BEING AN ORDINANCE REGULATING AND RESTRICTING
THE LOCATION AND USE OF BUILDINGS, STRUCTURES
AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR
OTHER PURPOSES, BY ADDING TO SECTION 18 THERE-
OF PROVISIONS INCREASING THE PERMISSABLE HEIGHT
OF BUILDINGS IN DISTRICTS CLASSIFIED: "C", "D%

PROVIDING THAT THIS ORDINANCE SHALL BE CUMULA-
TIVE OF ALL OTHER ORDINANCES AFFECTING ZONING;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That SECTION 18--MODIFICATIONS TO DISTRICT REGULATIONS of the Comprehensive
Zoning Ordinance (Ordinance No. 3011) text regulations (codified as APPENDIX A
to Ordinance No. 5282, the Code of the City of Fort Worth) be and the same is
hereby amended by adding to such Section the following:
B. FLOOR AREA RATIO OPTION: Height and number of stories of buildings
shall be governed by the following provisions, in their entirety, in
lieu of the height regulations of the applicable district when permits
are approved under the Floor Area Ratio Option. The Floor Area Ratio
Option shall be available only in Districts listed in the table follow-
ing.
1 . Definitions
a. FLOOR AREA RATIO: For the purposes of this provision Floor
Area Ratio is defined as the quotient of the net floor area
divided by the gross lot area, the ratio being expressed
mathematically for convenience as
Net Floor Area = Floor Area Ratio
Gross Lot Area
b. NET FLOOR AREA: For the purposes of this provision Net Floor
Area is defined as the area in the various floors of the
building, measured between the exterior faces of the building,
including mezzanines and interior balconies, but excluding;
(1) All basements, sub-basements and cellars whose ceilings
are at or below grade (ground level of the finished
building);
(2) All interior spaces devoted exclusively to vehicular
parking and loading and all access ramps and maneuver-
ing areas accessory thereto;
(3) All arcades which have at least a 14 foot ceiling and
are open to public traverse during the normal business
hours of the building;
(4) All courts;
(5) All shafts as defined in the City of Fort Worth Build-
ing Code;
(6) All stair wells;
(7) Customary accessory uses such as elevator penthouses or
bulkheads; mechanical equipment rooms; cooling towers,
tanks; and ornamental cupolas and domes erected on the
top of a building.
c. GROSS LOT AREA: For the purposes of this provision Gross
Lot Area is defined as the total ground area of the site,
from property line to property line. The area included in
required yards and easements shall be included in the Gross
Lot Area.
d. SITE: For the purposes of this provision Site is defined
as the total land area to be occupied by the building,
including yards and open spaces. A Site shall be a homo-
geneous parcel under single ownership or unified control ,
except that two parcels separated by a public street or
alley may constitute a Site. If a building is erected
on a Site under Floor Area Ratio provisions the Gross Lot
Area shall not thereafter be reduced if such reduction
would cause the maximum allowable Floor Area Ratio to be
exceeded.
e. RESTRICTIVE COVENANT: For the purpose of notice to the
public that a Site comprises the Lot Area for a Floor Area
Ratio concept building, the owner shall execute an instru-
ment which shall be filed in the Plat or Deed Records of
Tarrant County, Texas by the City. The instrument shall
delineate the site and shall contain restrictive covenant
that the Gross Lot Area shall be preserved so that the
maximum allowable Floor Area Ratio shall not be exceeded.
2. The Maximum Allowable Floor Areas
The Maximum Allowable Floor Area Ratio shall be as follows:

3. Accessory Structure Heights
Elevator penthouses or bulkheads; mechanical equipment rooms;
cooling towers; tanks; and ornamental cupolas and domes; antenna
towers; signs and spires may be erected on buildings to any height
not prohibited by any other law, code or regulation.
4. Other Applicable Regulations
Nothing in these provisions shall be construed to waive any dis-
trict regulation except height and number of stories; and nothing
in this provision shall be construed to waive any other applicable
height limitation imposed by Airport Hazard Area Zoning, Federal
Aviation Administration Air Space Limitation, or any other appli-
cable code, regulation or law.
SECTION 2.
The zoning regulations and districts, as herein established, have been made in
accordance with the comprehensive plan for the purpose of promoting health,
safety, morals, and the general welfare of the community. They have been de-
signed to lessen congestion in the streets; to secure safety from fire, panic,
flood and other dangers; to provide adequate light and air; to prevent over-
crowding of land; to avoid undue concentration of population; to facilitate
the adequate provision of transportation, water, sewerage, parks and other pub-
lic requirements and with a view to conserving the value of buildings and en-
couraging the most appropriate use of land throughout the municipality.
SECTION 3.
Ibis ordinance shall be cumulative of all other ordinances of the City of Fort
Worth affecting zoning and shall not repeal any of the provisions of said ordi-
nance except in those instances where provisions of those ordinances are in di-
rect conflict with the provisions of this ordinance.
SECTION 4.
Should any section, clause or provision of this ordinance be declared by the
court to be invalid, the same shall not affect the validity of the ordinance
as a whole or any part thereof other than the part so declared to be invalid.
SECTION 5.
Any person, firm or corporation who violates, disobeys, omits, neglects or
refuses to comply with or who resists the enforcement of any of the provisions
of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00)
nor more than Two Hundred and Noj100 Dollars ($200.00) for each offense. Each
day that a violation is permitted to exist shall constitute a separate offense.
SECTION 6.
This ordinance will take effect and be in full force and effect from and after
its passage and publication as required by law.
