ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF NORTH BEACH STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Texas Bitulithic Company , for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit! NORTH BEACH STREET From I. H. 820 to 3600' north, known and designated as Project No. 104-36000-368, a seven-inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high super- imposed concrete curb on two twenty-six foot traffic lanes with a forty-eight foot earth median. Six-inch thick concrete driveways and approaches will be con- structed where specified. Two single right-turn lanes, one single left-turn lane and one double left-turn lane will be constructed at the Motorola site. WHEMS, by sundry proceedings heretofore passed by the City Council of the City of Port Worth, Texas, including Ordinance No. 7416 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHER AS, the City Council of the City of Port Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 7416 , and WHM3AS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, TH-�,,RSFORE, BE IT ORDAI`i"34D BY TILT CITY COUNCIL OF THE CITY OF FORT WORTH, T-;%AS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. Deviation from Bid Price The final contract cost of this project is $8,288.71 over, the revised bid price. The increase resulted because the quantity of concrete paving shown in the proposal of the contract documents was underestimated by the consultant during preparation of plans and contract documents. Compliance with Specifications Tests made during construction show that material used and required thick- nesses are in compliance with contract specifications with the exception of one area and the contractor was penalized for this area as provided in the specifications.
