AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 1,320 ACRES OF LAND, MORE OR LESS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PRO- VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chambers in the Municipal Office Building of Fort Worth, Texas, on the lst day of June, 1976, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 20th day of May, 1976, which date was not more than twenty (20) nor less than ten (10) days prior to the date of the public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, was, on January 1, 1976, and is now in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 238.134 square miles on January 1, 1976; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory contains 1,320 acres of land, more or less; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to-wit: Being portions of the Heirs of W. W. Thompson Survey, Abstract No. 1498; the D. E. Norton Survey, Abstract No. 1167; and the N. A. Roberts Survey, Abstract No. 1275, situated about 8 miles Northeasterly from the Courthouse in Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth city limit line in the East right-of-way line of Old Denton Road (County Road No. 4048) at its intersection with the North right-of-way line of Watauga-Smithfield Road (County Road No. 4022) . THENCE along and with the present Fort Worth city limit line and along and with the East right-of-way line of Old Denton Road North No Degrees - 03 Minutes - 58 Seconds East 4,202.66 feet and North No Degrees - 1 Minute - 59 Seconds East 4,725.55 feet to a point in the North line of said Cambridge Realty Development Corporation tract and in the South line of a tract of land conveyed to Irvin Properties, Ltd. , by deed recorded in Volume 5618, Page 992, Tarrant County Deed Records. THENCE South 89 Degrees - 54 Minutes - 12 Seconds East to, and along, the common line of said Irvin Properties, Ltd. , and Cambridge Realty Development Corporation tracts, and continuing and in all 5,335.74 feet to a point for corner in the East right-of-way line of Alta Vista Road (County Road No. 4053). THENCE South No Degrees - 28 Minutes - 55 Seconds West along and with the East right-of-way line of Alta Vista Road 4,036.83 feet to the Southwest corner of a tract of land conveyed to G. L. Duncan and M. R. Ellis by deed recorded in Volume 4893, Page 597, Tarrant County Deed Records, said point being in a Northerly line of said Cambridge Realty Development Corporation tract. 2 THENCE South 89 Degrees - 35 Minutes - 34 Seconds East along the common line of said Duncan and Ellis and said Cambridge Realty Development Corporation tracts, 2,352-33 feet to the most Northerly Northeast corner of said Cambridge Company, Inc. tract. THENCE along the common line of said Duncan and Ellis and said Cambridge Company, Inc. tracts, the following courses and distances: South 89 Degrees - 46 Minutes - 34 Seconds East 692.2 feet, and South No Degrees - 23 Minutes - 10 Seconds West 2,278.69 feet, and North 89 Degrees - 53 Minutes - 29 Seconds West 401.05 feet, and South No Degrees - 36 Minutes - 27 Seconds West 1,334.94 feet to the Northeast corner of a tract of land conveyed to Weldon G. Carden, et ux, by deed recorded in Volume 4305, Page 493, Tarrant County Deed Records. THENCE North 89 Degrees - 36 Minutes - 9 Seconds West along the common line of said Carden, et ux, and said Cambridge Company, Inc. tracts 1,650-56 feet to the Northwest corner of said Carden, et ux, tract. THENCE South 1 Degree - 23 Minutes - 4 Seconds West continuing along the common line of said Carden, et ux, and said Cambridge Company, Inc. tracts 1,244.46 feet to a point in the present Fort Worth city limit line which is 50 feet North from and parallel to the North right-of-way line of Watauga-Smithfield Road (County Road No. 4022). THENCE along and with the present Fort Worth city limit line: North 89 Degrees - 36 Minutes - 9 Seconds West 1,012-55 feet to a point for corner in the West right- of-way line of Alta Vista Road, and South No Degrees - 47 Minutes - 46 Seconds West 50 feet to a point for corner in the North right-of-way line of Watauga-Smithfield Road, and North 89 Degrees - 43 Minutes - 22 Seconds West 5,213.41 feet to the PLACE OF BEGINNING and containing 1,320 acres of land, more or less. SECTION 2. That the above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. 3 SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or un- constitutional phrase, clause, sentence, paragraph or section. SECTION 5. That this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained.
