AN ORDINANCE GRANTING TO THE ST.LOUIS SOUTHWESTERII RAILWAY CMPANY OF TEXAS T33R RIGHT TO CONSTRUCT, MAINTAIN AND OPERATE A CERTAIN TRACK OR TRACKS ACROSS FIRST STREET, BETWEEN Ht4MON AND HAYS STREETS, PROM A POINT ON THE EAST LINE OF BLOCK 16, TO THE ICIEST LINE OF BLOCK 109 IN THE CITY OF FORT ;'JOR TH, TARRANT C OURrY, T=AS. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FT. WORTH,TEXAS : Section 1. That the St.Louia Southwestern Railway Company of Texas, is hereby granted the right, privilege and franchise to construct, maint&.in and operate a spur track across First Street from a point on the South line of First Street 128 feet, more or less, east of the east line of HAMPTON STREET , to a point on the North lire, of First Street 148 feet, more or less, east of the east line of Hampton Street as is shown in "RED" on blue print map hereto attached and marked n ,EXHIBIT A n and made a part of this ordinance. Section II. It is provided that : (a) The rail and equipment use& in the construction of all of said tracks on, across or along said streets shall be of standard quality, and the construction shall be satisfactory to the City Engineer and Board of Commissioners of the City of Ft. Forth. (b ) St.Louis Southwestern Railway Company of Texas shall maintain the space between the rails of all of said tracks, and for eighteen inches on each side thereof, as near as may be level with the tops of any such tracks, and the same shall be constructed and maintained so as not to unnecessarily obstruct or endanger travel on said streets , or any portion thereof; and the construotion, maintenance and operation of said tracks, and of the streets between the rails, and for eighteen inches outside of such rails , shall be satisfactory to the City Engineer and the Board of Commissioners of the City of Ft.Worth. Section III. The said St.Louis Southwestern Railway Company of Texas, its successors and assigns, shall, at its or their own cost and expense, pave and repave or other- wise surface and resurface and keep in good order and con- dition, the space between the rails of b.11 of said tracks and for eighteen inches on each side thereof, with the same material with which the streets - �r are paved and surfaced, and shall conform its or their tracks, or any part thereof, to the proper grade of s -id streets, and change the grade thereof as often and whenever the grade of said streets are changed, so that all parts of said tracks shall always be kept at the duly established grade line, or as near thereto as the sur- face of the grade of streets will permit. SECTIO-N IV. Said St.Louis Southwestern Railway _ Company of Texas, its successors and assigns, do agree to inae—=—I fy` and save the City of Ft . Worth harmless from any and all damages, claims, judgments and other costs and expenses receovered against or paid by the said City of Ft.Worth by reason of injuries either to persons or property proximately caused by or arising out of the construction, maintenance and operation of said tracks, upon and along said street; provided said Railway Company is notified by WAS- said City of Ft. Worth of the claim so Made or the suit brought against said City, and approves the settlement of the claim or is permitted to participate in the defense of any suit brought thereon. SECTION V. This ordinance shall take effect and be in force from and after its passage. I hereby oertify that the above and foregoing Ordinanae was X29K duly presented and unanimously adopted by the Board of Commissioners ' of the City of Fort Worth, Texas at a regular session of said Board held Tuesday August 5th, d. 1919.
