AN ORDINANCE APPROPRIATING REVENUE OF THE CITY OF FORT WORTH OF AN ADDITIONAL $3,100 FROM THE UNAPPROPRIATED SURPLUS FUND BALANCE TO ACCOUNT NO. 845-84501 TO COVER THE INCREASED CITY PARTICIPATION IN THE AIR POLLUTION CONTROL PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ORDINANCES IN CONFLICT HEREWITH AND APPROVING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the City Manager of the City of Fort Worth shall be provided with such revenue as may be secured from various sources included in Ordinance No. 7787 and in the Budget of the City Manager; and in addition thereto there is appropriated from the Unappropriated Surplus Fund Balance to Account No. 845-84501 the amount of $3,100 to cover the increased City participation in the Air Pollution Control Program. SECTION 2. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sections or parts of sections of this ordinance, which provisions shall be, remain and continue to be in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 7787, but all other ordinances and appropriations for which provision has been heretofore made are hereby expressly repealed if in conflict with the provisions of this ordinance. SECTION 4 That this ordinance shall tape effect and be in full force and effect from and after the date of its passage, and it is so ordained. On July 18, 1978 (M&C G-3871) , the City Council approved submission of an application to the Environmental Protection Agency to. provide funding for the APC program for the period October 1, 1978, through September 30, 1979. The application authorized at that time allowed for total program costs of $185,869. Of these costs the EPA was to contribute $66,669 and the City $119,200. The City match was based on the anticipated level of expenditures for 1977-78 and was projected to exceed that amount to comply with the EPA Maintenance of Effort Regulation. However, final expenditures for 1977-78 exceeded estimates rendering the City match amount in noncompliance. Following preliminary review of the City's proposal, the Regional EPA advised that the application did not comply with Federal regulations as it proposed to appropriate fewer City funds to the program than was expended in the previous fiscal year. Failure to provide funds equivalent to the previous year's expenditures could result in a loss of the Federal allocation. The EPA further advised that monies are available to increase the Federal participation in the Fort Worth program for $66,669 to $70,254. However, the request for these funds can be considered only if the City amends its application, obligating funds equivalent to the 1977-78 actual expenditures. Funding The changes suggested by the EPA require amendments to the 1978-79 budget as indicated in the table below. The City's contribution would increase from $119,200 to $122,300, City Funds Federal Funds Total. The changes to the grant application described above will further delay award of the 1978-79 grant, perhaps as long as March, 1979. Consequently, it is requested that funds be made available to sustain the APC program for the period December 1, 1978, to March 31, 1979. Recommendation It is recommended that the City Council authorized 1) The City Manager to amend the 1978-79 grant application to the Environmental Protection Agency requesting $70,254 in Federal funds and increasing the City's contribution to $122,300; 2) The appropriation of an additional $3,100 to Account No. 845-84501 to cover the increased City participation; and, 3) The expenditure of City matching funds to sustain the Air Pollution Control program uAtil March 31, 1979.
