AN ORDINANCE APPROPRIATING REVENUE OF THE CITY IN EXCESS OF ITS TOTAL ESTIMATED IN- COME AS SET FORTH IN THE ANNUAL BUDGET FOR THE PURPOSE OF ACQUIRING FEE SIMPLE ABSOLUTE TITLE TO SYCAMORE GOLF COURSE; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR APPRO- PRIATION ORDINANCES; REPEALING ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the City Manager of the City of Fort Worth shall be provided with such revenue as may be secured from the various sources included in Ordinance No. 7399 and in the Budget of the City Manager; and, in addition thereto there is hereby appropriated the initial sum of One Hundred Thousand, Five Hundred Dollars ($100,500.00) to acquire fee simple absolute title to Sycamore Golf Course and pay necessary costs of condemnation. SECTION 2. Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such de- cision, opinion or judgment shall in no way effect the remain- ing portions, parts, sections or parts of sections of this ordinance, which provisions shall be, remain and continue to be in full force and effect, ' A SECTION 3, That this ordinance shall be cumulative of Ordinance 7399, but all other ordinances and appropriations for which provision has been heretofore made are hereby expressly re- pealed if in conflict with the provisions of this ordinance. SECTION 4, That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: City Attorney ADOPTED: December 27, 1976 EFFECTIVE: December 27, 1976 City of Fort Worth, Texas .mayor and Council Communication DATE REFERENCE SUBJECT: Condemnation Award Deposit -- PAGE NUMBER 12/27/76 L-5357 Acquisition of Sycamore Golf Course 1or ._L_ Authority is requested to deposit the award of the Special Commissioners, as provided by law, as a result of eminent domain proceedings for the acquisition of the privately owned Sycamore Golf Course: 1. Description of Project The privately owned Sycamore Golf Course has been for sale at least a year. The City Council on July 26, 1976, by Informal Report No. 2728 was advised of the Park and Recreation Advisory Board's recommendation to acquire this property. One of the principals of the estate that owns the property is a City employee which because of City ordinance, required the land to be acquired through condemnation proceedings. On August 9, 1976, (MSC G-3129) the City Council authorized eminent domain proceedings for the acquisition of the land com- prising the Sycamore Golf Course. 2. Type of Acquisition Outright Purchase 3. Description of Land Blocks 22, 30, 31 and all of that portion of Blocks 5, 23, 24, 28 and 29, if any of these be, lying west of the middle of Sycamore Creek, in the W. J. Boaz replat of a part of the King and Hendricks Subdivision of a part of the James Sanderson Survey, being bounded on the south by Vickery Boulevard, on the east by Sycamore Creek, on the west by Sycamore Street, containing 22 acres, more or less. Zoning: "C" Apartment and "B" Two-Family Description of Improvements: Frame office and residence containing 1,988 square feet, in fair condition, and a short nine hole golf course. 4. Amount of Award Location: Northside of East Vickery Blvd. $100,000 and two blocks east of the Poly Freeway (U.S. 287) . 5. Financing By Informal Report No. 2728, the Council was advised that the acquisition of Sycamore Golf Course would have to be financed from General Fund Reserves. There are fees for the Special Commissioners, court cost, etc. , estimated to not exceed $500. It is recommended that the City Council adopt a supplemental appropriations ordinance to establish General Fund Account No. 001-80615-0001, "Sycamore Golf Course", in the amount of $100,500.00. Owners: Mrs. Alice Marie Fincher - Undivided 1/3 interest, Mrs. Nancy Fincher Brown - undivided 1/3 interest, and Mrs. Judy Carolyn Robinson and Mr. Billy Joe Fincher - undivided 1/3 interest.
