BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FORT WORTH: SECTION, 1, That D. HART, his heirs, successors and assigns are hereby granted the right, power and privelege to build, construct, maintain and' operate a certain switch or spur iailroad track over, along and across 20th Street and Central Avenue in the City of Fort Worth, as fol�.ows; Along the route indicated on the attached plat showing the rex;':tive positions of D.HIRIIS properties and�stid^ Railroad and adjacent streets, which plat is referred to and made a part h6reof: that, as shown by said plat, the proposed switch shall branch off from the line of the S.L.& S.F.RY at a point just East of the South corner of Lot 1, of the H.d .Wilscn sub-division, and then run thence in a curving line a little West of North passing out of the Frisco right of way and on to other property owned by D.BART, at a point 37.6 feet about Northwest of the Southeast corner of Central Avenue, and thence still curving toward the west across a strip of property owned by tr. MMT -r'n a northwest course across a very short street east of Block 551 and connecting Central Avenue with 20th street, entering about the middle of the east line of Block 55J, thence curving more westerly and entering 20th street at a point about fifty or .sixty feet west of the northeast corner of said Block 5b' and thence diagonally across 20th street to and along side of D.HAR` I S warehouse. f �� Section 2,- It is .provided that said connecting track as constructed across the said 20th street and Central Avenue as provided herein, shall be upon suob(grade as shall be approved by the City Engineer of the City of Fort Worth, and the top of each rail of each and every part of the laid track, and the spacing between the rails, shall be)kel5t level with the street along side; and the tracks, and all other equipment used in such extention or connection, shall be of standard quality and so constructed and maintained, that travel on said streets shall not be unnecessarily obstructed or endangered at any place and all matters of construction and maintainance shall be subject to the approval of the City Engineer and Board of Commissioners of the City of Fort Worth; and all tracks of said streets or portions thereof, that are now, or shall hereafter be paved, shall be of first class tails of such kind as shall be designated by the City Engineer, and shall be laid in such manner as to make the least possible obstruction to vehicle&, and shall be maintained in that condition. Section 3.- D.HART, his heirs, successors and assigns shall at his or their own costs and expense, pave and repave or otherwise sltaface and resurface, and keep constantly in good order and condition, with the same material with which the streets on the outside is paved and surfaced, all that part of said streets occupied by it, and that which lies between the rails of said tracks occupiel-'by it, and for eighteen inches on each side thereof, as ,as may be laid under this Ordinance, and the said D.HART, his heirs successors and assigns, stall conform his or their tracks, or any part thereof, to the proper grade of said streets and change the level of said tracks as often and when ever the grade of said streets is changed, so that every part of ea0h track shall always be kept at the duly established grade line, or as near thereto as the surface of the grade of the street outside thereof will permit. Section 4.- Said D.HART, his successors, heirs and assigns, do hereby agree to indemnify and hold the City of Fort Worth forever harmless because of, and promptly to pay off and dlcharge, or pmpay to the said City of Fort Wort?% all damages, claims, judgements, attorneys fees and other costs and expenses rendered against, or incurred or paid out by the said City of Fort Worth by reason of injuries either to persons or property, occasioned as the proximate result of anything done or permitted, or in any way proximately arising out of the con- struction, operation or maintainance of said tracks upon the above named streets. Section 5.- This Ordinance shall take effect and be in force, from and after its passage. I hereby certify that the above and forepving Urdina.nce was dulyy resented, passed and adopted by the Board of Commissioners of th ity of Fort Worth Texas at a regular meeting of said Board held May 29th, A.
