HomeMy WebLinkAboutOrdinance 7661 ORDINANCE NO. 7 O 40f AN ORDINANCE VACATING, ABANDONING AND CLOSING A 4' UTILITY EASEMENT CROSSING LOT K, BLOCK 5, CRESTLAND ADDITION, SECOND FILING TO THE CITY OF FORT WORTH ACCORDING TO A PLAT RECORDED IN VOLUME 388-J, PAGE 297 OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR THE RE- VERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the 4' utility easement crossing Lot K, Block 5, Crestland Addition, Second Filing to the City of Fort Worth according to a plat recorded in Volume 388-J, Page 297 of the Deed Records of Tarrant County, Texas, be and the same is hereby vacated, abandoned and permanently closed as a utility easement. SECTION 2. That the fee to the land in the above described utility easement is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved therein for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. APPROVED AS TO FORM AND LEGALITY: S. G. W. 1 REED LVE1.5/77 PZ-826 Seminary Dr. @ Frazier Ave, (V•-77-t-58) i or Ms. Sandra Carolyn Northrup, owner of the subject property, represented by Ms. Marcia Balloun, has requested that the City vacate a 4" utility easement crossing said Lot K, and shown on the attached map. The subject easement was dedicated in order to contain an existing sanitary sewer, Recent survey work, however, has confirmed that the subject easement does not contain this sanitary or any other improvements, Rather, the sanitary sewer is located some 241 to the north of the subject easement. City Departments and private utility companies have reviewed this request and have no objection subject to the submission of a satisfactory replat. Such a replat, providing a correctly located easement for the sanitary sewer in this area, has now been received by the City staff. Recommendation It is recommended that an ordinance be adopted vacating the subject easement as requested.
