort Worth, Texas, shall be changed so as to annex certain adjacent and con- tiguous territory to said City by extending said boundary lines as follows: The area embracing land south of the Village of Oak Knoll, being a portion of the L. G. Tinsley Survey, situated in Tarrant County, Texas: Beginning at a point in the present city limita, said point being in the south line of East First Street and in the west line of the Howard-Haltom Road near the northeast corner of Block 4, Page Company's East Side Addition, Second Filing; thence northerly and easterly along the westerly line of the Howard-Haltom Road to a point in the city limit line of the City of Oak Knoll Village, said point being at the southeast corner of said Oak Knoll Village; thence west along the city limit line of said Oak Knoll Village to the west line of Kings Highway, said point being in the present.city limit line of the City of Fort Worth; thence south along the west line of Kings Highway, being the present city limits of the City of Fort Worth, and continuing along the present city limit line of the City of Fort Worth to the place of beginning. B. Haney Surrey, portion of k. Garrison Survey and F. Jones Survey, situated in Tarrant County, Texas: Beginning at a point in the present city limit line, said point being in the north line of keadanrbrook Drive and in the east line of the J. B. Haney Survey; thence north along the east line of the J. B. Haney Survey and the east line of the A. Jordan Survey to the northeast corner of said Jordan Survey; thence west along the north line of the A. 'Jordan Survey to the easterly line of the keadowbrook Mu- nicipal Golf Course; thence along the boundary line of said Meadorbrook Municipal. The corporate boundaries of the City of Fort Worth, Texas, shall be changed so as to annex certain adjacent and con- tiguous territory to said City by extending said boundary lines as follows: The area embracing land to the south of the Municipal Airport and north of N. W. 35th Street, situated in Tarrant County, Texas: Beginning at a point in the present city limits, said point being 347.2 feet south, 69 degrees 36 minutes east of the most westerly southwest corner of said ku- nicipal Airport; thence south to a point in the present city limits, said point being in the south line of N. W. 35th Street; thence east along the south line of N. W. 35th Street, being the present city limits, and continuing north and west along the present city limits to the place of beginning. AMENDMENT No. VIII, Shall Chapter IM of the existing Charter of the City of Fort Worth, which chapter sets forth and defines the present corporate bound- ariee of said City by metes and bounds, be amended by adding thereto Section 8 (b), which reads as follows: Section 8 (b). The corporate boundaries of the City of Fort Worth, Texas, shall be changed so as to annex certain adjacent and con- tigaous territory to said City by extending said boundary lines as followas The area embracing the land lying between Buck Sansom Park and N. W. 32nd Street, situated in Tarrant County, Texas: Beginning at a point in the present city limits, said point being the most westerly southwest corner of Back Sansom Park; thence south 45 degrees west along an exten- sion of the most westerly line of Buck Sansom Park to a point in the present city limit line, said point being in the northeasterly line of Block 216, Rosen Heights Second and Third Filing, and in the westerly line of N. W. 32nd Street; thence southeasterly along the westerly line of N. W. 32nd Street, being the present city limit line, and continuing along the present city limit line to the place of beginning. AMMIMT H0, IY. Shall Chapter XUX of the existing Charter of the City of Fort Worth, which chapter sets forth and defines the present corporate bound- aries of said City by metes and bounds, be amended by adding thereto Section 9 (b), which reads as followst Section 9 (b). The corporate boundaries of the City of Fort Worth, Texas, shall be changed so as to annex certain adjacent and con- tiguous territory to said City by extending said boundary lines as follows: The area embracing the land east of the Sewage Disposal Plant and west of the Trinity River, and the land south and went of mite Lake, situated in Tarrant County, Texas: Beginning at a point in the present city limits, said point being at the northeast corner of the Wim. Edwards Survey; thence north along the east line of said Edwards Surrey produced 300 feet; thence west 300 feet north of and parallel to the north line of said Edwards Surrey, and continuing west crossing the Trinity River to a point in the present city limit line; thence south along the present city limit line and continuing along the present city limits to the place of beginning. XVII. Shall Chapter IXCVIII pf the existing Charter of the City of Fort Worth be amended by adding thereto Section 40, which reads as follows: Section 40. The City Council shall have power, by ordinance, to fix the boundary limits of the City of Fort Worth, Texas, and to pro-. vids for the alteration and the extension of said boundary limits, and the annexation of additional territory lying adjacent to the City, with or without the consent of the territory and inhabitants annexed. upon the introduction of any such ordinance in the City Council, it shall be published in the form in which it may be finally passed, in a daily news- paper, published in the City of Fort Worth, Texas, at least one time, and said ordinance shall not thereafter be finally acted upon until at least thirty (30) days have elapsed after the first publication thereof; and upon the final passage of any such ordinance, the boundary limits of the City shall thereafter be fixed in such ordinance; and when any additional territory has been so annexed, same shall be a part of the City of Fort Worth, Texas, and the property situated therein shall bear its pro rats, part of the taxes levied by the City, and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens, and shall be bound by the acts, ordinances, resolutions and regulations of the City. AMENDUM N0. IVIII. Shall Section 1, Chapter IVII, of the Darter of the City of Fort Worth be amended and, after being amended, read as follows: Section le All public free libraries and reading rooms of the City of Fort Worth shall be under the supervision of a Board of Trustees, which shall be thirteen (13) in numbers composed of both men and women, to be known as the Library Board. The members of the Library Board shall be appointed by the City Council and shall be subject to removal in the way and manner provided for the removal of the members of the park Board, as defined in Section 3, Chapter IVIII, of the City Charter. AMENDMT NO. IIY. Shall Section 2, Chapter XVII, of the Charter of the City of Fort Worth be amended and, after being amended, read as follows: Section 2. .The Hoard of Trustees shall elect from its members a President, a First Mice-president, a Second Vice-President, a Treasurer, and also a Socretary, who may or may not be a member of said Board. The members of said Hoard will be qualified voters of the City of Fort Worth, and shall serve without compensation. AIRNDMT N0. IX* Shall Section 4, Chapter XM, of the Charter of the City of Fort Worth be amended and, after being amended, read as follows.- Section 4. An annual tax of five cents on the one hundred dollar valuation of all taxable property situated within the city linita of the City of Fort Worth shall be annually levied and collected by the City Council for the benefit of the Public Libraries of the City of Fort Worth. 17 The fund arising from said tax levy, together with all sums appropriated by the City Council in the annual budget for library purposes, shall be deposited and kept by the City Treasurer in a separate fund known as the Library Fund, and shall be paid out only upon warrants issued by said Board of Trustees, signed by its president and countersigned by its treasurer. AMRMI ENT NO. XXI• Shall Section 6, Chapter M, of the Charter of the City of Fort Worth be amended and, after being amended, read as follows: Section 6. Fends for maintenance of Recreation Department to be Derived Frum Receipts of the Department and From an Annual Ad Valorem Tax Levy of not Less Than Your Cents (40) per Annum on Each $100.00 of Valua- tion -- Said Amounts to be Placed in the Budget for the Benefit of This Department .,r. Public Recreation Board to Assume Payment of Outstanding Indebtedness Against Swinging Pools or Either Recreation Grounds. -- The City Council, when levying the taxes for each fiscal ar, shall levy an annual ad valorem tax of not lass than four cents (ytron each one hundred dollars ($1.00) of assessed value of all real and personal property in the City, not exempt from taxation by the Constitution and laws of the State, for the use and benefit of the Recreation Fund. In addition thereto the said Recreation Fund shall be allowed all the receipts and revenues aris- ing from the operation of the various recreational activities placed under the administration of this department; and the said ad valorem tax and the said receipts, together with whatever further amount, if any, the City Council may set apart in its annual budget for the use and benefit of this department, shall constitute the appropriation to be annually act apart in the said budget for the operation, maintenance and upkeep of this department. The said tax, when collected, shall be deposited with the City Treasury to the credit of the Recreation Fund, and said sums, to- gether with all sums appropriated by the City Council in the annual budget for recreational purposes, or received from other sources, shall be deposited and hold by the City Treasury in a separate account to the credit of the Recreation Fund, subject to the order and disbursement of the Public Recreation Board for the purposes and in accordance with the provisions of this Chapter, and the same shall be paid out upon warrantal/ issued by the Public Recreation Board, signed by the President or Vice- President of the said Board, and countersigned by the Commissioner of Accounts and the Secretary of the Public Recreation Board. All debts and liabilities heretofore created by the former Public Recreation Board under the previous Charter, together with all debts and liabilities existing against the swimming pools and other recreational activities heretofore functioning under the former Park Board of this City, shall be assumed by the Public Recreation Board hereby created, and the funds accruing to the said Board from the sources hereinbefore specified or so much thereof as may be necessary, shall be used in the discharge and payment of the said debts and liabilities. That it shall be the duty of the City Secretary to prepare the of- ficial ballot, on which official ballot shall appear the proposed amend- ments not out in Section 1 of this ordinance, and after each of said pro- posed amendments shall be printed the words "Yes," "No," in order that the voter may vote "Ies" or "No" on each of said proposed amandments. SECTION S. That all voters desiring to vote for the adoption of any of the pro- posed amendments shall permit to remain on their ballot, with respect to each proposed amendment which they desire to have adopted, the word "Yes"; and those opposed shall permit to remain on their ballot, with respect to each amendment which they desire to have rejected, the word "No." SECTION 6. That the City Secretary shall at once mail a copy of each of the proposed amendments to every qualified voter in the City of Fort worth, Texas, as appears from the rolls of the Tax Collector of Tarrant County, Texas, for the year ending January 31, 1946. SECTION 7. That a copy of this ordinance shall be sufficient notice of said elec- tion, and thirty (30) days' notice of the time and places of holding the said election shall be given by publication of such notice in the official newspaper of said City once each week for four (4) weeks, the date of the first publication being not less than thirty (30) full days prior to the date of the election. SECTION 8. That each proposed amendment as is set forth hersinabove, if approved by a majority of the qualified voters voting upon said amendment, shall become a part of the Charter of the City of Fort Worth as soon as an offi- cial order and ordinance has been entered upon the records of said City by the governing body thereof, declaring the same adopted. SECTION 9.
