HomeMy WebLinkAboutOrdinance 6263 ORDINANCE NO. __C& Z 4 AN ORDINANCE CLOSING AND VACATING THE EAST WEST UTILITY EASEMENT BETWEEN LOTS 1, 2, 3, 16, 17 AND 18, BLOCK 2, J. T. COUCH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the east west utility easement between Lots 1, 2, 3, 16, 17 and 18, Block 2, J. T. Couch Addition to the City of Fort Worth, Tarrant County, Texas, a width of 10 feet and length of 279 feet from Flamingo Street to Nell Street, be and the same is hereby extinguished, vacated, closed and perma- nently abandoned as an easement for public utilities. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easement above described is hereby re- leased and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or .parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. T. Couch and Olive Duke, owners of all adjoining property, have requested that the City vacate the east-west utility easement between Lots 1, 2, 17 and 18, on the north and Lots 3 and 16 on the south in Block 2, J. T. Cauch Addition. This easement has a width of 10 feet anA. 1ength of 279 feet running from Flamingo Street to Nell Street as shown on the attached map. Subject easement is unused and if abandoned will permit owners to use the adjoining property more advantageously. City departments and private utility comp-anies have reviewed this request and have determined that subject easement will not be needed in the future. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the utility easement as requested. Recommendation It is recommended that an ordinance be adopted vacating subject easement as recommended by the City Plan Commission.
