HomeMy WebLinkAboutOrdinance 7361 ORDINANCE NO. �y AN ORDINANCE PROVIDING ADDITIONAL TOW-AWAY ZONES, WHEREIN ANY VEHICLE ILLEGALLY STOPPED, STANDING OR PARKED SHALL BE SUBJECT TO IM- POUNDMENT, BY AMENDING SECTION 26-122 OF FORT WORTH (1964) , AS AMENDED; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PROVISIONS OF ORDINANCES AND OF SUCH CODE AFFECTING MOTOR VEHICLES AND TRAFFIC; PROVID- ING FOR REPEAL; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Subsection (b) of Section 26-122 of Chapter 26 of the Code of the City of Fort Worth (1964) , as amended, be, and the same is hereby amended and, after having been so amended, same shall be and read as follows: "(b) Each of the following is designated as a tow-away zone, effective when notice of said zone is given by an official traffic- control device, and any vehicle unlawfully stopped, standing or parked in any such tow- away zone shall be removed in the manner and to the place provided by this chapter: " (1) Second Street, from Houston Street to Taylor Street; "(2) Seventh Street, from Lamar Street to Jones Street; " (3) Sixth Street, from Jones Street to Cherry Street; " (4) Taylor Street, from Second Street to Belknap Street; "(5) Alice Street, west half, from West Dickson Street to West Pafford Street; "(6) May Street, from West Biddison Street to West Butler Street; "(7) West Ripy Street, from South Main Street to a point one hundred and fifty (150) feet west of May Street; 11(8) Saint Louis Avenue, from West Biddison Street to West Butler Street." SECTION 2. That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth (1964) , as amended, affecting motor vehicles and traffic, except where the provisions of this ordinance are in direct conflict with the pro- visions of such ordinances and such Code, in which event such conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 26 of the Code of the City of Fort Worth (1964) , as amended, and of any other ordinance affecting motor vehicles and traffic which have accrued at the time of the ef- fective date of this ordinance; and, as to such accrued viola- tions and all pending litigation, both civil and criminal, -2- whether pending in court or not, under such chapter and/or other ordinances, same shall not be affected by this ordi- nance but may be prosecuted until final disposition by the courts. SECTION 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each day or portion thereof during which any violation of any of the provisions of this ordinance is committed, continued or permitted, and each violation shall be punishable by a fine not to exceed Two Hundred Dollars ($200.00) . SECTION 6. That this ordinance shall be in full force and effect -3- from and after the date of its passage and publications as required by law, and it is so ordained. This action is taken as a result of staff analysis of problems identified in a petition submitted to the Council on April 26, 1976, by residents of the Worth Heights Addition. Street Extent Alice Street, West half From West Dickson to West Pafford Street May Street From West Biddison Street to West Bulter Street West Ripy Street From South Main Street to a point one hundred and fifty (150) feet west of May Street Saint Louis Avenue From West Biddison Street to West Butler Street These tow-away zones were installed by the Traffic Engineer under emergency provisions in order to relieve the congested traffic conditions that devel- oped as the result of industrial employees parking in a residential neigh- borhood. In order to continue these tow-away zones in force, it is necessary that the City Council adopt the attached ordinance. Recommendation It is recommended that the proposed ordinance described above be adopted.
