AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING CF 0.04 SQUARE MIIES CF LAND, CICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS: AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an oppor6unity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 27th day of March, 1967, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, mtice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 14th day of March, 1967, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and, WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 391,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 197,590 square miles on January 1, 1967; and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and ''WEREAS, the territory hereinafter described contains approximately 0.04 square miles; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. , The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: Being a portion of the J.J. Bonham Survey Abstract No. 99, a portion of the Joseph Boman Survey Abstract No. 81, and a portion of the D.W. Campbell Survey Abstract No. 358, located about 5 miles northwest Prom the courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a common corner of the City of Fort Worth and City cf Sansom Park City Limit Lines at the intersection of the rights-of-way of Titus Street and Azle Avenue, the comer of Block 210, Rosen Heights Additions; Therr;e northwesterly along the Sansom Park City Limit Line, to and along the southwesterly right-of-way line of Nine Mile Bridge Road (FM 1220) in all 6450 feet, more or less, to its irtersection with a City of Fort Worth City Limit Line produced south; Therm north, crossing Nine Mile Bridge Road (FM 2220) to a corner of the Fort Worth City Limit Line in the northeasterly right-of-way line of Nine Mile Bridge Road (FM 1220); thence southeasterly along the present City of Fort Worth City Limit Line, in the Nine Mile Bridge Road (FM 1220) and along said line produced southeasterly, in all 6200 feet, more or less, to its intersection with the east right-of-way line of Azle Avenue in the southwesterly line of Block 226, Rosen Heights Addition, thence southeasterly along the present City of Fort Worth City Limit Line to the northwesterly corner of Block 211, Rosen Heights Addition; thence southwesterly across Azle Avenue, to the place of beginning, and containing approximately 0.04 square miles, all in ptiblic right-of-way. SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the propdrty so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3• That this ordinance shall and does hereby amend every prier ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5• This ordirmnee shall be in full f orce and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided f or in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. BROWNLEE Mayor and Council Communication MCMAHAN MORPNIS DATE REFERENCE SUBJECT: Annexation of Azle Avenue PAGE GRAHAM NUMBER from Titus to Broadview 3 13 67 PZ-'?31 i or '„H �tY A section of Azle Avenue (Nine Mile Bridge Road) 180 feet in width and RCE approximately 6450 feet in length, extending from Titus Avenue northwest- erly approximately to Broadview, lies outside any corporate area. The area is shown on the attached print. Sansom Park's corporate boundary extends to the southerly right-of-way line and Fort Worth's corporate boundary extends to the northierly right- of-way line of Azle Avenue. Because Fort Worth's corporate area includes frontage on this street, it would be advantageous to have it within Fort Worth's jurisdiction, in order that adequate street improvements, traffic regulation, and police enforcement can be -attained in the future. The City Plan Commission on February 21, 1967 reviewed this matter and recommends to the City Council that an ordinance be adopted annexing the section of Azle Avenue shown on the attached print. In order to imple- ment the City Plan Commission's recommendation for annexation, it is necessary: 1) That the City Council pass a resolution setting a public hearing on March 27, 1967, to consider the proposed annexation and that notice of this hearing be published one time on either the 14th, 15th, or 16th day of March 1967, in a newspaper having general circulation in the City of Fort Worth and in the territory proposed to be annexed; 2) That all interested persons be permitted to be heard at the public hear- ing on March 27, 1967, and that the hearing be closed; 3) That at its regular meeting on April 10, 1967, the City Council institute annexation proceedings by the adoption of the annexation ordinance on first reading and that the City Secretary be instructed to publish the first reading ordinance one time on either the llth, 12th, or 13th day of April, 1967, in a daily newspaper published in the City of Fort Worth; and, 4) That the City Council adopt the annexation ordinance on second and final reading at its regular meeting on May 15, 1967.
