AN ORDINANCE VACATING AND EXTINGUISHING AN 16 FOOT
WIDE ALLEY, SITUATED IN BLOCKS 5 AND 10, DAGGETT'S SECOND
ADDITTION, AN UNRECORDED ADDITION TO THE CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS, CONTAINING
APPROXIMATELY 8,876.5 SQUARE FEET OR 0.2038 ACRE OF LAND
MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a sixteen-foot wide alley, situated in Blocks 5 and 10, Daggett's Second Addition,
an unrecorded addition to the City of Fort Worth, Tarrant County, Texas and containing 8,876.5
square feet or 0.2038 of land more or less, and as more specifically described in Exhibits A
attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

DESCRIPTION OF ALLEY PROPOSED FOR VACATION
SITUATED in the City of Fort Worth, Tarrant County, Texas, and being all of that certain 16 foot wide alley in
Blocks 5 and 10, of Daggett's Second Addition, and said alley being more fully described as follows:
BEGINNING at the southeast corner of Lot 1-R, of said Block 10, in the north line of East Broadway Street (50
feet wide) for the southwest corner of said alley;
THENCE North 0 degrees, 39 minutes West with the east line of said Lot 1-R for the west line of said alley,
crossing closed East Daggett Avenue, and continuing with the west line of said alley and the east line of Lots 6
through 1, in said Block 5, in all 555.18 feet to the northeast corner of said Lot 1 in Block 5, in the southerly line
of East Vickery Boulevard (variable width right-of-way);
THENCE South 87 degrees, 51 minutes, 10 seconds East with said south line of East Vickery Boulevard for the
north line of said Block 5, and the north line of said alley, continuing in all 16.01 feet to the northwest corner of
said Lot 12 for the northeast comer of said alley;
THENCE South 0 degrees, 39 minutes East with the west line of Lots 12 through 7 in said Block 5, for the east
line of said alley, crossing said closed East Daggett Avenue, and continuing with the west line of Lots 13 and 14
for the east line of said alley, in all 554.39 feet to the southwest corner of said Lot 14 for the southeast corner of
said alley in said north line of East Broadway Street;
THENCE South 89 degrees, 21 minutes West with said north line of East Broadway Street for the south line of
said alley, continuing in all 16.0 feet to the PLACE OF BEGINNING, and containing 8876.5 square feet (0.2038
acre).

Adopt Ordinance Vacating an Alley in Blocks 5 and 10, Daggett's Second Addition, Between East Vickery Boulevard and East Broadway
Avenue to be Replatted with the Adjoining Property for Additional Parking and Driveway Access for the Existing Industrial Warehouses(COUNCIL
DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating an alley in Blocks 5 and 10, Daggett's Second Addition, between East Vickery Boulevard and East
Broadway Avenue to be replatted with the adjoining property for additional parking and driveway access for the existing industrial warehouses;
and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
G.Curtis Surveyors, LLC,on behalf of 300 East Vickery, LLC, Boonpetro Real Estate, LLC and 201 South Calhoun Parters, LLC,has requested
vacation of this alley to be replatted with the adjoining property for additional parking and access for the industrial warehouse located along the
alley.The City Plan Commission recommended approval of this request at its meeting on September 25,2019.An acceptable final plat(FS-19-
170)has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication (M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the alley.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
