AN ORDINANCE AMENDING CERTAIN TRAFFIC REGULATIONS OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1964), AS AMENDED, BY AMEND- ING, DELETING, AND ADDING TO SECTION 26-63, REGULATING SPEED- ING ON PUBLIC ROADWAYS WITHIN SAID CITY; PROVIDING A PENALTY; REPEALING ORDINANCE PROVISIONS INCONSISTENT HEREWITH; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; DIRECTING PUBLICATION IN PAMPHLET FORM; DIRECTING PUBLICATION OF THE CAPTION AND PENALTY CLAUSE; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDI- NANCE BY COPYING THE CAPTION AND PENALTY CLAUSE IN THE MINUTES OF THE CITY COUNCIL AND BY FILING THE ORDINANCE IN THE CITY'S ORDINANCE RECORDS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 2, Section 1 of the Charter of the City of Fort Worth, as well as Sections 169(b) and 170(b) of Article 6701d, Revised Civil Statutes, the City of Fort Worth has authority to establish both minimum speed limits and prima facie maximum reasonable and prudent speeds within its corporate boundaries for vehicles on streets and highways; and, WHEREAS, upon the basis of engineering and traffic investigations, taking into consideration the width and condition of the pavement, the usual traffic, as well as other circumstances on public streets and highways, the City Council has determined (1) that slow speeds at cer- tain locations consistently impede the normal and reasonable movement of traffic, and (2) that certain speeds at certain locations are mini- mum speed limits thereat and thereon and (3) that certain speeds at certain locations are reasonable and safe prima facie maximum speeds; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That any person who violates any of the provisions of this ordi- nance shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than One Dollar ($1.00) nor more than Two Hundred Dollars ($200.00). SECTION 4. That this ordinance shall repeal every prior ordinance and provi- sion of the Code of the City of Fort Worth (1964), as amended, in con- flict herewith, but only in so far as the portion of such prior ordi- nance or provision shall be in conflict, and as to all other ordinances -4-. and provisions of the Code not in conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 5. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incor- poration in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. That the City Secretary of the City of Fort Worth is hereby directed to publish this ordinance in pamphlet form for general distribution among the public, and this ordinance as so published shall be admissible in evidence in all courts without further proof than the production of said pamphlet, as provided in Section 3, Chapter XXUI of the Charter of the City of Fort Worth. SECTION 7. That the City Secretary of the City of Fort Worth is hereby directed to publish the caption and penalty clause of this ordinance for five (5) days in the official newspaper of the City of Fort Worth, as authorized by Article 1176b-1 , Revised Civil Statutes. SECTION 8. That the City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and penalty clause of same in the minutes of the City Council of Fort Worth, and by filing the ordinance in the ordinance records of said city. -5- SECTION 9. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and publication as provided by law.
