HomeMy WebLinkAboutOrdinance 7861 ORDINANCE NO. � AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 188, ROSEN HEIGHTS, ADJACENT TO LOTS 1, 2 AND 3, FROM ROCK ISLAND STREET SOUTHEAST TO LOT 26, BLOCK 3, MARINE HEIGHTS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley in Block 188, Rosen Heights Addition, adjacent to Lots 1, 2 and 3, varying in width from 24 feet to 29.3 feet and varying in length from 152 feet to 180.7 feet, the same beginning at the Southeast right-of-way line of Rock Island Street and extending southeast to Lot 26, Block 3, Marine Heights Addition, be and the same is hereby vacated, abandoned and permanently closed as a right-of-way for alley purposes. SECTION 2. That the fee to the land in the above described vacated alley right-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 3. That all ordinances cr parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. PAGE WILKES BROWN NUMBER 188, Lots 1-3; Marine Heights, Blk 3, REED 1 78 PZ-885 Lot 26 Rock Island St. @ N.W. 32nd St. lor �_ a Crites Builders, Inc. , owner df Lots 1-3, Block 188, Rosen Heights, with consent of Lucius Lavan, owner of Lot.;26, Block 3, Marine Heights, has requested that the City vacate the 24' to 29.3' wide alley in Block 188, Rosen Heights, adjacent to Lots 1, 2 and 3, a length 150' to 180.71 from Rock Island Street south to Lot 26, Block 3, Marine Heights, as shown on the attached map. The subject alley, acquired by dedication, is not open. Concerned City Depart- ments and private utility companies have reviewed this request. Texas Electric Service Co. has requested that a portion of the alley be retained as an easement for their existing facility. No other utility facilities are contained within the proposed vacation. A satisfactory replat has been submitted to City staff replatting vacated right- of-way with adjacent property. The City Plan Commission has reviewed this request and recommends that subject right-of-way is vacated as requested. Recommendation It is recommended that an ordinance be adopted facating the subject alley, as requested.
