MC Needed) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and HDR Engineering, Inc. , (Engineer) made and entered into City Secretary Contract No. 35202, (the Contract) which was authorized by the City Council by M&C G-15722 on the Fifteenth day of May 2007; and WHEREAS, the Contract involves engineering services for the following project: Terminal-been Storm Drain Extensions, Project No. 00658 WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in M&C G-15722 ,adopted by the City Council on the Fifteenth day of May 2007 and further amplified in a proposal letter dated August, Sixteenth, 2010, copies of which are attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $79,881. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $323,581. WORTH, TX ATTACHMENT "A" Scope for Engineering Design Related Services for Storm Water Improvements Protects Scope for Engineering Design Related Services Storm Water Facilities Improvements Terminal-Deen Area The scope set forth herein defines the work to be performed by the ENGINEER in completing the project. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. Under this scope, "ENGINEER" is expanded to include any sub-consultant, including surveyor, employed or contracted by the ENGINEER. OBJECTIVE Storm water runoff from the Burlington Northern Santa Fe (BNSF) Railway yard located east of N. Main Street in the City of Fort Worth, Texas (see ATTACHMENT"E"—Area Location Map) has caused flooding of resident's yards along Zwolle Street south of Terminal Road. HDR Engineering, Inc. performed a conceptual drainage study to determine design alternatives which will alleviate this flooding. The study recommended the upgrade and replacement of the existing storm drain system along Zwolle and Beaumont Street. This new system requires up-sizing the storm drain and placing new inlets and manholes along Zwolle and Beaumont Streets. Along with these drainage improvements, roadway improvement plans will be prepared, including full asphalt street improvements for Zwolle Street and Beaumont Street. These improvements are to be based on design criteria as per the City of Fort Worth "Storm Water Management Design Manual" dated March 2006. This amendment will include the preparation of additional construction plans extending the proposed storm drain from Zwolle, along Terminal Road to Deen Road (i.e. the entrance into the BNSF yard). This additional work will include survey, design of the required inlets, storm drain, and lateral lines. The work will include any reconstruction of Terminal that may be necessary to complete the storm drain. In addition, this amendment includes the work necessary to complete the design under current City guidelines, procedures, and protocols regarding the construction phase services, traffic control, and a proper SWPPP. WORK TO BE PERFORMED TASK 1. DESIGN MANAGEMENT. ENGINEER will manage the work outlined in this scope to ensure efficient and effective use of ENGINEER's and CITY's time and resources. ENGINEER will manage change, communicate effectively, coordinate internally and externally as needed, and proactively address issues with the CITY's Project Manager and others as necessary to make progress on the work. 1.1. Communications and Reporting • Attend a pre-design project kickoff/chartering meeting with CITY staff to confirm and clarify scope, understand CITY objectives, and ensure economical and functional designs that meet CITY requirements. • Conduct and document monthly project update meetings with CITY Project Manager. • Conduct review meetings with the CITY at the end of each design phase. • Conduct and document biweekly design team meetings. • Prepare invoices, in accordance with Attachment B to this Standard Agreement and submit monthly in the format requested by the CITY. • Prepare and submit monthly progress reports in the format provided by the respective CITY Department. • Prepare and submit baseline Project Schedule initially, and Project Schedule updates with a schedule narrative monthly, as required in Attachment D to this Standard Agreement and according to the City of Fort Worth's Schedule Guidance Document. • Complete Monthly M/WBE Report Form and Final Summary Payment Report Form at the end of the project. • Coordinate with other agencies and entities as necessary for the design of the proposed infrastructure, and provide and obtain information needed to prepare the design. • With respect to coordination with permitting authorities, ENGINEER shall communicate with permitting authorities such that their regulatory requirements are appropriately reflected in the designs. ENGINEER shall work with regulatory authorities to obtain approval of the designs, and make changes necessary to meet their requirements, as part of the design scope. • Personnel and Vehicle Identification: When conducting site visits to the project location, the ENGINEER or any of its sub-consultants shall carry readily visible information identifying the name of the company and the company representative. ASSUMPTIONS • The following is intended to clarify and/or expand upon the work necessary to complete TASK 1 — DESIGN MANAGEMENT as described above: 1.1 Managing the Team This Task shall include the leadership, management, and direction of the design team; ensure quality and performance of the work; provide for proper internal and external communication, and the allocation of team resources. The project management portion of this contract shall include reimbursable expenses, project team meetings, correspondence, invoicing, schedule, resource and budget tracking, and other project management duties required for the duration of the project. 2. It is assumed Section 1.1(a)of this Scope complies with the provisions of Contract Amendment #1. No additional fee is anticipated for this work. b. Quality Assurance/Quality Control (QA/QC) 1. Prior to submitting deliverables to the CITY, a Senior Engineer shall thoroughly review all plans, specifications, and estimates, as well as other deliverables, for accuracy and completeness using HDR QA/QC established procedures. Documentation of all QA/QC reviews shall be kept in the project files. 2. Periodically throughout the project, the Project Principal shall check with the project manager and CITY staff to discuss the performance of the project team address staffing concerns (if any) and ensure the CITY needs are being met in accordance with the scope and schedule. 3. It is assumed Section 1.1(b)of this Scope complies with the provisions of Contract Amendment#1. No additional fee is anticipated for this work. c. Team Meetings and Correspondence 1. During the course of the project, the Project Manager will conduct team meetings to discuss the progress of the project, project deliverables, and team assignments. It is assumed the provisions of Section 1.1(c)(1)are considered incidental to provisions of Contract Amendment #1 and will be continued under this Sub-Section. No additional fee is anticipated for this work. 2. Meetings between the CITY and ENGINEER shall occur as needed. Decisions resulting from such meetings shall be documented and kept in the project files. For the purposes of this Scope, it is assumed three (3) meetings will be conducted that are not incidental to, or otherwise described in, this Scope of work. It is further assumed these meetings will be attended by the Project Manager, Project Engineer, and/or Project EIT. Additional personnel will be added as directed by the Project Manager. The work related to this Sub-Section is considered additional services and will be performed under this Scope and Fee. The ENGINEER shall prepare notes and correspondence as needed so as to maintain a documentation of project related conversations, decisions and City direction that takes place during the duration of the project. It is assumed the provisions of Section 1.1(c)(3) of this Scope are incidental to other provisions as described in this scope of work. No additional fee is anticipated for this work. d. Team Resource Allocation 1. The ENIGEER shall assign the team members necessary to complete the project. The Team shall as a minimum include the Project Manager, Project Engineer, and a Design EIT. Additional Staff will be assigned as needed and/or as directed by the Project Manager. 2. The Project Manager shall be responsible for the leadership, management, and direction of the design team. He shall also be responsible for the communication with the CITY. 3. This work is considered incidental to Contract Amendment #1 and this Scope of work. No additional fee is anticipated for this work. 1.2 Communications and Reporting a. A pre-design project kickoff/chartering meeting with CITY staff was held in accordance with the requirements of Contract Amendment #1 to confirm and clarify the Scope and CITY objectives related to the work in Beaumont and Zwolle Street. A kickoff/chartering meeting for the additional work (i.e. the extension of the storm drain along Terminal from Zwolle to Deen Street) is not anticipated in this Scope. b. It is understood the monthly project update meetings will begin with a September meeting. A maximum eleven (11) meetings are assumed based on a construction start date of November 1 and a 180 working day construction schedule. This Scope assumes the Project Manager, will attend these meetings. Additional personnel will be added as directed by Project Manager. c. It is understood that a maximum of three (3)formal review meetings will be conducted at the end of each design phase including the CONCEPTUAL DESIGN PHASE (30%), PRELIMINARY DESIGN PHASE (60%), and the FINAL DESIGN PHASE (90%). Each review meeting will be attended by the Project Manager, Project Engineer, and/or the Project EIT. Additional, personnel will be added at the direction of the Project Manger. 1. A formal review meeting was held for the submittal of the 30% and 60% Design Plans. These meetings were not contemplated in City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 4 of 31 Contract Amendment#1, however, each meeting was conducted using the procedures and protocols described in this Scope of Services are considered additional work. The 90% review meeting will be held under the provisions of this Scope. 2. It is understood informal meetings related to the 30% and 60% Design Plans were held under the provisions of Contract Amendment#1. The Design plans included the work related to Beaumont and Zwolle. No additional fee is anticipated for this work. 3. This work assumes one review by the CITY for each design Phase. Additional comments and/or responses required by the CITY may be considered as additional work. d. It is understood informal design team meetings have been held as needed in accordance with the provisions of Contract Amendment#1. No additional fees are anticipated for this work. However, formal design team meetings will begin in August 2010 under the provisions described in this Scope Amendment. A maximum of five (5) bi-weekly meetings will be held during the anticipated completion of the project including this original as well as the additional work (the extension of the Storm Drain along Terminal from Zwolle to Deen). The meetings will be attended by the Project Manager, Design Engineer, Project EIT, and other personnel as determined by the Project Manager and are considered additional services. e. It is understood the preparation of invoices is considered incidental to both Contract Amendment#1 and this Scope of Services and no additional fee is anticipated for this work. It is understood the invoices, beginning with the August 2010 invoice, will be submitted in accordance with Attachment B to this Standard Agreement and submitted monthly in the format requested by the CITY. f. It is understood the preparation and submittal of monthly progress reports is considered as incidental to both Contract Amendment #1 and this Scope of Services. No additional fee is anticipated. g. Prepare and submit baseline Project Schedule, and Project Schedule updates with a schedule narrative monthly, as required in Attachment D to this Standard Agreement and according to the City of Fort Worth's Schedule Guidance Document. 1. It is understood that an initial schedule was submitted to the City and updated as needed and/or as directed by the City's Program Manager. Contract Amendment#1 does not require monthly updates or narratives. 2. It is assumed that monthly updates and narratives have been (will be) provided beginning in July 2010 under the provisions as described in this Scope of Services. The work related to the monthly schedules and narratives will be considered additional work. A maximum of eleven (11) schedule updates and narratives will be provided based on a construction begin date of November 1, 2010 and 180 working days for construction. It is understood the preparation and submittal of Monthly M/WBE Report Form and the Final Summary Payment Report Form at the end of the project is considered incidental to both Contract Amendment #1 and this scope of work. No additional fee is anticipated. i. Coordinate with other agencies and entities as necessary for the design of the proposed infrastructure, and provide and obtain information needed to prepare the design. Work related to this provision is considered as incidental to other Sections described in this Scope of Services. 1. It is assumed the ENGINEER will coordinate the design with construction of the 12"water line to be located in Beaumont, from Grover to Deen. This work is in accordance with Contract Amendment#1 as well as this Scope of Services and no additional fee is anticipated. j. With respect to coordination with permitting authorities, no permits, other than a Flood Plain Fill Permit is anticipated. Therefore, no coordination with permitting agencies is anticipated in this scope of services. Any such coordination required by the City will be considered additional work. k. Personnel and Vehicle Identification: When conducting site visits to the project location, the ENGINEER or any of its sub-consultants shall carry readily visible information identifying the name of the company and the company representative. This work is considered incidental to the provisions of this Scope of services. No additional fee is anticipated for this work. DELIVERABLES A. Meeting summaries with action items B. Monthly invoices C. Monthly progress reports D. Baseline design schedule E. Monthly schedule updates with schedule narrative describing any current or anticipated schedule changes F. Monthly M/W BE Report Form and Final Summary Payment Report Form TASK 2. CONCEPTUAL DESIGN (30 PERCENT). The Conceptual Design shall be submitted to CITY per the approved Project Schedule. The purpose of the conceptual design is for the ENGINEER to identify, develop, communicate through the defined deliverables, and recommend the design concept that successfully addresses the design problem, and to obtain the CITY's endorsement of this concept. Data Collection • In addition to data obtained from the CITY, ENGINEER will research and make efforts to obtain pertinent information to aid in coordination of the proposed improvements with any planned future improvements that may influence the project. ENGINEER will also identify and seek to obtain data for existing conditions that may impact the project including; utilities, agencies (such as TxDOT and railroads), CITY Master Plans, CITY drainage complaint files, existing applicable drainage studies, FEMA floodplain and floodway maps, existing models of project area (if any) and property ownership as available from the Tax Assessor's office. • The following is applicable at all locations that require water service line replacement: The ENGINEER shall visit the project site and obtain the meter numbers and sizes on all existing meters to be replaced on the project and shall identify existing sample stations and fire line locations. 2.2. Drainage Computations • ENGINEER will delineate the watershed based on contour data and field verification and document existing street; right-of-way and storm drain capacities for the subject site. A drainage area map will be drawn at maximum 1" = 200' scale from available 2-foot contour data with the contours labeled. Data source and year will be provided by the CITY. Calculations regarding street and right-of- way capacities and design discharges (5-year and 100-year frequencies) at selected critical locations will be provided. Capacities of existing storm drain will be calculated and shown. All calculations shall conform to CITY criteria delineated in the CITY's Storm Water Management Design Manual. All locations in the project area where 100-year runoff exceeds available storm drain and right-of-way capacities shall be clearly identified. The ENGINEER's responsibility includes recommendations for improvements of the existing system as deemed reasonable and consistent with CITY standards. 2.3. Subsurface Utility Engineering Provide Subsurface Utility Engineering (SUE) to Quality Level B as described below. The SUE shall be performed in accordance with Cl/ASCE 38-02. Quality Level D • Conduct appropriate investigations (e.g., owner records, County/CITY records, personal interviews, visual inspections, etc.), to help identify utility owners that may have facilities within the project limits or that may be affected by the project. • Collect applicable records (e.g., utility owner base maps, "as built"or record drawings, permit records, field notes, geographic information system data, oral histories, etc.) on the existence and approximate location of existing involved utilities. • Review records for: evidence or indication of additional available records; duplicate or conflicting information; need for clarification. • Develop SUE plan sheets and transfer information on all involved utilities to appropriate design plan sheets, electronic files, and/or other documents as required. Exercise professional judgment to resolve conflicting information. For information depicted, indicate: utility type and ownership; date of depiction; City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 7 of 31 quality level(s); end points of any utility data; line status (e.g., active, abandoned, out of service); line size and condition; number of jointly buried cables; and encasement. Quality Level C (includes tasks as described for Quality Level D) • Identify surface features, from project topographic data and from field observations that are surface appurtenances of subsurface utilities. • Include survey and correlation of aerial or ground-mounted utility facilities in Quality Level C tasks. • Survey surface features of subsurface utility facilities or systems. • The survey shall also include (in addition to subsurface utility features visible at the ground surface): determination of invert elevations of any manholes and vaults; sketches showing interior dimensions and line connections of such manholes and vaults; any surface markings denoting subsurface utilities, furnished by utility owners for design purposes. • Exercise professional judgment to correlate data from different sources, and to resolve conflicting information. • Update (or prepare) plan sheets, electronic files, and/or other documents to reflect the integration of Quality Level D and Quality Level C information. • Recommend follow-up investigations (e.g., additional surveys, consultation with utility owners, etc.) as may be needed to further resolve discrepancies. • Provide Quality Level C to identify overhead utilities on the project and provide the overhead utility information on the SUE plan sheets. Level B (includes tasks as described for Quality Level C) • Select and apply appropriate surface geophysical method(s) to search for and detect subsurface utilities within the project limits, and/or to trace a particular utility line or system. • Based on an interpretation of data, mark the indications of utilities on the ground surface for subsequent survey. Utilize paint or other method acceptable for marking of lines. • Unless otherwise directed, mark centerline of single-conduit lines, and outside edges of multi-conduit systems. • Resolve differences between designated utilities and utility records and surveyed appurtenances. • Recommend additional measures to resolve differences if they still exist. Recommendations may include additional or different surface geophysical methods, exploratory excavation, or upgrade to Quality Level A data. • As an alternative to the physical marking of lines, the ENGINEER may, with CITY's approval, utilize other means of data collection, storage, retrieval, and reduction that enables the correlation of surface geophysical data to the project's survey control. Level A • Expose and locate utilities at specific locations. • Tie horizontal and vertical location of utility to survey control. • Provide utility size and configuration. • Provide paving thickness and type, where applicable. City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 8 of 31 • Provide general soil type and site conditions and such other pertinent information as is reasonably ascertainable from each test hole site. 2.4. The Conceptual Design Package shall include the following: • Written summary of alternative design concepts considered, strengths and weaknesses of each, and the rationale for selecting the recommended design concept. • Cover sheet • Drainage area map with supporting drainage computations in the CITY's standard tabular format. • SUE Plan sheets sealed by a licensed professional engineer registered in the State of Texas. • Horizontal alignment (excluding profiles) of proposed storm water improvements, including existing lot layout, , streets, street right-of-way, proposed easements, and existing utilities gathered during the SUE within the project limits. • Proposed phasing of water, sanitary sewer, street and drainage work documented in both the project schedule and narrative form. • Documentation of key design decisions (Project Decision Log). • Estimates of probable construction cost. ASSUMPTIONS • The following is intended to clarify and/or expand upon the work necessary to complete TASK 2 — CONCEPTUAL DESIGN (30 PERCENT) as described above: 2.1 Data Collection a. It is understood this Sub-Section expands and/or clarifies the provisions given in Contract Amendment#1 and this Scope of Services. 1. The data collection of the work related to Beaumont and Zwolle was completed under the provisions of the Contract Amendment #1. It is assumed this work complies (or will apply) with the requirements of this Scope of Services as well. No additional fee for work described in this Sub-Section is anticipated. 2. The work related to data collection for the extension of the storm drain along Terminal from Zwolle to Deen is considered additional services to be performed under the provisions of this Scope of Services and fee. b. This scope of services does not anticipate the relocation of water mains and/or services. City of Fort Worth,Texas Attachment A PMO Release Date:06✓21/2010 Page 9 of 31 2.2 Drainage Computations a. It is understood this Sub-Section expands and/or clarifies the provisions given in PHASE 1 — CONCEPTUAL DESIGN (30%); Par. 1(a) & 1(b) of Contract Amendment #1. 1. The drainage area maps and related hydraulic computations for Beaumont and Zwolle Street were completed under the provisions of the Contract Amendment#1. It is assumed this work complies (or will apply) with the requirements of this Scope of Services as well. No additional fee for work described in this Sub-Section is anticipated. 2. The work which is related to the extension of the Storm Drain along Terminal to Deen is considered additional services to be performed under the provisions of this Scope of Services and fee. 2.3 Subsurface Utility Engineering a. A SUE Level B was performed for the work related to Beaumont and Zwolle in accordance with the provisions of Contract Amendment #1. It is understood that the provisions of Contract Amendment#1 did not include a SUE report, SUE Plans, or signature and seal of a Professional Engineer Licensed in the State of Texas on the SUE Plans. It is assumed the SUE, SUE Report, SUE Plans, and Texas PE signatures and seal will be provided for the project under the provisions of this Sub-Section of the Scope of Services. The work (for Beaumont and Zwolle Street) related to the Plans, Report, and obtaining the Texas PE signature is considered additional services to be performed under the provisions of this Scope of Services and Fee. b. The SUE, SUE Plan, SUE Report, Signatures and Seals, related to the extension of the Strom Drain from Zwolle to Terminal is considered additional services to be performed under the provisions of this Scope of Services and Fees. 2.4 The Conceptual Design Package shall include the following: a. For this Scope of Services it is assumed a written summary of the alternative designs was submitted in accordance with the original contract. No new alternatives were considered under provisions of Contract Amendment #1 or those of this Scope. b. The Cover Sheet is considered incidental to both the provisions of Contract Amendment #1 and the Scope of Services described herein. No additional fee is anticipated for this work. c. The drainage area map and supporting drainage calculations were incorporated into the 60% Design Plan Submittal. City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 10 of 31 1. The work for Beaumont& Zwolle Street was submitted as required under the provisions of Contract Amendment #1. It is understood this drainage area map and corresponding computation complies with the provisions of this Scope of Services requiring no additional Fee. 2. It is assumed this Scope of Services will require a revision to the Drainage Area Map and related computations related to the extension of the Storm Drain along Terminal Road. This work is considered to be additional services to be performed under the provisions of this Scope of Services and fee. d. The preparation of SUE report, SUE Plans, or signature and seal of a Professional Engineer Licensed in the State of Texas is considered as additional services to be performed under the provisions of this Scope of Services and fee. e. With the exception of the work related to the extension of the storm drain along Terminal Road, the work related to Horizontal alignment (excluding profiles) of proposed storm water improvements, including existing lot layout, streets, street right-of-way, proposed easements, and existing utilities gathered during the SUE within the project limits is considered incidental to both the Contract Amendment#1 and this Scope of Services. However, the work related to the storm drain extension is additional services to be performed under the provisions of this Scope of Services and fee. f. Relocation of water mains and/or water services is not anticipated in this Scope of Services. g. Documentation of key decisions (Project Decision Log) is considered incidental to the provisions of this Scope of Services. No additional fee is anticipated. h. Estimates of Probable Cost were submitted as part of 30% plan submittal. This work was completed in accordance with the provisions of this Scope of Services and was not included in Contract Amendment #1. The work is considered as additional services to be performed under the provisions of this Scope of Services and Fee. • All storm water calculations and design shall conform to the City of Fort Worth Storm Water Management Design Manual, March 2006. • The SUE and SUE plan sheets shall be in accordance with Cl/ASCE 38-02. • Eight (8) copies of the conceptual design package will be delivered. Drawings will be half size (11"x 1 n. • The 30% Conceptual Plans were completed under the provisions of Contract Amendment #1. In accordance with its provisions, no DW F files were created nor were they uploaded to the designated project folder in Buzzsaw. Should the City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 11 of 31 CITY require the 30% plans to be uploaded to Buzzsaw, it shall be considered as additional work. • ENGINEER shall not proceed with Preliminary Design activities without approval by the CITY of the Conceptual Design Package. DELIVERABLES A. The Conceptual Design Package for the work related to Beaumont & Zwolle Street was submitted to the CITY for a formal review in accordance with the provisions of Contract Amendment#1 and complied with this Scope of Work. This Scope does not anticipate a separate 30% Plan Submittal for the work related to the extension of the storm drain along Terminal Road. TASK 3. PRELIMINARY DESIGN (60 PERCENT). Preliminary plans shall be submitted to CITY per the approved Project Schedule. ENGINEER will develop the preliminary design of the infrastructure as follows: 3.1. Development of Preliminary Design Drawings shall include the following: • Cover Sheet • Drainage area maps showing proposed improvements with drainage calculations and hydraulic computations in accordance with the City of Fort Worth Storm Water Management Design Manual, March 2006. • A Project Control Sheet, showing all Control Points, used or set while gathering data. Generally on a scale of not less than 1:400. The following information shall be indicated for each Control Point: Identified (existing City Monument#8901, PK Nail, 5/9' Iron Rod); X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on City Datum only; descriptive location (i.e. set in the centerline of the inlet in the South curb line of North Side Drive at the East end of radius at the Southeast corner of North Side Drive and North Main Street). • Overall project easement layout sheet(s). • SUE plan drawings. • Plan and profile drawings of proposed storm water improvements, including existing lot layout with property ownership, streets, curb lines, driveways, medians (if applicable), sidewalks, existing and proposed water and sanitary sewer mains, existing utilities gathered during the SUE and existing utility easements within the project limits. • No less than two bench marks per plan/profile sheet. • The ENGINEER will prepare standard and special detail sheets that are not already included in the City's standard details. These may include connection details between various parts of the project, tunneling details, boring and jacking details, waterline relocations, details unique to the construction of the project, trenchless details, and special service lateral reconnections. City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 12 of 31 • Prepare separate drawings for water and/or sanitary sewer mains including a overall water and/or sanitary sewer layout sheet and plan and profile drawings. • Overall project water and/or sanitary sewer layout sheets. The water layout sheet shall identify the proposed water main improvement/existing water mains in the vicinity and all water appurtenances along with pressure plane boundaries, water tanks, pump stations, valves, and fire hydrants. The sewer layout sheet shall identify the proposed sewer main improvement/existing sewer mains and all sewer appurtenances in the vicinity. • Plan and profile sheets which show the following: proposed water and/or sanitary sewer plan/profile and recommended pipe size, fire hydrants, water service lines and meter boxes, gate valves, isolation valves, manholes, existing meter numbers and sizes that are to be replaced, existing sample locations, existing fire line locations, existing utilities and utility easements, and all pertinent information needed to construct the project. Legal description (Lot Nos., Block Nos., and Addition Names) along with property ownership shall be provided on the plan view. • The ENGINEER shall make provisions for reconnecting all identifiable water and/or wastewater service lines which connect directly to any main being replaced, including replacement of existing service lines within City right-of-way or utility easement.When the existing alignment of a water and sanitary sewer main or lateral is changed, provisions will be made in the final plans and/or specifications by the ENGINEER to relocate all service lines which are connected to the existing main and connect said service lines to the relocated main. • The following shall be applicable at all locations where it is necessary to relocate or reroute the existing private sanitary sewer service line due to the abandonment or realignment of the existing public sanitary sewer lateral or main: The CITY shall furnish the ENGINEER with a sample format of how the sewer service line reroute/relocation should be designed and submitted for construction. During design survey, if a rod can be inserted through the cleanout to the bottom of the service line, the ENGINEER will obtain the flow line elevation and design the service line prior to advertising the project for bid. If the service flow line information cannot be obtained during design survey, the ENGINEER shall delay the design of the sewer service line until after a Quality Level A Subsurface Utility Engineering (SUE investigation has been performed). The Level A SUE will be performed; (1) by the ENGINEER if included in the fee proposal; or (2) by the CITY prior to bidding if the CITY determines that it is needed for satisfactory completion of the design; or (3) by the Contractor after the project has been bid, by means of a bid item to that effect. In all options, the ENGINEER shall propose appropriate de- hole locations in the project and collect flow line elevation and other applicable information of the sewer service line. The ENGINEER shall use this information to provide the design for the sanitary sewer service line to be rerouted or relocated. • Station equations relating utilities to paving, when appropriate. • Proposed roadway profile grades and elevations along each curb line; elevations at all P.V.I.'s; P.I's half stations; high and low points; vertical curve information; and pertinent AASHTO calculations. Profiles for existing curbs (if any) and existing ground at the left and right of right-of-way lines shall be shown. Existing found property corners (e.g. Iron pins) along the existing right-of-way shall be shown on City of Fort Worth,Texas Attachment A PMO Release Date:0 6/2 1120 1 0 Page 13 of 31 the plans. Profiles for existing and proposed storm drain mains and laterals shall be provided. • Channel plan and profile drawings shall include existing channel centerline, existing left and right top of channel bank, proposed top of channel backs, and 100 year water surface profile. • Preliminary roadway and/or channel cross-sections will be developed, from the survey notes, at intervals not-to-exceed 50 foot along the project length and will extend 10 foot past the right of way line on both sides of the street. Additional cross-sections at important features including driveways, P.I.'s of intersecting streets, (minimum distance of 100 foot along cross-street at each P.1.) walks, retaining walls, etc., will also be provided. Profiles of centerline of driveways will also be provided where necessary. Scale will be 1" =20' horizontal and 1" =2' vertical. Excavation and embankment volumes and end area computations shall also be provided. 3.2. Geotechnical Investigation/Pavement Design • Soil investigations, including field and laboratory tests, borings, related engineering analysis and recommendations for determining soil conditions will be made. In addition to the above investigations, borings and appropriate field and laboratory analysis will be made at reasonable intervals along the project alignment for the Contractor's use in determining soil conditions for preparing bids and a Trench Safety Plan. • The ENGINEER shall prepare a detailed geotechnical engineering study and pavement design in conformance with the City, of Fort Worth Pavement Design Standards Manual, 2005. The study shall include recommendations regarding utility trenching and identifying existing groundwater elevation at each boring. 3.3 Constructability Review • Prior to the 60 percent review meeting with the CITY, the ENGINEER shall schedule and attend a project site visit with the CITY Project Manager and Construction personnel to walk the project. The ENGINEER shall summarize the CITY's comments from the field visit and submit this information to the CITY in writing. 3.4 Public Meeting • After the preliminary plans have been reviewed and approved by the CITY, the ENGINEER shall prepare project exhibits, and attend public meeting to help explain the proposed project to residents. The CITY shall select a suitable location and mail the invitation letters to the affected customers. The ENGINEER shall coordinate with CITY GIS staff to identify affected property owners/residents and develop a spreadsheet listing addresses of those to invite to the public meeting. 3.5 Utility Clearance • The ENGINEER will consult with the CITY's Transportation and Public Works Department, Water Department, and other CITY departments, public utilities, City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 14 of 31 private utilities, and government agencies to determine the approximate location of above and underground utilities, and other facilities (current and future)that have an impact or influence on the project. ENGINEER will design CITY facilities to avoid or minimize conflicts with existing utilities, and where known and possible consider potential future utilities in designs. • The ENGINEER shall deliver approved preliminary construction plans to the CITY's Utility Coordinator as well as upload a DWF preliminary plan set to the designated project folder in Buzzsaw for forwarding to all utility companies which have facilities within the limits of the project. 3.6 Traffic Control Plan • Develop a traffic control plan utilizing standard traffic reroute configurations posted as "Typicals" on the CITY's Buzzsaw website. The typicals need not be sealed individually, if included in the sealed contract documents. • Develop supplemental traffic control drawings as needed for review and approval by the Traffic Division of the Transportation and Public Works Department. These drawings shall be sealed by a professional engineer registered in the State of Texas. ASSUMPTIONS • The following is intended to clarify and/or expand upon the work necessary to complete TASK 3 — PRELIMINARY DESIGN (60 PERCENT) as described above: 3.1 Preliminary Design Drawings a. The work related to the Cover Sheet is considered incidental to the provisions of Contract Amendment#1 as well as this Scope of Services. No additional fee is anticipated. b. The Drainage Area Maps and hydraulic computations related to the work located in Beaumont and Zwolle is considered incidental to the provisions of Contract Amendment#1 as well as this Scope. A revision of the drainage area maps and computations necessary to complete the extension of the storm drain along Terminal is considered additional work performed under the provisions of this Scope and fee. c. The work related to the project control sheet described above is considered incidental to the provisions of Contract Amendment#1 as well as this Scope. The revisions to the project control sheet related to the extension of the storm drain along Terminal are considered as additional work performed under the provisions of this Scope and fee. d. No acquisition of real property and/or easements is anticipated for the work in Beaumont, Zwolle, or Terminal. However, temporary access and construction easements will be required. An overall project easement layout sheet will be provided under the provisions of Contract Amendment #1 and this Scope of Services. The work performed under City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 15 of 31 this Sub-Section is considered incidental to the work considered for this project. No additional fee is anticipated under the provisions of this Scope. e. It is assumed the SUE Plan Drawings will/have been provided under the provisions of Section 2.3 (with exceptions described in the Assumptions of Section 2.0) of this Scope of Services. f. It is understood 60% design plans were completed in accordance with the provisions of Contract Amendment #1 and this Scope. This work included the plan and profile drawings (as described above)for the improvements located in Beaumont and Zwolle Streets. No additional services or fee is anticipated for this original work. Plan and profile drawings for the extension of the work located in Terminal will be completed in accordance provisions of this Scope of Services and Fee. g. For the purposes of this Scope, it is assumed a maximum of five (5) bench marks will be provided and shown on the Geometric layout and control sheet. This work is considered incidental to the provisions of Contract Amendment #1 and this Scope of Services. h. The standard and special details prepared for the work related to Beaumont and Zwolle Street is considered to be in accordance with Contract Amendment #1 as well as the provisions of this Scope of Services. Special details are anticipated for the work related the extension of the storm drain along Terminal to Deen and are considered additional work to be completed in accordance with the provisions of this Scope and Fee. i. This Scope of Services does not anticipate the relocation of sanitary sewer and/or water mains or services. Should they be required, it shall be considered as additional services. j. Station Equations are/have been provided in accordance with the provisions of Contract Amendment #1 as well as the provisions of this scope of services. No additional fee is anticipated for this work. k. The proposed profile grades and elevations related to the work in Beaumont and Zwolle as described above were/are being provided under the provisions of Contract Amendment #1 and this Scope. No additional fee is anticipated for the original work. However, the work necessary for the extension of the storm drain in Terminal is considered as additional work to be completed under the provisions of this Scope and Fee. I. This Scope of Services does not anticipate improvements to the existing channel, other that the necessary reconstruction of the existing headwalls and concrete apron. Preliminary roadway and channel cross sections were submitted with the 60% design plans accordance with the provisions described in this scope of services. Contract Amendment #1 did not include this work, therefore, all work associated with the cross sections is considered additional work and is/or will be completed in accordance with the provisions of this Scope and Fee. n. Documentation of key decisions (Project Decision Log) is considered incidental to the provisions of this Scope of Services o. Estimates of Probable Cost were submitted as part of 60% plan submittal. This work was completed in accordance with the provisions Contract Amendment #1 and this Scope of Services and is considered incidental to the provisions of this Scope of Services. 3.2 Geotechnical Investigation/Pavement Design a. It is understood the Geotechnical Investigation/Pavement Design has been completed under the provisions of Contract Amendment#1 and this Scope of Services. b. It is assumed no new, or additional, Geotech Investigation/Pavement Design is anticipated for the extension of the storm drain along Terminal. No new, or additional, fees are anticipated under the provisions of this Scope of Services. 3.3 Constructability Review a. A constructability review meeting and site walk through was scheduled and concluded after the 60% review meeting. This walk through and site visit was concluded in accordance with the provisions described in this Scope of Services. Contract Amendment#1 did not include this work, therefore, all work associated with it is considered additional work and is completed in accordance with the provisions of this scope and fee. 3.4 Public Meeting a. A public meeting will we conducted after the 90% review committee review. The work shall be completed in accordance with the Scope of Services and Fee as described above. It is understood, Contract Amendment #1 did not include this work, therefore, all work associated with this public meeting is considered additional work. 3.5 Utility Clearance a. It is understood that this Sub-Section clarifies, revises, and enhances the description of work described in Contract Amendment #1, Phase I1, Section 3. No new, or additional, fee is anticipated under the provisions of this Scope of Services. City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 17 of 31 3.6 Traffic Control Plan a. It is understood that the Traffic Control Plans related to the work located in Beaumont and Zwolle Street will be prepared in accordance with Contract Amendment #1, as well as provisions of this Scope of Services. No new or additional fees are anticipated for this original work. b. The work related to the Traffic Control Plan for the extension of the storm drain located in Terminal from Zwolle to Deen are considered additional services and will be completed under the provisions of this Scope and Fee. • It is understood 60% design plans were submitted and reviewed by the CITY. It is assumed the design plans related to the extension of the storm drain along Terminal will be submitted either at, or immediately after, the 90% design plan submittal as described in Section 4.0 of this Scope. • All storm water calculations and design shall conform to the City of Fort Worth Storm Water Management Design Manual, March 2006. • Four (4) borings at an average bore depth of 15 feet each will be provided. • Traffic Control "Typicals"will be utilized to the extent possible. It is assumed an additional six (6) project specific traffic control sheets will be developed. • Four (4) copies of the geotechnical report will be delivered to the CITY with 90% design plans. • Ten (10) half-sized plans will be delivered for Utility Clearance. • Ten (10) half-sized plans will be delivered for Constructability Review. • Ten (9) half-sized drawings will be delivered for Preliminary Design. • The 60% Preliminary Plans were completed and submitted under the provisions of Contract Amendment #1. In accordance with its provisions, no DWF files were created, nor were they uploaded to the designated project folder in Buzzsaw. Should the CITY require the 60% plans to be uploaded to Buzzsaw, it shall be considered as additional work. • ENGINEER shall not proceed with Final Design activities without written approval by the CITY of the Preliminary Design plans. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100 PERCENT). Upon approval of the Preliminary plans, ENGINEER will prepare construction plans as follows: • Final draft construction plans and specifications shall be submitted to CITY per the approved Project Schedule. • The ENGINEER shall submit a final design estimate of probable construction cost with the final design plans submitted. This estimate shall use ONLY standard CITY bid items. • Following a 90%construction plan review meeting with the CITY, the ENGINEER shall submit Final Plans (100%) to the CITY per the approved Project Schedule. Each plan sheet shall be stamped, dated, and signed by the ENGINEER registered in State of Texas. ASSUMPTIONS • The following is intended to clarify and/or expand upon the work necessary to complete TASK 4— FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100 PERCENT) as described above: 4.1 Final Design Drawings a. It is understood the Final Design Plans related to the work located in Beaumont and Zwolle Street will be prepared in accordance with Contract Amendment #1, as well as the provisions of this Scope. No new or additional fee is anticipated for this original work. b. The work related to the Final Design Plans Plan for the extension of the storm drain located in Terminal from Zwolle to Deen is considered additional services and will be completed under the provisions of this Scope and Fee. 4.2 Final Opinion of Probable Cost a. It is understood that this Sub-Section relating to the final opinion of probable cost clarifies, revises, and enhances the description of work described in Contract Amendment #1. No new, or additional, fees are anticipated under the provisions of this Scope. 4.3 Final Construction Documents (100%) a. It is understood that the Final Construction Documents related to the work located in Beaumont and Zwolle Street will be prepared in accordance with Contract Amendment #1, as well as provisions of this City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 19 of 31 Scope of Services. No new or additional fee is anticipated for this original work. b. The work related to the Final Construction Documents for the extension of the storm drain located in Terminal from Zwolle to Deen is, however, considered additional work as described in this Scope of Services. • All storm water calculations and design shall conform to the City of Fort Worth Storm Water Management Design Manual, March 2006. • Eight (8) half size (11"x17") and One (1) full size (22"x34") drawings and eight (8) sets of specifications will be delivered for the 90%design. • A DW F file for the 90% Design will be created from design CAD drawings and will be uploaded to the project folder in Buzzsaw. • Eight (8) half-sized (11"x17") and one (1) full size (11"x17") drawings and Eight (8) sets of specifications will be delivered for the 100% design. • A DW F file for the 100% Design will be created from design CAD drawings and will be uploaded to the project folder in Buzzsaw. DELIVERABLES A. 90% construction plans specifications. B. 100% construction plans and specifications. C. Documentation of key design decisions (Project Decision Log). D. Detailed estimates of probable construction cost for the authorized construction project, including summaries of bid items and quantities using the CITY's standard bid items and format. E. Original cover mylar for the signatures of authorized CITY officials. TASK 5. BID PHASE SERVICES. ENGINEER will support the bid phase of the project as follows. 5.1. Bid Support • The ENGINEER shall upload all plans and contract documents onto Buzzsaw for access to potential bidders. • Contract documents shall be uploaded in an .xIs file. • Unit Price Proposal documents are to be created utilizing CFW Bidtools only and combined in a specified spreadsheet workbook, Bid Proposal Worksheet Template, and will be populated and configured so that all pages are complete and the Summary Worksheet(s) in the workbook detail and automatically summarize the totals from the inserted Unit Price Proposal document worksheets. • Plan Sets are to be uploaded to Buzzsaw in two formats, .pdf and .dwf files. The .pdf will consist of one file of the entire plan set. The .dwf will consist of City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 20 of 31 individual files, one for each plan sheet, and will be numbered and named in a manner similar to that of the plan set index. • The ENGINEER shall sell contract documents and maintain a plan holders list on Buzzsaw from documents sold and from Contractor's uploaded Plan Holder Registrations in Buzzsaw. • The ENGINEER will develop and implement procedures for receiving and answering bidders' questions and requests for additional information. The procedures shall include a log of all significant bidders questions and requests and the response thereto. The log shall be housed and maintained in the project's Buzzsaw folder titled Request for Information. The ENGINEER will provide technical interpretation of the contract bid documents and will prepare proposed responses to all bidders questions and requests, in the form of addenda. The ENGINEER shall upload all approved addenda onto Buzzsaw and mail addenda to all plan holders. • Attend the prebid conference in support of the CITY. • Assist the CITY in determining the qualifications and acceptability of prospective contractors, subcontractors, and suppliers. • When substitution prior to award of contracts is allowed in the contract documents, the ENGINEER will advise the CITY as to the acceptability of alternate materials and equipment proposed by bidders. • Attend the bid opening in support of the CITY. • Tabulate and review all bids received for the construction project, assist the CITY in evaluating bids, and recommend award of the contract. A copy of the Bid Tabulation is to be uploaded into the project's Bid Responses folder on Buzzsaw.[delete task if Bid Tabulation to be done by CITY] • Assist the CITY with assembling and awarding contracts for construction, materials, equipment, and services. • Incorporate all addenda into the contract documents and issue conformed sets. 5.2 Mylar Drawings • The ENGINEER shall submit a set of sealed conformed mylar drawings for record storage. • Record Drawings shall also be submitted as an Adobe Acrobat PDF format (version 6.0 or higher) file and DWF format. There shall be one (1) PDF file and one (1) DWF file for the TPW plan set and a separate PDF and DWF file for the Water plan set. Each PDF and DWF file shall contain all associated sheets of the particular plan set. Singular PDF and DWF files for each sheet of a plan set will not be accepted. PDF and DWF files shall conform to naming conventions as follows: I. TPW file name example — "W-1956_org47.pdf" where "W-1956" is the assigned file number obtained from the CITY, "—org" designating the file is of an original plan set, "47" shall be the total number of sheets in this file. For information on the proper manner to submit files and to obtain a file number for the project, contact the Department of Transportation and Public Works Vault at telephone number (817) 392-8426. File numbers will not be issued to a project unless the appropriate project numbers and fund codes have been assigned and are in the Department of Transportation and Public Works database. ASSUMPTIONS • The following is intended to clarify and/or expand upon the work necessary to complete TASK 5— BID PHASE SERVICES as described above: 5.1 Bid Support a. The work associated with the uploading of the contract documents will be completed in accordance with this Scope of Services. This work is considered additional work and was not contemplated under the provisions of Contract Amendment#1. b. The work associated with the distribution of the plans, maintenance of the plan holders list will be will be completed in accordance with this Scope of Services. This work is considered additional work and was not contemplated under the provisions of Contract Amendment#1. c. It is understood that the receipt of bidder's questions and issuing response thereto, is contemplated under the provisions of Contract Amendment #1 and has been expanded upon and clarified in this Scope. No additional fee is anticipated for this work. d. It is understood the attendance of the ENGINEER at a pre-bid conference is contemplated under the provisions of Contract Amendment #1 and has been expanded upon and clarified in this Scope of Services. No additional fee is anticipated for this work. e. It is understood that the assistance in determining the qualifications and acceptability of the prospective contractors, sub-contractors, and suppliers is contemplated under the provisions of Contract City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 22 of 31 Amendment #1 and has been expanded upon and clarified in this Scope of Services. No additional fee is anticipated for this work. f. It is understood the ENGINEER will attend the bid opening in support of the CITY. This work is considered incidental to the Contract Amendment #1 and this Scope of Services. No additional fee is anticipated for this work. g. Evaluation of the bids, preparation of the Bid Tabulation, and recommendations, were contemplated under the provisions of Contract Amendment #1 and has been expanded upon and clarified in this Scope of Services. No additional fee is anticipated for this work. h. The assistance to the City in the assembling and awarding the contract documents was not contemplated in Contract Amendment #1. This work is considered additional services and will be completed under the provisions of this Scope of Services. i. The incorporation of addenda into a conformed set of contract documents is considered incidental to the work described in this sections. No new and/or additional fees are anticipated for this work. 5.2 Mylar Drawings a. It is assumed record drawings will be provided for this project. No work under this Section is anticipated. • The project will be bid only once and awarded to one contractor. • Twenty (20) sets of conformed plans and specifications will be delivered to the CITY and made available on Buzzsaw. The twenty (20) sets of plans shall consist of Ten (10) full size (22"x34") and Ten (10) half size (11"x17") drawings. • PDF and DWF files will be uploaded to Buzzsaw. DELIVERABLES A. Addenda B. Bid tabulations C. Recommendation of award D. Conformed construction documents TASK 6. CONSTRUCTION PHASE SERVICES. ENGINEER will support the construction phase of the project as follows. 6.1 Construction Support • The ENGINEER shall attend the preconstruction conference. • After the pre-construction conference, the ENGINEER shall provide project exhibits and attend public meeting to help explain the proposed project to City of Fort Worth,Texas Attachment A PMO Release Date:06/21/2010 Page 23 of 31 residents. The CITY shall select a suitable location and mail the invitation letters to the affected customers. • The ENGINEER shall visit the project site at requested intervals as construction proceeds to observe and report on progress. • The ENGINEER shall review shop drawings, samples and other submittals submitted by the contractor for general conformance with the design concepts and general compliance with the requirements of the contract for construction. Such review shall not relieve the Contractor from its responsibility for performance in accordance with the contract for construction, nor is such review a guarantee that the work covered by the shop drawings, samples and submittals is free of errors, inconsistencies or omissions. The ENGINEER shall log and track all shop drawings, samples and other submittals in Buzzsaw. • As requested by the CITY, the ENGINEER shall provide necessary interpretations and clarifications of contract documents, review change orders, and make recommendations as to the acceptability of the work. • The ENGINEER shall attend the"Final" project walk through and assist with preparation of final punch list. 6.2 Record Drawings • The ENGINEER shall prepare record drawings from information submitted by the inspector and/or Contractor. The drawings shall be submitted as full size (22"x 34") mylar drawings. • Record Drawings shall also be submitted as an Adobe Acrobat PDF format (version 6.0 or higher) file and DWF format. There shall be one (1) PDF file and one (1) DWF file for the TPW plan set and a separate PDF and DWF file for the Water plan set. Each PDF and DWF file shall contain all associated sheets of the particular plan set. Singular PDF and DWF files for each sheet of a plan set will not be accepted. PDF and DWF files shall conform to naming conventions as follows: I. TPW file name example — "W-1956—org47.pdf" where "W-1956" is the assigned file number obtained from the CITY, "—org" designating the file is of an original plan set, "47" shall be the total number of sheets in this file. Example: W-0053—org3.pdf and K-0320—org5.pdf II. Water and Sewer file name example — "X-35667_org36.pdf" where "X- 35667" is the assigned file number obtained from the CITY, "_org" designating the file is of an original plan set, "36" shall be the total number of sheets in this file. ASSUMPTIONS • The following is intended to clarify and/or expand upon the work necessary to complete TASK 6 — CONSTRUCTION PHASE SERVICES as described above: 6.1 Construction Support Services a. It is understood the ENGINEER will attend the pre-construction conferences in accordance with the provisions of both the Contract Amendment #1 and this Scope of Service. No additional and/or new fee is anticipated. b. The work associated with the Public Hearing as described above was not contemplated in Contract Amendment #1. This work is considered additional services and will be completed under the provisions of this Scope of Services. c. The ENGINEER will visit the Site at requested intervals. This Scope of Services assumes a one (1) visit per month during the period of construction and two site visits are assumed to occur as needed for a total of 8 visits. Each Site visit will include the PROJECT MANAGER and/or his designate. d. The review and recommendation for shop drawings, samples, and/or other submittals was not contemplated in the Contract Amendment #1. This work is considered additional services and will be completed under the provisions of this Scope of Services. Section 6.1(d) assumes a maximum of 4 hours for the Project Manager, 8 hours for the Project Engineer, and 4 hours for the EIT. e. It is understood the review and response to a "Request for Information" (RFI) includes necessary interpretation and clarification of the contract documents, the review of Change Orders, and the recommendation as to the acceptability of the work. This work was contemplated in Contract Amendment#1 and is expanded upon and clarified in this Scope of Service. For this work, a maximum of 30 additional hours (10 hours for the Project Manager and/or Project Engineer and 20 hours for an EIT) is assumed to meet the requirements of this Scope. f. It is understood the ENGINEER will attend one (1) final walk though and will assist with the preparation of the final punch list. This walk through is in accordance with the provisions of both the Contract Amendment #1 and this Scope of Service. ENGINEER will support and perform activities related to ROW and easements as outlined below, per scoping direction and guidance from the CITY's Project Manager 7.1. Right-of-Way Research • The ENGINEER shall determine rights-of-way and easement needs for construction of the project. Required temporary and permanent easements will be identified based on available information and recommendations will be made for approval by the CITY. 7.2 Right-of-Way/Easement Preparation and Submittal. • The ENGINEER shall prepare documents to be used to obtain right-of-way and permanent and/or temporary easements required to construct the improvements. • The documentation shall be provided in conformance with the checklists and templates available on the CITY's Buzzsaw site. 7.3 Temporary Right of Entry Preparation and Submittal • Prior to construction, the ENGINEER shall prepare, mail and obtain Temporary Right of Entries from landowners. It is assumed that letters will only be required for land owners adjacent to temporary construction easements or who are directly affected by the project and no easement is required to enter their property. • The documentation shall be provided in conformance with the checklists and templates available on the CITY's Buzzsaw site. ASSUMPTIONS • Right-of-Way research includes review of property/right-of-way records based on current internet based Tarrant Appraisal District (TAD) information available at the start of the project and available on-ground property information (i.e. iron rods, fences, stakes, etc.). It does not include effort for chain of title research, parent track research, additional research for easements not included in the City of Fort Worth,Texas Attachment A PMO Release Date.06/21/2010 Page 26 of 31 TAD, right-of-way takings, easement vacations and abandonments, right-of-way vacations, and street closures. • No acquisition of real property is anticipated for this project. • It is assumed temporary access and construction easements will be necessary for the completion of the project. This Scope of Services assumes a maximum of five (5) temporary access easements and five (5) temporary construction easements. This work is considered as additional work under the provisions of this Scope of Services. It is noted that the issue of ROW acquisition was not contemplated in the Contract Amendment #1. DELIVERABLES A. Temporary Construction easement exhibits and documents will be prepared in accordance with applicable City ordinances. B. Temporary Right of Entry Letters TASK 8. SURVEY. ENGINEER will provide survey support as follows. 8.1 Design Survey • ENGINEER will perform field surveys to collect horizontal and vertical elevations and other information needed by ENGINEER in design and preparation of plans for the project. Information gathered during the survey shall include topographic data, utilities as required by the SUE, structures, trees (measure caliper, identify overall canopy, and have qualified arborist identify species of trees), and other features relevant to the final plan sheets. Existing drainage at intersections will be verified by field surveys. Spot elevations will be shown on intersection layouts with cross slope to fit intersecting grade lines. • The minimum survey information to be provided on the plans shall include the following: — A Project Control Sheet, showing ALL Control Points, used or set while gathering data. Generally on a scale of not less than 1:400: — The following information about each Control Point; a. Identified (Existing. CITY Monument#8901, PK Nail, 5/8" Iron Rod) b. X, Y and Z Coordinates, in an identified coordinate system, and a referred bearing base. Z coordinate on CITY Datum only. c. Descriptive Location (Ex. Set in the centerline of the inlet in the South curb line of North Side Drive at the East end of radius at the Southeast corner of North Side Drive and North Main Street). 8.2. Temporary Right of Entry Preparation and Submittal • Prior to entering property for field survey, the ENGINEER shall prepare mail and obtain Temporary Right of Entry from landowners. Construction Survey • Be available to the CITY on matters concerning the layout of the project during its construction ASSUMPTIONS • This Scope of Services assumes the construction staking will be completed by the City. DELIVERABLES A. Copies of field survey data and notes signed and sealed by a licensed surveyor. B. Drawing of the project layout with dimensions and coordinate list. TASK 9. PERMITTING. ENGINEER will provide permitting support for the CITY to obtain any and all agreements and/or permits normally required for a project of this size and type, as follows 9.1. Storm Water Pollution Prevention Plan • For projects that disturb an area greater than one (1) acre, ENGINEER will prepare the Storm Water Pollution Prevention Plan (SWPPP) required for the Project for use by the Contractor during construction. ENGINEER will prepare drawings and details for proposed SWPPP improvement that the Contractor must use during construction. Contractor will be responsible for filing the SWPPP with appropriate regulatory agencies. 9.2. Environmental Services • Negotiating and coordinating to obtain approval of the agency issuing the agreement and/or permits • Completing all forms/applications necessary • Submitting forms/applications for CITY review • Submitting revised forms for agency review • Responding to agency comments and request 9.3. Texas Department of Licensing and Regulation (TDLR) • Identify and analyze the requirements of the Texas Architectural Barriers Act, Chapter 68 Texas Administrative Code, and become familiar with the governmental authorities having jurisdiction to approve the design of the Project. • Submit construction documents to the TDLR • Completing all TDLR forms/applications necessary • Obtain the Notice of Substantial Compliance from the TDLR • Request an inspection from TDLR or a TDLR locally approved Registered Accessibility Specialist no later than 30 calendar days after construction substantial completion. Advise the CITY in writing of the results of the inspection. • Responding to agency comments and requests ASSUMPTIONS • The following is intended to clarify and/or expand upon the work necessary to complete TASK 9 — PERMITTING as described above: 9.1 Storm Water Pollution Prevention Plan a. The work associated with the Storm Water Pollution Prevention Plan was contemplated in Contract Amendment #1 and is expanded and clarified in this Scope of Services. This work is incorporated into this Scope of Services and fees. b. It is understood Contract Amendment#1 included the work related to the SWPPP for the construction of improvements for Beaumont and Zwolle Street. The work related to the extension of the storm drain along Terminal to Deen is considered additional services and is included in this Scope and Fee. 9.2 Environmental Services a. No environmental permitting (i.e. USACE Section 404 Permitirng) is anticipated for this work. Should they be required, it shall be considered as additional work. 9.3 Flood Plain Services a. It is understood the outlet structure for the project is located in a federally designated floodplain with a floodway. However, an application for a Conditional Letter of Map Revision (CLOMR) nor an application for a Letter of Map Revision (LOMR) to the Federal Emergency Management Agency is anticipated for this project. Should either, or both, be required it shall be considered as additional work. b. This Scope of Services anticipates a Flood Plain Fill Permit will be required. This work will include an analysis of the existing and post construction structure to determine the impact on the Base Flood Elevation (i.e. BFE). The analysis will be general in nature and is intended to demonstrate a "no-rise" in the BFE. This work will also include a maximum of two (2) meetings with the CITY and the submittal of the Fill Permit Application in accordance with applicable CITY Ordinances. The work described herein was not contemplated in Contract Amendment #1 and is considered as additional work. 9.4 Texas Department of Transportation (TxDOT) a. No TxDoT permits are anticipated for this scope of services. 9.5 Railroad Permit a. No Railroad permits are anticipated for this scope of services. DELIVERABLES A. SWPPP Report and LOI. B. However, ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. These additional services include the following: • Negotiation of easements or property acquisition. • Services related to development of the CITY's project financing and/or budget. • Services related to disputes over pre-qualification, bid protests, bid rejection and re-bidding of the contract for construction. • Construction management and inspection services • Performance of materials testing or specialty testing services. • Services necessary due to the default of the Contractor. • Services related to damages caused by fire, flood, earthquake or other acts of God. • Services related to warranty claims, enforcement and inspection after final completion. • Services to support, prepare, document, bring, defend, or assist in litigation undertaken or defended by the CITY. • Performance of miscellaneous and supplemental services related to the project as requested by the CITY. Compensation A. The ENGINEER shall be compensated a total lump sum fee of $ 79,881.00 as summarized in Exhibit B-1 — Engineer Invoice and Section IV—Summary of Total Project Fees. The total lump sum fee shall be considered full compensation for the services described in Attachment A, including all labor materials, supplies, and equipment necessary to deliver the services. B. The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. II. Method of Payment A. DISCUSSION: The Storm Water Management Program was established to reduce flooding in Fort Worth,preserve streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements.This will be accomplished by infrastructure reconstruction and system maintenance,master planning,enhanced development review and increased public education and outreach. On May 15,2007,(Ordinance No. 17543-05-2007)the City Council approved the transfer of$575,000.00 from the Storm Water Fund to the Storm Water Capital Projects Fund for design consultant contracts under $259000.00. A Request for Qualifications(RFQ)to provide drainage design was issued by the City in January 2006 and 24 design consultants submitted statements of qualifications,including HDR Engineering,Inc. HDR Engineering,Inc.,was selected to study the drainage in the subject area and provide design services for drainage improvements for the Terminal—Deen Storm Drain Extensions project(City Project No.00658.) On April 16, 2007,the City Manager executed administratively an engineering agreement with HDR Engineering,Inc.,in the amount of$23,800.00 to perform a conceptual drainage study to evaluate severe flooding conditions on Zwolle Street south of Terminal—Deen Road,caused by stormwater runoff. It was anticipated that the study project would be expanded to a design project.The study identified the need to upgrade the existing storm drain system and inlets along Zwolle Street and Beaumont Street. On October 16,2007,(Ordinance No. 17840-10-2007)City Council authorized the issuance and sale of $25,000,000 in revenue bonds in Storm Water Capital Project Revenue Bond 07 Fund,to fund a two year Storm Water Capital project program. On November, 11,2008,the City Council authorized the City Manager to execute Amendment No. 1 (M&C C-23178) an engineering agreement with HDR Engineering,Inc.,(City Secretary Contract No. 35202—A1) in the amount of$219,900.00 for the design of storm drain system along Zwolle Street and Beaumont Street. On September 22,2009, (Ordinance No. 18838-09-2009)the City Council approved the issuance and sale of$45,000,000.00 in revenue bonds for the Storm Water Capital Project Bond 2009 Fund to fund a two—year storm water capital project program. The need for additional engineering work has been identified.During design,it was determined that more properties were being impacted,requiring additional survey and design.Amendment No. 2 includes this work plus preparation of a Floodplain Development Permit,a Storm Water Pollution Prevention Plan (SWPPP),a Traffic Control Plan and Construction Phase Services. HDR Engineering,Inc.,proposes to perform the above services for a lump sum fee of$79,881.00.City staff considers the fee to be fair and reasonable for the scope of services proposed. HDR Engineering,Inc.,is in compliance with the City's MWWBE Ordinance by committing to 35 percent MWWBE participation.The City's goal on the project is 17 percent. This project is located in COUNCIL DISTRICT 2,Mapsco 49S.
