HomeMy WebLinkAboutOrdinance 7261 ORDINANCE NO AN ORDINANCE PROVIDING THAT N. E. 11TH STREET CROSSING THE RIGHTS-OF-WAY OF THE ST. LOUIS- SAN FRANCISCO AND ST. LOUIS-SOUTHWESTERN RAIL- ROADS BE VACATED, ABANDONED AND CLOSED; PROVID- ING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described portion of N. E. llth Street across the St. Louis-San Francisco and St. Louis-South- western Railroads rights-of-way be and the same is hereby closed, abandoned and permanently vacated as a street or pub- lic thoroughfare of any kind or character whatsoever, save and except that the entire area of N. E. llth Street closed by this ordinance is retained as a ptility easement: Beginning at a point in the westerly right-of- way line of the St. Louis-San Francisco Railroad on the northerly right-of-way line of N. E. llth Street; Thence easterly along the northerly right-of-way line of N. E. llth Street, crossing the right-of-way of the St. Louis-San Francisco and the St. Louis- Southwestern Railroads, to a point in the easterly right-of-way line of the St. Louis-Southwestern Railroad; Thence southwesterly along said easterly right- of-way line to a point in the southerly right-of-way line of N.E. llth Street; Thence westerly along said southerly right-of-way line, crossing the rights-of-way of the aforesaid railroads, to a point in the westerly right-dif-way line of said St. Louis-San Francisco Railroad; Thence northeasterly with said westerly right-of- way line to the place of beginning. i SECTION 2. That the interest of the City of Fort worth in the fee to the land in said street is hereby released and shall re- vert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. P OGE NUMBER 1/10/75 NUMBER PZ- @ St. Louis-San Francisco Railroad > or __l__ GRAHAM R - - HUMAN ROBIS 'The Director of Public Works, with the consent of the St. Louis-San Francisco SANTRAailroad, has requested that the City vacate only that portion of N. E. llth wALts Street in the 200 and 300 blocks crossing the St. Louis-San Francisco Railroad tracks between North Commerce and North ,zones Streets, as shown on the attached WOOD map. MUM Subject right-of-way, acquired by dedication, is open and unpaved and contains sanitary sewer, water, and telephone facilities. The agencies responsible for u'RIE these public facilities request the vacated right-of-way be retained as a utility easement. This request was initiated by the Director of Public Works in con- junction with the railroad in order to eliminate hazardous and hard to maintain railroad crossings. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject right-of-way as requested. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission.
