HomeMy WebLinkAboutOrdinance 5062 ORDINANCE NO. �O Y AN ORDINANCE AMENDING ORDINANCE NO. 3011, THE COMPREHENSIVE ZONING ORDINANCE, BY ADDING A NEW USE, CASTING OF MAGNESIUM PRODUCTS, TO SECTION 14, "J" LIGHT INDUSTRIAL DISTRICT, USE REGULATIONS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR SEVERABILITY; PROVIDING FOR A FINE OF NOT LESS THAN $5.00, NOR MORE THAN $200.00 FOR VIOLATION OF THE TERMS OF THIS ORDINANCE AND THAT EACH DAY THAT A VIOLATION EXISTS SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 14, "J" Light Industrial District, USE REGULATIONS of Ordinance No. 3011 be and the same is hereby amended to include the following additional use: 9-B-1. Casting of magnesium products provided,that the capacity of any one (1) melting pot or ladle shall not exceed three hundred (300) pounds. SECTION 2. The zoning regulations and districts, as, herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals, and the general welfare of the community. They have been designed to lessen- congestion in the streets; to secure safety from fire, panic, flood and other dangers; tu provide adequate light and air9 to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing with reasonable consideration, among other things, of the character of the district and its particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where promo ions of those ordinances are in direct conflict with-the provisions of this ordinance, SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION S. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars (,$200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6. Adopted: .d` 6 VZ 194 3 • City of Dort Worth, Texas Mayor and Council Communication DATE REFERENCE sueJEcr: NUMBER proposed Zoning Ordinance PAGE 11/25/63 pZ-84 endment - Magnesium Casting in "J" IotDiqtrirt _L On September 16, 1960, Comprehensive Zoning Ordinance Number 3011 was amended to permit casting of aluminum products, with a maximum capacity of three hundred pounds for anyone melting pot or ladle in "J" Light Industrial Dis- tricts. This use has proved to be compatible with other uses in the "J" Light Industrial District and no zoning or enforcement problems have been encountered. An inquiry was received recently regarding the zoning requirement for casting both aluminum and magnesium. Information was supplied to the inquirer that casting of aluminum was a permitted use in a "J" Light Industrial District, but that casting of magnesium products required "K" Heavy Industrial zoning and ap- proval of the Zoning Board of Adjustment after a public hearing. The inquiry was transmitted to the City Zoning Commission for discussion and the Commission instructed the staff to investigate and prepare a report on the possibility of a text change to permit magnesiuia casting in the "J" Light In- dustrial District. The staff report recommending a zoning text change, a copy of which is attached, was submitted to the Zoning Commission on September 17, 1963. The Commission instructed that a public hearing be advertised for -October 15, 1963, to consider the proposed zoning text change, a copy of which is also attached to this communication. .At the public hearing, there was no opposition to the proposed change, and the Commission voted unanimously to recommend to the Council that the "J" Light Industrial District of Zoning Ordinance Number 3011 be amended to include casting of products from magnesium, with a three hundred pound limit for any one melting pot or ladle. A resolution was adopted by the City Council on November 4, 1963, setting a public hearing by the Council for November 25, 1963, to consider the recom- mended change, and the necessary publication has been made.
