HomeMy WebLinkAboutOrdinance 3761 ORDINANCE NO. 7�1 AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRI, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVmE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCR3EED AREAS FROM THE USES AS SHOUN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011; PRESCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR.EACH OFFENSE,.AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE CFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described areas be altered, changed and amended as follows to wit: AREAS FROM TO Lots 5 through 7, Block 1; North Mistletoe Addition; and Darwin Street from West line of Forest Park Boulevard to the South litre of T. & P. Railroad right-cf-way and an unnamed street adjacent to Lot 7, Block 1; North Mistletoe Addition; the streets having been closed by Ordinance No. 3716, September 27, 1957 "A" "In Lots 1 through 7, Block 4; Moore-Thornton Strips; and Tract 11, R. Briggs Survey NJ" "K" (1300 and 1400 blocks of E. Fourth Street) Lots 1 and 21 Block 52, Ridglea Addition RAN "Ce (West side of 4600 block Westridge Avenue) The South 187 feet of Tract 1-A; T. White Survey, and Bast half of Gandy Street lying between North line of Byers Avenue to the South line of Bryce Avenue closed by Ordi- nance No. 3589, February 13, 1957 "A" "K" Alley lying between 2050 block of Montgomery and Gen Streets, (Block 18, Ross Heights Addition, closed by Ordinance No. 3228, July 28, 1954; Byers Avenue from East line of Montgomery to East line of Gandy Street and West half of Gandy Street from North line of Byers Avenue to South line of Bryce Avenue closed by Ordinance No. 3589, February 13, 1957 "A" RJR, Tracts 3-A, 3-B and North portion of Tract 3, M. The zoning regalations and districts, as herein established, have been made in accordance with a comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed to lesson congestion in the streets; to secure safety from fire, panic and other dangers; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, parka and other public requirements. They have been made with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land through thm cemmuni.ty. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the Court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and NoAOO Dollars ($5.00) nor more than Two Hundred and NoAOO Dollars ($200.00) for each offense. Each day that a violation is permitted to e-xdst shall constitute a separate offense. SECTION 6.
