AN ORDINANCE CLOSING AND VACATING THE 75'x1759
DRAINAGE EASEMENT LOCATED IN THE NORTHEAST
CORNER OF TRACT 40-C, WEDGWOOD ADDITION TO THE
CITY OF FORT WORTH, TARRANT COUNTY., TEXAS; AND
PROVIDING FOR THE REVERSION OF THE INTEREST OF
THE CITY OF FORT WORTH IN SAID LAND_
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That the hereinafter described drainage easement lo-
cated in the northeast corner of Tract 40-C, Wedgwood Addition
to the City of Fort Worth, Tarrant County, Texas, be and the
same is hereby extinguished, vacated, closed and permanently
abandoned as an easement, save and except that easements in
the north eighteen feet (181) and the east ten feet (10')
thereof are retained for existing utilities located therein:
Beginning at a point on the south line of
State Highway 217 opposite and 170 feet southerly
from Highway centerline station 297-50; thence
south 15 degrees 19 minutes west 75 feet to a
point; thence south 74 degrees 41 minutes east
175 feet to a point; thence north 15 degrees 19
minutes east 75 feet to a point in the said
right of way line opposite and 170 feet southerly
from Highway centerline station 299-25; thence
north 74 degrees 41 minutes west along the said
right of way line 175 feet to the point of begin-
ning, and containing .301 of an acre of land more
or less.
SECTION 2.
That the interest of the City of Fort worth in the fee to
the lapd in said easement above described is hereby released
and shall revert to the adjacent owner of the fee as provided
by law, save and except the portion thereof expressly retained.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage.

NUMBER Drainage Easement in a Portion
11/4/65 PZ-157 1of 1 of the Wedgwood Addition
Worth Investment Company, owner of Tract 40-C, Wedgwood Addition, has requested
abandonment of the drainage easement located in the northeast corner of the
property as shown on the attached map. The Worth Investment Company has recently
constructed a closed drain system at its expense in the easement which eliminates
the need for the easement. Maintenance of the drain is the responsibility of the
owner, who now wishes to use the reclaimed area for development.
Because the easement was originally obtained by the State Highway Department,
it will be necessary for the State to relinquish its interests to the owner, `"The
District Engineer of the Texas .Highway Department has advised that the State
would relinquish its interests in the entire easement at the request of the City,
accompanied by a resolution or ordinance, abandoning the City interest in the
easement. The State has also been advised that it might be necessary for the
City to retain easements for the existing utilities although the State would
abandon the entire easement.
Private utility companies, the Public Works, Water, Traffic Engineering, and
Planning Departments have reviewed the request and do not object to the abandon-
ment, provided the north 18 feet and the east 10 feet of the existing drainage
easement are reserved for existing utilities.
The City Plan Commission has reviewed the request and recommends adoption of the
ordinance that has been prepared abandoning the easement as requested, subject
to the owner's filing an instrument with the City dedicating to the City the
easements as requested. The owners have filed the dedication instrument with
the City Planning Department.
