HomeMy WebLinkAboutOrdinance 6562 Y ORDINANCE NO.�'r AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF EDERVILLE ROAD EXTENSION AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOIi; OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be Im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: EDERVILLE ROAD EXTENSION, UNIT III From 400' west of Jill Lane to Brentwood Stair Road, known and designated as Project No. 104-23000-117, Unit III, a six-inch thick reinforced concrete pavement on a seven-inch thick cement stabilized sub- grade with seven-inch high superimposed concrete curb so that the finished road- way will be forty-eight feet wide and by constructing six-inch thick concrete driveways where specified. r w F1. together with concrete curbs, gutters, driveways and incidentals to such improvements on proper grade and line, where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said im- provements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; contract therefore has been made and entered into with AUSTIN ROAD COMPANY ; and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot proposed to be: assessed against abutting property and the owners thereof, and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of streets, avenues, and public places hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting pro- perty and the owners thereof, are as follows, to-wit: EDERVILLE ROAD EXTENSION, UNIT III From 400' west of Jill Lane to Brentwood Stair Road, known and designated as Project No. 104-23000-117, Unit III. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the PAW day of Am@Mft lVovelrt v- , 1971 , at 9:30 A._Me in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give or-cause to be given notice ,of the time and place of such hearing and of other 'matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes as amended by Acts 1967, 60th Legislature, Page 365,_ Chapter 176, Section 1, emergency effective May 12, 1967. Such notice, shall be by advertisement inserted at least three (3) times in a newspaper published in the pity of Fort Worth, Texas, the first publication to be made at least twenty-one (21) days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act as amended. The City Secretary is further directed to give or cause to be given .personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of 'highways, streets, avenues .and public places, as well as to all owning or claiming Any interest in any such property. Such personal notice shall be in writing and shall be given or caused to be given by the City Secretary by depositing such written notice in the United States Mail at least fourteen (14) days before the date of the hearing, postage prepaid, in envelopes addressed to all persons owning or claiming any interest in the respective properties abutting the high- ways, streets, avenues and public places or portions thereof to be improved, as the names of such persons are shown on the current rendered tax rolls of the City of Fort Worth and at the addresses so shown, or if the name of such respective owners do not appear on such rendered tax rolls, then address to such owners as their names are shown on the current unrendered tax rolls of the City of Fort Worth at the addresses shown thereon. In those cases in which an owner of property abutting a highway, street, avenue or public place or portion or portions there- of which is to be improved is listed as "unknown" on the' then current City of Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth tax rolls but no address for such owner is shown, no notice need be mailed. In those cases where the owner is shown to be an estate, the mailed notice may be addressed to such estate. In this connection, the City Secretary shall prepare and file or cause to be prepared :and filed with these proceedings a list of the_ properties to be assessed,, the names of those..persons owning or claiming any interest in 'said.prbperties to whom the notice was mailed, together with the last known addresses 'determined as aforesaid of the respective owners and those per. sons owning or claiming any interest in said property, The City Secretary shall certify that each of the parties in said list whose address is shown on the then current rendered or unrendered tax rolls of the City of Fort Worth was mailed a copy ,of the notice of hearing and shall further certify the date or dates on which said notice' was mailed. A copy of each notice shall be attached to such' certificate. The certificate of the City Secretary will be con- clusive evidence of the facts therein recited. Project Description Roadway R.O.W. Unit Description Limits Width Feet III Ederville Road From 400' west of Jill Lane to 48 65 to 80 Brentwood Stair Road This project is a part,of the Capital Improvement Program (CIP A-19) and will serve as a connection between Oakland Boulevard, Wilson Road, Weiler Boulevard and IH-820. Bids were received on June 17, 1971, for the construction of 6 inches thick reinforced concrete pavement and 6 inches thick cement stabilized subgrade, complete with monolithic curb. In addition, the project included the con- struction of a retention pond and related storm sewer facilities and appurte- nances. The low bidder was Austin Road Company in the amount of $296,000.03. Working days allotted: 220. On July 12, 1971, M&C C-2033, the staff was requested to take bids on hot-mix asphaltic concrete. Bids were received on August 19, 1971, consisting of two alternate types of construction using hot-mix asphaltic concrete pavement designs. Since this project is in an area of changeable soil which has shown extreme problems cracking in nearby streets, additional soil samples were obtained to determine the underlying soil conditions. These tests were made in addition to the normal procedure of obtaining a soil sample at or very near the pro- posed street elevation. These tests indicate that soils in this area consist of layers of very high plastic material, which are very close to the surface in some cases. Along the profiles of the streets, the types of soils change rapidly due to the many layers of various soils. Most of the soil layers are of a clay variety, but some sand layers exist which would tend to feed moisture to the clay stratas and thereby increase shrinking and swelling. Alternate No. 2 Using the Texas Highway Department method of design and taking into considera- tion the characteristics of the soils encountered in the tests, it was deter- mined that a paving design should consist of 6 inch hot-mix asphalt concrete, 6 inch cement stabilized crushed stone, and 6 inch stabilized subgrade. This paving section, along with concrete curb and gutter, the retention pond, storm drainage facilities and appurtenances, are known as "Alternate No. 2". Alternate No. 1 Due to existing financial restrictions in bond financed projects, an alternate a DATE REFERENCE SUBJECT: Award of Contract — PAGE NUMBER Ederville Road Extension 9/20/71 C-2079 2 of 3 was designed using a stage construction method by which a lower first cost is obtained with the probability of some future cost, Alternate No. 1 is similar to the City's reconstruction specifications and consists of 2 inches of hot-mix asphaltic concrete, 8 inches cement stabilized crushed stone, and 6 inches of stabilized subgrade, with the concrete curb and gutter, retention pond, storm drain facilities and appurtenances. The stage construction concept is based on the expectation that a few years after construction, an additional 2 inches of hot-mix asphaltic surface would have to be added. The end result, consist- ing of 4 inches of hot-mix asphaltic concrete, 8 inches of stabilized crushed stone on 6 inches of stabilized subgrade, would be nearly equal to that speci- fied in Alternate 2. It is felt that some "heaving" and, settling of the street will occur in the first 3 to 5 years, and after that time, an additional 2 inches of hot-mix surface could be supplied which would re-level the roadway. Pavement Evaluation In considering the overall performance, serviceability, maintenance and financial considerations, the order of selection would be: 1) Reinforced concrete pavement 2) Alternate 2 3) Alternate 1 Submission of Bids The following bids have been received: Bidder Alternate 1 Alternate 2 Glade, Inc. $20Z,449.11 $237,968.61 L. No Bid No Bid Bid Evaluation If Alternate 1 is selected, the additional 2 inch hot-mix asphaltic top that would need to be placed in 3 to 5 years, would consist of 30,050 square yards at approximately $1.00 per square yard, which would equal $30,050. In addi- tion, it is felt that, due to the thin hot-mix asphaltic surface, some sur- face and base failures may occur. If approximately 5 per cent failures occur on the area, the cost of these repairs when added to the cost of the additional 2 inches of hot-mix asphaltic concrete would equal the bid of Alternate 2. There is a risk of much greater surface cracking and base failure with the 2 inch surface. Further assessments could not be levied against adjacent property owners at a future date when the additional hot-mix surface was added. It is recommended that Alternate No. 2 be selected and awarded to the low bidder, Glade, Incorporated, in the amount of $237,968.61, r DATE REFERENCE SUBJECT: Award of Contract - PAGE NUMBER Ederville Road Extension 9/20/71 3 °� 3 C-2079 Project Cost,and Financing Based on the low bid for Alternate 2, approximately $43,738.55 will be assessed against the abutting property owners. The cost to the City-at-large will be approximately $218,026.92. Based on the low bid for Alternate 1, approximately $39,369.32 will be assessed against the abutting property owners. The cost to the City-at-large will be $183,324,70. Sufficient funds for City's cost of construction, inspection engineering, and miscellaneous expenses are available in Project Account No. 104-23000-117, Ederville Road. Recommendations It is recommended that: 1) The following Bond Fund Transfer be approved: Amount From To Reason $43,738.55 Revolving Fund, 042-07924-901 Ederville Road To provide funds Extension for property Unit III, owners' share of 042-10423-117 construction costs 2) An ordinance be adopted: a) Declaring the necessity for and ordering the improvements; b) Making provisions for levying assessments; c) Directing the Public Works Department to prepare estimates of costs and amounts to be assessed; d) Awarding the contract to Glade, Inc. , in the amount of $237,968.61, based on the low bid for paving Alternate 2; e) Making appropriations to cover the indebtedness thereby incurred for improvements of the project named above. 3) An ordinance be adopted: a) Approving the estimates of costs and amounts proposed to be assessed; and b) Setting October 11, 1971, as the date for the Benefit Hearing.
