AN ORDINANCE AMENDING ORDINANCE NO. 3011 , BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDING; AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES; OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011; PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described area be altered, changed and amended as follows to wit: Z-67-31 Lots 1, 2 and 3, Block 29; and Lots 20, 21 and 22, Block 30, Worth Hills Addition; Lots 9 and 10, Block 8; and Lots 11 and 12, Block 9, Johnson's Northside Addition. (2966-67-68-69 and 3000-01-02-03 Roosevelt Avenue) FROM "E" TO "B" Z-67-32 Lot 1, Block 22, Worth Hills Addition. (3101 Roosevelt Avenue) FROM "E" TO "B" Z-67-36 Northerly portion of Lot 25, Block 3, Vickery Acres Addition, not now zoned "E" Commercial. (Rear of 3065 Mansfield Highway) FROM "B" TO "E" Z-67-38 A 9.88 acre portion of Tract 6 (City Tax Records), A. Stinson Survey, as described by metes and bounds: A portion of the A. Stinson survey, Abst. No. 1413, situated in the southerly part of Fort Worth in Tarrant County, Texas, and embracing parts of the tracts conveyed to James M. Ellis by the deeds recorded in volume 1074, page 136 and in volume 138, page 534 of the Tarrant County Deed Records. Beginning at a 5/8 inch iron at the northwest corner of said first above mentioned tract, said corner being the intersection of the east line of Mississippi Avenue and the South line of Glen Garden Drive, formerly known as Sutton Street, proceed North 89 degrees 32 minutes east 330 feet to a point of beginning of Zoning Tract "B", such point being on the south right of way of Glen Garden Drive. Thence north no degrees--22 minutes east along said street and tract line, 447 feet to a point, such point being the northwest corner of Zoning Tract "B" which is on the east line of Mississippi Avenue. Thence north 89 degrees-32 minutes east 296.6 feet to a point. Thence north 15 degrees-27 minutes east to the point of beginning of Zoning Tract "B", 9--88/100 Acres. Collett Survey, described as follows: Beginning at an intersecting point on the south line of Seminary Drive and the west line of Campus Drive. Thence, west along the south line of Seminary Drive a distance of 1180.3 feet to an iron pin. Thence S 1017'E a distance of 300 feet. Thence N 88043' E to an intersecting point on the west line of Campus Drive. Thence North on the west line of Campus Drive to the point of beginning. Ross and Arnett Dorbandt by a deed recorded in Vol. 2116, p. 513, of the Deed Records of Tarrant County, Texas, and the tract conveyed to Bert F. Ross and Mrs. Virginia Dorbandt by a deed recorded in Vol. 2191, p. 15, of said Deed Records. Beginning at an iron rod set in the most southerly west line of said B.B.B. & C. RR Company Survey, being in the east line of the C. K. Gleason Survey, 360 varas from its northeast corner; and from said beginning corner, in Chaplin School Road, U. S. Geological Survey Monument, marked "92 DHW" bears North 6 degrees 20 minutes East 12-16/100 varas; Thence South 89 degrees 20 minutes East, along the Old Weatherford Road, and continuing, in all 950-1/10 varas to a set stone marked "DEAL"; Thence South no degrees 25 minutes East 49-4/10 varas to an old set stone marked "HC", for the northwest corner of Lot 2 set apart to J. F. Covington by the decree of the District Court in Cause No. 1945, a copy of which is of record in Vol. 49, p. 570, of the Deed Records of Tarrant County, Texas; and being a northwest corner of said Hays Covington Survey and a reentrant corner of said B.B.B. & C. RR. Company Survey; Thence South 89 degrees 49 minutes East, along a common line of said Surveys, in the old Weatherford Road, 1282-2/10 varas to a spike set in the intersection of said Road with Alemeda Street; and from said spike an iron rod bears South 48 degrees 45 minutes West 14-62/100 varas; Thence South no degrees 25 minutes East, along the middle of said Street, 1207-7/10 varas to the Southeast corner of the tract conveyed to Ross and Dorbandt by a deed recorded in Vol. 2116, p. 513, of said Deed Records; and from said corner an iron rod, the Northeast corner of Block 3 in Linda Vista Estates Addition, bears North 89 degrees 47 minutes West 9 varas; Thence North 89 degrees 47 minutes West, along the North line of said Addition, and continuing, in all 1312-8/10 varas to a steel rod for the southwest corner of said Ross and Dorbandt Tract, from which an iron pipe, the northwest corner of Block 1 in said Addition, bears South 89 degrees 47 minutes East 7-8/10 varas; Thence North no degrees 11 minutes East, along the West line of said Ross and Dorbandt Tract, 590 varas to an iron rod, from which another iron rod, the south-southeast corner of the B. B. B. & C. RR Company Survey, bears South 89 degrees 55 minutes East 12-76/100 varas; Thence North 89 degrees 55 minutes West, along the south line of said survey, 935-8/10 varas to a spike in Chaplin School Road, the South-Southwest corner of said survey, from which an iron rod bears South 89 degrees 55 minutes East 10-06/100 varas; Thence North no degrees 27 minutes East, along a west line of said Railroad Company Survey, in said Road, 676 varas to the place of beginning, and containing 390-65/100 acres. Of the total area, 1.12-94/100 acres are within the B. B. B. & C. RR Company Survey, and 276-65/100 acres are within the Hays Covington Survey, and 1-06/100 acres are within the J. P. Casteel Survey Abst. 349, included in a deed from Elizabeth Ann Moore et al to Gillis A Johnson as recorded in Volume 1228, Page 307, Deed Records of Tarrant County, Texas, described as follows: Beginning at a point in the southerly ROW line of U.S. Highway 80, said point also being the northwest corner of Block 4, Westland Addition to Fort Worth; thence southwesterly along the south line of said Highway 80 to its intersection with the corporate limit line of Fort Worth, Texas as established by Ordinance 4846; thence southeasterly and northeasterly along said corporate limit line to a point for corner, said point being 300' ft. west, measured perpendicularly from the west ROW line of Westland Ave. in Westland Addition; thence south along a line 300 ft. west of and parallel to the west line of Westland Avenue, said line also being the Fort Worth corporate limit line, to its intersection with the south line, projected west, of Block 11, Westland Addition; thence east to the southwest corner of Block 11, Westland Addition; thence north along the west line of Westland Addition to the point of beginning. Highway 80, said point also being in the west line of Block 3, Westland Addition to Fort Worth; thence north along the west line of said Block 3 to the north line of the N. Casteel Survey; thence N89151'W along the north line of the N. Casteel Survey and said line extended west to the west line of Chapin School Road to a point for corner; thence north along the west line of Chapin School Road to its intersection with the Fort Worth corporate limit line as established by Ordinance 4848; thence southwesterly along said city limit line a distance of 1250 ft. more or less to a point for corner, said point being in the western boundary of the tract of land conveyed by Cassie Fowler and husband to Gillis A. Johnson as recorded in Volume 1696 page 1, Deed Records, Tarrant County, Texas; thence SO°07'E and S8045'W along the westerly boundary of said Gillis A. Johnson tract to a point for corner, said point being in the north line of U. S. Highway 80; thence northeasterly along the north line of said U. S. Highway 80 to the POB. (Adjacent to Highway 80 West and I-20, between Dr. Harris Road and Mary's Creek) FROM UNZONED TO "AG" Z-67-28 A tract of land out of the E. S. Harris and Shield Surveys, situated about 3 miles southwesterly of the Courthouse of Tarrant County, Texas, described as follows: Beginning at a point in the north line of the Harris Survey Abstract #688, said point being S89050'E 389.5 ft. and S8900'E 577.9 ft. from the Northwest corner of said survey and also being in the new southeasterly ROW line of the realignment of the Clear Fork of the Trinity River; thence N89°0'W 63.3 ft. along the north line of said Harris Survey and the realigned ROW line of the Clear Fork of the Trinity to a point for corner; thence N35014' E and N37142' E along the new ROW line of the realigned Trinity River 450 ft. M/L to the center line of the old channel of the Clear Fork of the Trinity River; thence southerly, westerly and northerly with the center line of said old channel and its meanders to its intersection with the new southeasterly ROW line of the Clear Fork of the Trinity River, said point being southwesterly 275 ft. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general Hlelfare of the community, They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public hearing with reasonable considera- tion among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6. This ordinance will take effect and be in full force and effect from and after its passage and publication as required by law.
