r ORDINANCE NO. �--- AN ORDIN kNCE CLOSING, VACATING AND P_.?�IANENTLY ABANDONING THAT PART OF ALICE STREET TENDING FROM THE NORTH LINE OF DICKSON STREET NORTH A�--'HVIMBI n AND UFTY (S50) FEET, UPON CERTAIN CONDITIONS 1O-RE PARTICULARLY SET 6ff IN SAID ORDINANCE, AND ACCEPTING THE DEDICATION OF A STRIP OF LAND FIFTY (50) FEET IN ',.IDTH OFF OF THE LAST END OF LOTS ONE (1) TO ELEVEN (11), INCLUSIVE, OF BLOCK T',ENTY (20) , ORTH HEIGHTS ADDITION TO THE CITY OF FORT .ORTH, TARRANT COUNTY, TEXAS, FOR STREET PURPOSES. SE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION I. That Alice Street, bets,cen Dickson and Martin Streets in the City of Fort Worth, is not now and never has been extensively used for traffic; that public necessity requires that the present location of Alice Street from Waggoman Street to Biddison Street be changed so that said street shall be located at least seventy-five (75) feet east of its present location, in order that the interest of the public shall be better served. That it is advantageous and to the best interest of the public that that part of Alice Street,between the north line of Dickson Street at-A, ..(IOU} fist mouth line of Martin:Street, be immediately closed, vacated and permanently abandoned, and that a dedication of a strip of land off of the east end of lots one (1) to eleven (11), inclusive, of Block twenty (20), Worth Heights addition to the City of Fort Worth, be accepted for the purposes of a street, thoroughfare and public ]aigh"y. SECTION II. That before this Ordinance shall go into effect, the Fort Worth Elevators Company, a private corporation, shall file in the office of the City Secret P3;-Treasurer a writt`em acceptance of the following terms: (a) . That, in the event the City Council of the City of Fort Worth deem it wise and expedient to order the construction of an tinder pass or wdbway under the tracks of the any of Texas, that sad Fort Worth Elevators Company will co-operate with the said City in the construction of said under pass and furnish such portion of its property as shall be necessary to do such con- struction work, and shall waive any claim for damages to adjacent, contiguous or other property by reason of the construction of such subway, and will also furnigh proper location for necessary retaining walls. (b). That the said Fort Worth Elevators Company shall dedicate to the City of Fort IVorth for the use of the public, and as a street and public thoroughfare, fifty (50) feet off of the east end of Lots one (1) to eleven (11), in- clusive, in Block twenty (20), Worth Heights Addition, which strip, together with the present alley, will make. a thorough- fare sixty (60) feet in width. (c) . This Ordinance shall be ineffect from and after the receipt of the written acceptance of the terms hwein set forth by the Fort Worth Elevators Company. Van Zandt, Jr., City Secretary-Treasurer, Dear Sir: We are in receipt from you of certified copy of Ordinance No. 1162, passed by the Fort Worth City Commission on Tuesday, August 17th, 1926, clos- ing, vacating, and permanently abandoning to our use that part of slice Street extending from the north line of Dickson Street north 550 feet to the south line of Martin Street, granting to us the right to occupy the abandoned portion of Alice Street 50 feet in width east and west by 550 feet in length north and south, upon which we will immediately construct an addition to our "Katy" El- evator in the form of reinforced concrete grain storage bins and Head House. We accept this Ordinance unreservedly and in accordance with its provisions, and hereto affix our Corporate Seal, accompanied by the signature Of our firm, made by our President, Jule G. Smith, and attested by our Vice President & Treasurer, Wilton P. Ingraham, and Vice President & Secretary, Jule B. Smith, it being our further understanding that the City of Fort Worth will Quit Claim Deed to us this pmrt of Alice Street 50 feet wide by 500 feet in length at such time as they call upon us for a Deed to the City of Fort Worth of a similar strip off of the east side of lots 1 to 11, block 20, 550 feet in length, to be used as a part of a 60 foot street eztending 'from Martin Street on the north to Dickson Street on the south. Trusting that this letter of acceptance in every way meets the require- ments of Ordinance No. 1162, a copy of which we now have, we hereby subscribe our official signatures.
