I � AN ORDINANCE PROVIDING TEAT THAT PORTION OF CAPPS STREET BETWEEN THE EAST LINE OF SOUTH MAIN STREET AND THE WESTER- LY LINE OF BRYAN AVENUE AND MORNINGSIDE DRIVE INTERSECTION ON THE EAST BE ABANDONED, CLOSED AND VACATED, PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING THAT THIS ORDINANCE BECOIE EFFECTIVE INRIv1EEDIATELY. WHEREAS, it appearing to the City Council of the City of Fort Worth, Texas, that heretofore on or about the 24th day of July, A. D. 1931, the construction of a subway was completed under the tracks of the Missouri- Kansas-Texas Railway Company near a point where Capps Street intersects said railway tracks at grade; and, WHEREAS, said underpass was found to be fully adequate to meet all the requirements for pedestrian and vehicular traffic in that area; and, WHEREAS, it was also found that it was dangerous for traffic to use the grade-crossing over said railway lines at said point, and the City Council, after such investigation, abandoned, closed and vacated that portion of the street over said grade-crossing at the date aforementioned, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That the action of the City Council of the City of Fort Worth, Texas, in closing vacating and abandoning that portion of Capps Street, lying and being between the east line of South Main Street on the west and the westerly line of Bryan Avenue and Morningside Drive intersection on the east and being north of and adjacent to Block #2, South Park Heights Addition to the City of Fort Worth, Tarrant County, Texas, as shown by the attached plat marked Exhibit "A", be and the same is hereby adopted, confirmed and ratified. SECTION II. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION III. That this ordinance shall take effect and be in full force and effect from and after the date of its passage.
