WHEREAS, the City of Fort G%rth (City) and Dannenbaum Engineering
Corporation, (Engineer) made and entered into City Secretary Contract
No. 35551, (the Contract) which was authorized by the City Council by
M&C C-22178 on the 12th day of June 2007, and
WHEREAS, the Contract involves engineering services for the
following project:
Storm Water Utility Project - Linda Lane Drainage Improvements, Dotti®
Lynn Parkway Culvert Improvements, and Oakridge Terrace Drainage

NOW THEREr"ORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I, of the Contract is amended to include the additional
engineering services specified in a proposal letter dated July 16, 2009,
copies of which are both attached hereto and incorporated herein. The
cost to City for the additional services to be performed by Engineer
total $63,565.00.
2.
Article TI, of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer £or all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $193,612.00.

Oakridge Terrace & Linda Lane Drainage Improvements
Supplemental Agreement No. 3
Mr. Owen:
Per your request, we have prepared a supplemental agreement to include the designs for
additional water and sanitary sewer mains within the project limits. Those additions include:
• Berke Road (from East Broadus St. to Fair Park Blvd.) -Replace existing G-inch water
main with new &inch PVC water main; replace existing 6-inch sanitary sewer lateral (L-
6225) between Sta 5+51 to Sta 13+71 E with new &111ch PVC sewer pipe.
• Sahara Place (from Fair Park Blvd. to terminus at cul-de-sac) —Replace existing 6-inch
water main with new 8-inch PVC water main; replace existing 6-inch sanitary sewer
lateral (L-6226) between Sta 0+00 to Sta 9+93E with new 8-inch PVC sewer pipe;
replace existing 64nch sanitary sewer lateral (L-6227) between Sta 0+00 to Sta 2+73 and
between Sta 5+85 to Sta 7+08E with new &inch PVC sewer pipe.
• Glen Eden Drive (From Clear View Dr. to South Riverside Dr.) — Replace existing 6-inch
water main with new 8-inch PVC water main; replace existing -Inc6h sanitary sewer
lateral (1,4081) between Sta 0+00 to Sta 8+50E with new &inch PVC sewer pipe.
In addition, we have included topographic surveys from Spooner and Associates (see attached) to
detail the expanded project limits. We have also included costs associated with preparation of
Permanent Drainage Easements at Lots 18 & 19/13lock 2 Rolling Hills Addition. Reprographics
will be performed by Trevino Engineering Support Services. All of the above referenced sub-
contractors are certified MWBE. This will result in a 22.7% portion of the overall project
agreement that will be performed by approved M/WBE firms, which exceeds the target goal of
17%s
tf you are in agreement with this Supplemental Agreement Number 3, our authorized
compensation will increase by $63,565.00. The $130,047.00 contract amount authorized by
Supplemental Agreement Number 2 will be increased to $193,612.00. Please do not hesitate to

I. Compensation:
A. 'the Engineer shall be compensated a total lump sum fee of $G3,S6S.00 as
summarized in Exhibit "13-3B". Payment of the total lump sum fee shall
be considered full compensation for the services described in Exhibit "A"
for all labor materials, supplies and equipment necessary to complete the
project.
B. The Engineer shall be paid monthly as described in Exhibit "B-1",
Section 1 — Method of Payment.
Each Invoice is to be verified as to its accuracy and compliance with the
terms of this contract by an officer of the Engineer.
II. Schedule:
A. Phases 1 and 2 shall be completed 30 days after the "Notice to Proceed"
letter is issued.

Partial payment shall be ►Wade to the Engineer monthly upon City's approval of an
invoice from the Engineer outlining the estimated current percent complete of the total
project.
The aggregate of such monthly partial fee payments shall not exceed the following:
Until satisfactory completion of Exhibit "A", Conceptual Engineering plan submittal and
approval by the City, a sum not to exceed 30 percent of the total lump sum fee.
Until satisfactory completion of Exhibit "A", Preliminary Construction Plan submittal to
City, a sum not to exceed 60 percent of the total lump sum fee, less previous payments.
Until satisfactory completion of exhibit "A", final Construction plan submittal to the
City, a sum not to exceed 90 percent of the total lump sum fee, less previous payments.

completion of Exhibit "A", pre -Construction Conference.
J1. Progress Reports
A. The Engineer shall submit to the designated representative of Director of
Depal•lment of Lngineerin ;monthly progress reports covering all phases of

B. if the Engineer determines in the course of making design drawings and
speei0catials that the construction cost estimate of $A 11,100.00 (as estimated on
Exhibit 114) will be exceeded, whether by change in the scope of the project,
increased costs or other conditions, the Engineer shall immediately report such
fact to the City's Director of the Department of Engineering and, if so instructed
by Director of the Engineering Department, shall suspend all work hereunder.

Spooner and Associates is pleased to present this proposal for topographic surveying services extending the existing survey at Sahara
place as illustrated on the attached PDF exhibits. Survey limits are ROW to ROW including a 20' strip outside each right-of-way line unless
otherwise noted within the provided project scope. 75' of topographic mapping up each side street from the curb return is included for the footage for
each site. The location of all buildings faces that adjoin the project will be shown. All surface features pertinent to design will be included on the
survey. All trees V or larger will be located and Identified by species, All easement, right•of way and property lines will be shown on the survey. The
horizontal and vertical control for this project will be established on the Slate Plane Coordinate System (NAD'83 Surface Coordinates) frorn City
monumentation, Control points will he set using iron rods and will be established using GPS and conventional surveying methods. All vertical bench
marks will be referenced and set at 500' Intervals throughout the project, DIGTESS will be utilized to identify and locate all existing franchise utilities
within the survey. Deliverables will include AutoCAD files with an ASCII file for all data collected on the project. One foot contours with a TIN surface
model will be included. All plats, deeds and current ownership will be included within the deliverables,
EASEMENT PREPARATION
Workup of two drainage easements in Lois 18 & t 9, Block 2, Roiling Hills as shown on the said attached map exhibit. These services include the
workup of a plat exhibit with metes and bounds description for two parcels. The easements wilt be created strictly following the City of Fort Worth
standards for easement documents.

Authorize Amendment No. 3 in the Amount of $63,565.00 to City Secretary Contract No. 35551, an
Engineering Agreement with Dannenbaum Engineering Corporation, for the Linda Lane Drainage
Improvements and Oakridge Terrace Drainage Improvements and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council.
1. Authorize the transfer of $94,799.00 from the Water and Sewer Operating Fund to the Water Capital
Projects Fund in the amount of $44,246.00 and the Sewer Capital Projects Fund in the amount of
$50,553.00;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $44,246.00 and the Sewer Capital Projects Fund in the
amount of $50,553.00, from available funds; and
3. Authorize the -City Manager to execute Amendment No. 3 with Dannenbaum Engineering Corporation
in the amount of $63,565.00 for design and preparation of engineering plans and contract documents for
the bidding and construction of additional water and sewer lines located on Berke Road, Sahara Place
and Glen Eden Drive with the Linda Lane Drainage Improvements and Oakridge Terrace Drainage
Improvements (Project No. 00474).
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve
streams, minimize water pollution and to operate the storm water system in a more effective manner to
fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure
reconstruction and system maintenance, master planning, enhanced development review and increased
public education and outreach.
On October 16, 2007, the City Council approved the issuance and sale of bonds which will be used to
fund capital improvements in the storm water utility system scheduled over the next two years.
On June 12, 2007, the City Council authorized the City Manager to execute an engineering agreement
with Dannenbaum Engineering Corporation for design of the Linda Lane, Dottie Lynn Parkway and
Oakridge Terrace Drainage Improvements.
On June 12, 2008, the City Manager executed administratively Amendment No. 1 in the amount of
$19,601.00 for additional design on Linda Lane and Dottie Lynn Parkway portions of the project.

On February 17, 2009, the City Council authorized the City Manager to execute Amendment No. 2 in the
amount of $13,308.00 for the following: the design and preparation of engineering plans and contract
documents for the bidding and construction of required sewer line relocation (due to conflict between
existing sewer laterals and proposed storm drain) on South Riverside Drive identified during concept
design; add performance of Level B Subsurface Utility Engineering; and credit the contract for final design
services that will not be performed (a benefit/cost analysis was performed and the Dottie Lynn portion of
the contract will be deferred to a future date).
Amendment No. 3 for the subject engineering agreement will provide the following: the design and
preparation of engineering plans and contract documents for the bidding and construction of additional
water and sewer lines located in the following locations: Berke Road from East Broadus Street to Fair
Park Boulevard, Sahara Place from Fair Park Boulevard to the east end, and Glen Eden Drive from Clear
View Drive to South Riverside Drive. Also, preparation of documentation for an additional drainage
easement is included.
DannenbQuill Engineering Corporation proposes to perform the design services for a lump sum fee of
$631565.00. City staff considers the fee to be fair and reasonable for the scope of services proposed.
In addition to the contract amount, an additional $32,444.00 ($16,222.00 water and $16,222.00 sewer) is
required for project management by the Transportation/Public Works Department.
Dannenbaum Engineering Corporation is in compliance with the City's M/WBE Ordinance by committing to
13 percent M/WBE participation on this Amendment No. 3. The City's goal Amendment No. 3 is 10
percent.
This project is located in COUNCIL DISTRICT 8, Mapsco 91 D&L.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the current capital
budgets, as appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the
Storm Water Capital Projects 2007 Revenue Bond Fund.
