ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF TEXAS STREET
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH TEXAS; DECLARING THE CONTRACT WITH
GI M CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF SAID
IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL
ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN
AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING
THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING
THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF
FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO-
PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with G91M CONSTRUCTION COMPANY for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and
public places in said City, to-wit:
1. Texas Street, North Side: From the East line of Henderson Street to 100t East
of the East line of Taylor Street, known and designated
as Unit 1, See. la, Project No. 104-35000-301,
sidewalks and driveway approaches.
2. Texas Street, South Side: From the West line of Monroe Street to 501 East of
the East line of Taylor Street, known and,designated
as Unit 1, Sec. lb, Project No. 104-35000 3012
sidewalks and driveway approaches.
3. Texas Street, South Side: From the West line of Lamar Street to the East line of
Cherry Street, known and designated as Unit 1, See. le,
Project No. 104-35000-301, sidewalks and driveway approaches.
4. Texas Street, South Side: From the West line of Macon Street to 1001 West,
known and designated as Unit 1, Sec. ld, Project No.
104-35000-301, sidewalks and driveway approaches.
5. Texas Street, South Side: From the West line of Florence Street to the East
line of Henderson Street, known and designated as
Unit 1, Sec. le, Project No. 104-35000-301, sidewalks
and driveway approaches.
6. Tenth Street, North Side: From the East line of Florence Street to the West
line of Cherry Street, known and designated as Unit 1,
Sec. 2a, Project No. 104-35000-301, sidewalks and
driveway approaches.
7. Tenth Street, North Side: From the East line of Lamar Street to the West line
of Taylor Street, known and designated as Unit 1,
Sec. 2b, Project No. 104-35000-301, sidewalks and

8. Tenth Street, South Side: From the West line of Taylor Street to the Fast line
of Lamar Street, known and designated as Unit 1, Sec. 2c,

Seventh Street, known and designated as Unit 1, See. 3b,

12. Taylor Street, East Side: From 106�1 North of Texas Street to the North line of
Texas Street, known and designated as Unit 1, Sec. 3c,

13. Taylor Street, East Side: From the South line of 13th Street to the North line
of Lancaster Avenue, known and designated as Unit 1,
Sec. 3d, Project No. 104-35000-301, sidewalks and
driveway approaches.

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
city of Fort Worth, Texas, including Ordinance No. 5778 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 5778 s and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IT ORDAINED BY THE� CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on'the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

III.
When each of the certi£iactes has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying_ the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage. /

Deviation from Bid price: $2,745.89 over-run for the following reasons :
1) More hot-mix asphaltic concrete was required than anticipated
order to make proper tie-ins from existing parking lots to
new sidewalks. + $2,450.00
2) During construction, it was necessary to remove dead tree
in the parkway which had not been anticipated. + 200.00
3) In sawing out for tree wells, it was necessary to lower
and replace three water service lines + 95.89
Total over-run $2,745.89
compliance with Specifications
Tests made during construction show that materials used were in compliance
with specifications.

Recommendations
It is recommended:
1) That a bond fund transfer of $4,000 be approved from Account No.
104-35000-901 to Project No. 104-35000-301, Downtown Sidewalk
Improvement Program, to provide additional funds needed for the
project; and
2) That the above project be accepted by adoption of an ordinance
and that final payment of $4,680.89 be authorized to Grimes
Construction Company.
