WHEREAS,the Public Works Director for the City of Fort Worth,Texas,has prepared Plans and Speci- fications for the improvements of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, and same having been examined by the City Council of the City of Fort Worth, Texas, and found to be in all matters and things proper, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The hereinafter described Plans and Specifications are hereby approved and adopted. H. The above,together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurten- ances; all of said improvements to be constructed as and where shown on the Plans and Specifications therefor. IV. The cost of said improvements as herein defined shall be paid for as follows, to-wit: A. The property abutting on that portion of the street, avenue or public place and the real and.true owners thereof shall pay all of the cost of curbs and gutters in front of their property and not exceeding nine- tenths (9/10ths) of the estimated cost of the remainder of such improvements. B. The City of Fort Worth shall pay all of the remainder of the cost of said improvements after deduct- ing the amounts herein specified to be paid by the abutting properties and the real and true owners thereof as set out in subsection A. The amounts payable by the abutting properties and the real and true owners thereof shall be assessed against such properties and the real and true owners thereof and shall constitute a first and prior lien upon such properties and a personal liability of the real and true owners thereof, and shall be payable, to-wit: When the improvements are completed and accepted by the City on a particular unit,the sums assessed against property abutting upon such completed and accepted unit shall be and become payable in five (5) equal installments, due respectively on or before thirty (30) days, and one (1), two (2), three (3), and four (4) years from the date of such completion and acceptance,and the assessments against the property abutting upon .the remaining units shall be and become due and payable in such installments after the date of completion and acceptance of such respective unit.The entire amount assessed against the particular parcels of property shall bear interest from the date of such completion and acceptance of the improvements on the unit upon which the particular property abuts at the rate of six (6°fo) per cent per annum,payable annually except as to interest on the first installment,which shall be due and payable on the date said installment matures, provided that any _owner shall have the right to pay any and all of such installment at any time before maturity by paying princi- pal with interest accrued to the date of payment,and further provided if default be made in'the payment of any installment promptly as the same matures, then at the option of the City of Fort Worth or its assigns,the entire amount of the assessment upon which such default is made shall be and become immediately due and payable; but it is specifically provided that no assessment shall in any case be made against any property or any owner thereof in excess of the special benefits to property in the enhanced value thereof by means of said improvements in the unit upon which the particular property abuts, as ascertained at the hearing provided by the law in force in the City, nor shall any assessment be made in any case until after notice of hearing as pro- vided by law. Said assessments against the respective lots and parcels of property and owners thereof shall be evidenced by certificates of a special assessment which shall be executed in the name of the City of Fort Worth, PROVIDED, however, that acting through its duly authorized Director of Public Works, the City of Fort Worth retaining the right to authorize payment of the sums assessed against abutting property upon such com- pleted and accepted unit in not more than,forty-eight equal regular monthly installments of not less than$9.00 each, the first of such installments to become due and payable not more than 30 days after the completion and acceptance by.the City of the particular unit, PROVIDED FURTHER, that the City Attorney is hereby em- powered to authorize payments of said sums in lesser installments and/or over a longer period of time in cases in which the Director of Public Works has previously determined that an extreme financial hardship upon the property owner will otherwise result; and PROVIDED FURTHER, that such method of payment shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of Fort Worth a lawful,valid and binding note and mechanic's and materialman's contract upon forms supplied by the City granting a mechanic's lien upon and conveying the said abutting property in trust to secure the payment by said owner or owners according to the terms there- of of the sums assessed against such property. The assessments against the respective lots and parcels of property and the owners thereof shall be evidenced by certificates of special assessment, which shall be executed in the name of the City by the Mayor of said City and the City Secretary sliall attest the same and impress the corporate seal of the City thereon, and which may have attached thereto coupons in evidence of the several installments, or in evidence of any of the installments in which the assessment is payable, which certificates shall be issued to the City of Fort Worth, shall recite the terms and time of payment, the amount of the assessment, the description of the property, and the name of the owners, as far as known, and shall contain such other recitals as may be pertin- ent thereto,and shall further recite substantially that all proceedings with reference to the making of such improvements have been regularly had in compliance with law, and that all prerequisites to the fixing of the assessment lien against the property described in said certificates and the personal liability of the owners there- of, have been regularly had, done and performed, and such recitals shall be prima facia evidence of the matters so recited, and no further proof shall be required in any court, and the said certificates shall provide substan- tially that if default be made in the payment of any installment promptly as the same matures, then, at the option of the City of Fort Worth, or its assigns, the entire amount of the assessment shall be and become immediately due and payable, together wtih reasonable attorney's fees and costs of collection, if incurred, all of which, as well as the principal and interest on the assessment, shall be a first and prior lien against the property, superior to all other liens and claims except State,County,School District,and City ad valorem taxes. No error or mistake in naming any owner or in describing any property or in any other matter or thing, shall invalidate any assessment or any certificate issued in evidence thereof, and the omission of improvements on any particular unit or in front of anv property exempt by law from the lien of special assessment for street improvements shall not invalidate any assessment levied. The certificates referred to need not contain recitals in exactly the words above provided for, but the substance thereof shall suffice, and they may contain other and additional recitals pertinent thereto. VI. Bids having been advertised for as required by Article 1105b of the revised Civil Statutes of Texas, and the bid of S. R. 0. ASPHALT, INC. having been found to be the lowest and best bid for the malting and construction of said improvements,the contract therefore is hereby awarded to S. R. 0. ASPHALT, INC. , at and for the prices stated in the Proposal of said company and as reported and recommended by the Public Works Department, which said report and recom- mendation is on file with the City. the City Manager, and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City thereon, the said contract embracing, among other things,the prices for the work. VII. To provide for the payment of the indebtedness incurred by the City of Fort Worth, Texas, by said contract, there is hereby appropriated out of available funds and current revenues of the City, an amount sufficient to pay said indebtedness so incurred. VIII. The improvements provided for herein shall be made and constructed, notice given, hearing held and assessment levied and all proceedings taken and had in accordance with and under the terms of the powers and previsions of Chapter 106 of the Acts of the First Called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Texas Civil Statutes, which law has been adopted as an amend- ment to and made a part of the Charter of the City of Fort Worth,Texas,and tinder which law these proceedings are taken and had. Ix. Each unit above described shall be and constitute a separate and independent unit of improvement and the assessments herein provided for shall be made for the improvements in each unit according to the cost of the improvements in that unit and according to the benefits arising from the improvements in that unit. X. In making assessments, if the name of the owner be unknown, it shall be sufficient to so state the fact, and if any property be owned by an estate or by any firm or corporation, it shall be sufficient to so state, an it shall not be necessary to give the correct name of the owner, but the real and true owners of the property mentioned shall be liable and the assessments against the property shall be valid. XI. The Director of Public Works of the City of Fort Worth, Texas, be and he is hereby, ordered and directed to file with the City Council, estimates of the cost of such improvements in each unit, in accordance with the terms of the powers and provisions of the Charter of the City of Fort Worth,Texas. XIL The City Secretary is directed to prepare, sign and file with the County Clerk of Tarrant County,Texas, a notice in accordance with the provisions of the Act passed at the Fifth Called Session of the Forty-first Legislature of the State of Texas, and shown as Chapter 21 of the Acts of said Session of the Legislature,said Act having been passed in the year 1930, and now shown as Article 1220a of Vernon's Texas Civil Statutes. XIII. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. XIV. This ordinance shall take effect and be in full force and effect from and after the date of its passage. PASSED AND APPROVED THIS ' __DAY OF�Q�2 C 19 APPROVED AS TO FORM AND LEGALITY: City Attorney —— _------- _—� • ATTACHMENT "A" Page 1 of 5 CITY OF FORT WORTH PUBLIC WORKS DEPARTMENT ENGINEERING DIVISION ASSESSMENT PAVING AT 21 LOCATIONS, SOUTHEAST SIDE Project 097-24000-140 RESUME OF THE PROJECT A neighborhood Hearing was conducted by the Engineering Division at the Glen Park Elementary School Auditorium on September 8, 1965, for Assessment Paving at 21 Locations on the Southeast Side, Project 097-24000-140. The procedures concerning owner partici- pation in the cost of paving, including methods and policies of determining assessments, street construction standards, and method of payment were explained to the 65 persons in attendance. UNIT 1, HUNTING DRIVE - E1 Rancho Road to Trueland Drive In October of 1955, Seven property owners adjacent to the proposed opening of Hunting Drive between E1 Rancho Road and Trueland Drive, a distance of approximately 1,600 feet, petitioned the city to "construct, establish grades and extend" the street to provide access to interior lots, improve traffic circulation in the area and provide more direct access to Glen Crest School which is located about one block west of El Rancho Road at Eastline Road. The City Council authorized $12,400 for the project on November 21, 1956 for storm drains, land acquisition and grading, provided the adjacent property owners contributed $9,877 for required street materials. The project was delayed until 1960 by difficulties in acquiring seven parcels needed for right-of-way, including eminent domain proceedings for two parcels. On December 30, 1960,the City Council again considered the entire project and determined that it should proceed only if the property owners contributed funds on a "developer partici- pation basis". Representatives of the Glen Crest Civic League then appeared objecting to the decision, upon which the Council rescinded its action of December 30. On March 31, 1961 the- Council reaffirmed the basic terms of the 1956 agreement, provided the property owners paid for an upgraded street specification of hot mix asphaltic con- crete on a crushed stone base, instead of triple course penetration on a gravel base permitted in 1956. Property owners then attempted to assemble in escrow sufficient funds for the paving materials, but by letter of November 12, 1963 they advised the Public Works Department that the funds could not be gathered. The project was abandoned until April 22, 1964 when a petition representing 50.6 per cent of the abutting property (but only 6 of 22 property owners on the proposed street) was received requesting paving on the assess- ment basis. Processing of the project was delayed until the location of major water transmission mains in the area was determined. The Water Department now advises that no major mains will be located in the street. Much of the interior lot area to be served by the street opening is vacant and subject to development; however, the ownership is highly divided. Adjacent owners who are unable to resubdivide or develop new lots are generally opposed to the project. Absen- tee owners and most of those gaining lots for development either favor or do not oppose ATTACHMENT „A" Page 2 of 5 the project. The Public Works Department included the project because the percentage of cost distribution is approximately the same as provided in the original agreement (both the City and property owners shares have doubled) and because the paving fulfills the spirit of the agreement approved by the City Council in 1956 and reaffirmed in 1961. David E. Marsh, 2744 Timberline Drive, the owner of the east 70.2 feet of Lot 2, Block A, Nell Adams Subdivision, stated he was opposed to the opening and paving of Hunting Drive. Mrs. Bernard C. Ackert, 4801 E1 Rancho Road, the owner of Lot 1, Block lencrest Addition, asked why Hunting Drive was being opened and paved. It was explained to Mrs. Ackert that the paving was proposed as the result of a petition by owners of abutting property. William E. Brazier, 2720 Timberline Drive, the owner of Tract 8F, M. Watson Survey, requested that he be placed on the record as opposed to the paving. UNITS 2, _3. 4, and 5, - COLLM STREET - Shackleford to Erath to Tallman to Nolan to Foard. Mrs . Allen J. Mallory, 4433 Foard, Lot 6, Block 1, Cobb's Orchard Addition stated that on March 8, 1965, she had applied to the City Plan Commission for permission to sub- divide her lot and was refused and as a consequence she was opposed to the paving. Investigation discloses that the subdivision of Lot 6 was reviewed and denied by the Plan Commission because it would result in non-conforming buildings on the new lots. Mrs. L. J. Perry, 4500 Nolan, the owner of Lot 6, Block 12, Cobb 's Orchard Addition, stated she could not afford the paving. She was advised that the City would be willing to discuss arrangements for an extended payment plan in order to relieve any financial hardship as a result of the paving improvements. Mr. James V. Blackwell, 4445 Nolan, Lot 6, Block 12, Cobb's Orchard Addition, stated he had not worked for eight months and that he could not pay for the paving even if the payments were extended over a period in excess of 49 months. Mr. Blackwell was also invited to discuss special financial arrangements with the staff. UNITS 6 and 7, TALLMAN STREET - Howard Street to the north line of Lot 3, Block 13, Cobb's Orchard Addition No objections to the paving were stated at the hearing. UNIT 8, BROOKLINE AVENUE - Trentman Street to 330 feet east No objections to the paving were stated at the hearing. UNIT 9, ARBOR AVENUE - Brookline Avenue to Miller Avenue Mr. K. J. Lee, 4100 Arbor, Lot 9, Block 10, Trentman City Addition, asked that he be placed on the record as opposed to the paving. UNITS 10 and 11, FLAMINGO ROAD - Algerita to Arbor to Brookline A 54 inch Water Department Transmission main is proposed for construction in this section of Flamingo Road in 1967. Deferment of the paving is proposed for these units until after the installation of the water main. See Attachment A-1. i ATTACHMENT "A" Page 3 of 5 UNITS 12 and 13, BROOKLINE AVENUE - Miller to Flamingo to Nell Brookline Avenue, (Unit 12) from Miller to Flamingo, and (Unit 13) from Flamingo to Nell, were initiated by the City to provide paved access to Flamingo, and a paved connection on Brookline between Miller Avenue and Nell Street. Because Flamingo Road is proposed for deletion, it is also proposed to delete units 12 and 13 of Bro-11 ine until such time as petitions are received or Flamingo Road is again initia- ted as a paving project. See Attachment A-1. UNITS 14 and 15, DUROTHY ROAD - Laster to Vesta Farley to David Strickland Road An area petition for paving Durothy Road, Units 14 and 15 and Laster Road, Unit 16 was sponsored by the P.T.A. of W. M. Green Elementary School. Residents in the Sun Valley Addition located east of I.H. 820 must cross the freeway at the overpass at Laster Road to reach the school. The paving of Laster Road and Durothy Road will provide paved access from the freeway west to the school. See Attachment A-3. Mr. E. C. House, who is a real estate appraiser representing the Weisenberger Company, the owner of Lots 20 and 21, Block 2, Weisenberger City Addition stated they did not request or desire the paving at this time and that in his opinion the enhancement to the property would not equal the paving cost. The property was assessed at residential rates with side lot credit granted. As a result of Mr. House's statements concerning property enhancement, the Public Works Department retained the services of an independent outside real estate appraiser to estimate the increase in value to side lot properties on Durothy Road. The appraisals obtained have been evaluated by the staff and a reduction in assessments is justified with the exception of Lots 21A and 22B, Block 1, Weisenberger City Addition. This property has been sub -divided and replatted to form two lots fronting on Durothy Road and is subject to assessments without side lot credit. The replatting has resultied: in Lot 22B becoming a corner lot with side lot on Vesta Farley Road, If Vesta Farley Road is paved in the future this lot will receive the same consideration for assessment reductio n as the side lots on Durothy Road now being assessed. The Public Works Department recommends reduction in paving assessments on the following side lots on Durothy Road in the amount representing the difference between the standard assessment and the estimated increase in lot values. Mrs. John R. Rivers, 5418 Durothy Road, the owner of Lot 22B, Block 1, Weisenberger Addition, stated she was in favor of the paving. Mrs. Charles A. Richardson, 5418 Durothy Road, the owner of Lot 1, Block 11, Weisenberger City Addition, stated she was opposed to the paving and inquired if it would be possible to change the west service road adjacent to I.H. 820 from one-way traffic to two-way traffic. Mrs. Richardson was advised that the Public Works and Traffic Engineering Departments could not recommend a change in the one-way traffic on the service road. The freeway was designed with one-way service roads in order to provide maximum traffic safety and a change such as suggested would expose the public to unwarranted traffic hazards. UNIT 16, LASTER ROAD Durothy Road to the west line of I.H. 820 Gertrude Holt, 5321 Laster, the owner of Lots 27, 28, 29 and 30, Block 11,Weisenberger Addition, stated her property was valuable and she desired the street be paved. Mrs. Holt also expressed an interest in obtaining sewer service. She was advised that the Water Department was ready to install a sewer line in Laster Road provided the property owners would pay their share of the cost as determined by standard community facilities policies. Mrs. E. V. Reid, 3032 Lomita, the owner of Lots 41 and 42, Block 11, Weisenberger City Addition, requested information as to whether water and sewer service would be made available to property on Laster Road. Mrs. Reid was advised that the Water Department did not plan to install the services in advance of paving because the property was vacant, but that the service could be provided back of the curb in the future when the adjacent land is developed. UNIT 17, FREDDIE STREET - From the south line of Lot 8, Block C, Castleman Addition to Baylor Street No objections to the paving were stated at the hearing. T r♦ f ATTACHMENT "A" Page 5 of 5 UNIT 18, FITZHUGH STREET - From 245 feet west of Donalee to Donalee Mr. Joe F. Jones, 3824 Fitzhugh, the owner of Lot 7, Block 2, L. S. Byrd Subdivision, stated that even though he signed the petition he considered the paving costs too high. He stated that the paving of Donalee Street cost about $0.80 a front foot. Mr. Jones was advised that Donalee Street was a penetration asphalt street which was pre- viously permitted under lesser paving standards. This cost of $0.80 did not include excavation, gravel base material, and curb and gutter. It was explained that penetration type street construction has resulted in numerous paving failures and often requires complete reconstruction. Although a majority of original petition signers have reversed position, the Public Works Department recommends closing the short unpaved gap and providing continuous pavement on Fitzhugh between Donalee and Sydney Street. t Mr. E. B. Kelly, 3816 Fitzhugh, the owner of Lot 5, Block 2, L. S. Byrd Subdivision stated that he preferred a hot topped street similar to Donalee Street and that by raising the paving standards he was deprived of the choice of paving. Mr. Kelly stated the people have no voice in the matter and that the City Council was forcing them (the residents being assessed) into something they did not want. Mr. Kelly was advised that the neighborhood hearing was held for the express purpose of allowing property owners to voice their opinions and that their comments are considered and help to guide the City Council in its decisions. UNIT 19, LINDSAY STREET - From 400 feet south of Avenue H to 525 feet south Lindsay Street was petitioned for paving by Mr. E. A. B(per, the owner of Lots B and C, Ethan Boyer Subdivision. At the time the petition was bubmitted to the Public Works Department it was Mr. Boyer's intention to improve his property. Mr. Boyer has advised the staff that he now has no plans to build on the property and no longer desires the pavement. Since the paving would only serve to extend a dead end street by 125 feet and would serve no improved property the Public Works Department concurs in Mr. Boyer's request that the street not be paved. See Attachment A-2. UNIT 20, CARVERLY AVENUE - From Texas Electric Company R.O.W. to Maceo Lane No objections to the paving were stated at the hearing. Carverly Avenue was initiated as a paving project in response to a request by Texas Electric Service Company. This small section of unpaved street constitutes a short paving gap and the lack of curb and gutter encourages public useage of the company right-of-way for motor vehicle traffic as well as off street parking. Residents in the Sun Valley Addition east of I.H. 820 use Laster Road and Durothy Road to reach the school. The project will provide paved. access west of the freeway to the school. Carverly Avenue (Unit 20) was initiated by the City in response to a request by the Texas Electric Service Company, in order to control vehicular trespass of the company's right-of-way. The project will also close a paving gap on Carverly Avenue between Maceo Lane and Alexander Drive. Proposed Deletions Following processing of petitions for this project, it was determined that a 54 inch water transmission main is proposed for construction in the Flamingo Road right-of-way in 1967 (CIP B-21). It is therefore proposed that Flamingo Road (Units 10 and 11) and intersecting blocks of Brookline Avenue (Units 12 and 13) be deleted from this project. A valid petition was received for paving Lindsay Street (Unit 19), but the poll card survey indicates that the original petition signers are now opposed to the paving. Because property owner support has been withdrawn and the street is deadend providing no neighborhood circulation, it is proposed that the Lindsay Street paving be deleted from the project.
