AN ORDINANCE AMENDING SECTION III OF ORDINANCE NO. 1741
PROVIDING THAT MILK PRODUCERS AND MIIB DISTRIBUTORS SHALL
BE REQUIRED TO OBTAIN PERMITS BEFORE ENGAGING IN THE PRO-
DUCTION AND DISTRIBUTION OF MILK AND MILK PRODUCTS, AND
PRESCRIBING ADDITIONAL REGULATIONS RELATING TO THE ISSU-
ANCE AND REVOCATION OF SUCH PEFNIITS BY THE DIRECTOR OF
PUBLIC HEALTH AND WELFARE OF THE CITY OF FORT WORTHI AND
PROVIDING A PENALTY FOR THE V IOLAT ION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TMCAS:
SECTION I.
That Section III of Ordinance No. 1741 of the City of Fort Worth
be and the same is hereby amended and, after being so amended to prescribe
additional regulations relating to the issuance and revocation of permits to
milk distributors and milk producers by the Director of Public Health and
Welfare of the City of Fort Worth, it shall read as follows:
Permits. -- It shall be unlawful for any person, firm, assooia-
tion, or corporation to bring into or receive into the City of Fort
Worth, for sale, or to sell or offer for sale, therein, or to have
on hand any milk or milk product, excepting evaporated milk, condensed
milk, condensed skimmed milk, powdered whole milk and powdered skimmed
milk, who does not possess an unrevoked permit from the Director of
Public Health and Welfare of the City of Fort Worth, and on whose ve-
hicles and in whose place of business there does not appear in a con-
spicuous place a placard showing the permit number in figures at least
three inches high and one and one-half inches wide.
Such a permit may be revoked by the Health Officer upon the viola-
tion by the holder of any of the terms of this or any other Health
Ordinance of the City of Fort Worth, provided that the holder of said
permit shall, after complying with such revocation, have the right of
" appeal to the City Council.
Before any permit provided for under this ordinance shall be is-
sued to any milk producer or distributor, a certificate of compliance
with the code under which the milk producers and distributors are operat-
ing in Fort Worth, Texas, shall be presented to the Director of Public
Health and Welfare, and said Director, before issuing a permit to the
applicant shall satisfy himself that the person, firm or corporation
seeking such permit has complied with all of the requirements of such
code, whether the same be operated under the supervision and direction
of the Department of Agriculture or the Federal Government.
In the event a person, firm or corporation, operating under a
permit issued by the Director of Public Health and Welfare prior to
the promulgation of a code by either of the agencies named in the pre-
ceding paragraph, shall violate any of the terms, conditions and re-
quirement&\prescribed in such code, the Director of Public Health and
Welfare she4l, upon certificate of non-compliance on the part of the
person, firm or corporation holding such permit from the agency super-
vising the production and distribution of milk, cancel and revoke said
permit until a certificate of compliance is issued showing compliance
with such code.
All permits issued hereunder shall be posted in a conspicuous
place on the premises of the holder of such permit.
SECTION II.
Any person, firm or corporation, or the agents, servants or officers
of any firm or corporation, found guilty of violating any of the provisions
of this ordinance shall be fined in any sum not to exceed Fifty Dollars ($50.00).
SECTION III.
This ordinance shall take effect and be in full force and effect from
and after the date of its passage, and publication as required by law.
