Such rate schedules shall become effective on the first day of April, 1974, or as soon thereafter as may be ap- propriate for billing purposes. Section 2. TESCO shall lay, erect, string, maintain and operate its lines and equipment so as to minimally interfere with traffic and shall promptly restore all thoroughfares and other surfaces which it may disturb to their original condition. At the City's request and for the City's benefit, TESCO, at its own cost and expense and without claim for reimbursement, shall raise, lower, relocate or otherwise reposition any of its electric service lines (overhead or underground) located in, on or under any street, alley or any other public right-of-way or easement dedicated to public uses; but TESCO shall have no such obligation where the request by the City is made for the purpose of enabling any. other person, firm, corporation or governmental entity to use such streets, alleys, public ways or easements of the City or to use the land theretofore used for such street, alley, public way or easement purposes. Section 3. Nothing in this ordinance contained shall be construed to repeal, restrict, limit, modify or amend those mutual covenants and agreements established by City Contract No. 7230. Section 4. Nothing in this ordinance contained shall be construed to repeal, restrict, limit, modify or amend in �ny manner the right, power and authority of the City under the Charter of the City of Fort Worth, the Constitution and the laws of the State of Texas and of the United States to regulate the rates and charges of TESCO for local electric service provided within the City of Fort Worth. Section 5. This ordinance shall repeal, supersede and replace any and all conflicting ordinances, resolutions, ,agreements and actions entered into between TESCO and the City: Section 6. The staff has concluded their analysis of this request and their findings are included in a report entitled "Analysis of Electric Company Rate Request", dated February 13, 1974 and attached to this M&C. Recommendation It is recommended that an ordinance be adopted prescribing the new rates proposed in the attached report to be effective April 1, 1974.
