HomeMy WebLinkAboutOrdinance 2461 ORDINANCE NO. • AN ORDINANCE AMENDING PARAGRAPH 1-5-12 OF ORDINANCE NO, 1389, AN ORDINANCE REGULATING THE CONSTRUCTION, ERECTION, ALTERATION, REPAIRING, R340DELING AND MDVING OF BUILDINGS AND STRUCTURES; PRESCRIBING.A SCHEDULE OF FEES FOR BUILD- ING PERMITS AND INSPECTIONS; REPEALING ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; DESIGNATING A SAVING CLAUSE- PROVIDING A FINE OF NOT TO EXCEED TWO HUNDRED DOL- LARS (j200.00) FOR THE VIOLATION THEREOF, AND THAT EACH DAY'S VIOLATION SHALL CONSTITUTE A SEPARATE OFFENSE; AND MAKING THIS ORDINANCE EFFECTIVE FROM AND AFTER THE DATE OF ITS PASSAGE AND PUBLICATION AS REQUIRED BY LAW, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1, That Paragraph 1-5-12 of Ordinance No. 1389 shall hereafter read as follows: Paragraph 1-5-12. Fees for Permits and Inspection. For every Building Permit issued for the erection or con- struction of any new building or structure, or for the altera- tion or repair of any existing building or structure, or for any mechanical installation, such as plumbing, heating, elec- tric wiring or elevators, the Building Commissioner shall collect a fee from the owner or contractor performing such work. Such fee shall cover the cost of permit and cost of inspection by the Building Commissioner or his assistants at regular intervals until work is completed, and shall be based on the total cost, including mechanical work, as follows: Building Cost Fees $100.00 or less $1.00 Over $100.00 and not exceeding $500.00 2,00 Over $500.00 and not exceeding $1,000.00 3.00 Over $1,000.00 and not exceeding $2,000.00 5.00 Over $2,000.00 and not exceeding $3,000.00 7.00 Over $3,000.00 and not exceeding $5,000.00 10,00 For each additional $1,000.00 above $5,000.00 and not exceeding $20,000.00 1.50 For each additional $1,000.00 above 620,000.00 1.25 For'movinva of a house or building from one location to another on the same lot 5,00 For moving of a house or building in, through or upon streets, alleys, avenues or pnblie grounds, the sum of $25.00 for the first day and $10.00 for each additional day, or fraction thereof, that the house or build- ing is in or on the street, alleys, avenues or public grounds. On additional cost due to changes in plans and specifica- tions, an additional fee must be paid by the owner or his au- thorized agent, in accordance with the above schedule. Inspection fees for special items such as plumbing, heat- ing, electrical work, sprinkler systems, elevators, fire escapes, signs and billboards, wrecking of houses, etc., as called for in various sections of this code, and in the plumbing and electrical ordinances shall be paid in addition to the general fee for Building Permits mentioned herein. In addition to the above fees, the owner or his agent shall pay the actual cost of any tests required by the Building Commissioner, unless the owner or his agent can furnish certificates covering such tests made by some recognized authority satisfactory to the Building Commis- sioner. Any act of erecting, repairing, changing, altering, or removing any building or structure or making any me- chanical installation such as heating, plumbing or elec- trical wiring in same, carried on without a permit having been issued by the Building Commissioner, or any willful misstatement of facts concerning the proposed type of con- struction, proposed use or estimated or actual cost made in securing a permit shall be considered a violation of this ordinance. Where penalties are invoked, in addition to such penalties, the owner or his agent shall further be held liable for payment of permit fees computed on the basis of the above schedule for the actual cost of such building or structure. SECTION II. Any person, firm, company or corporation, its agents, servants or employees, violating any of the provisions of this ordinance shall, upon con- viction thereof, be fined in any sum not to exceed Two Hundred Dollars ($200.00), and each days violation thereof shall be and is hereby declared to be a distinct and separate offense and punishable as such. SECTION III. That all ordinances and parts of ordinances heretofore passed by the City Council of the City of Fort Worth that are in conflict with the forego- ing provisions of this ordinance shall be void and of no further force and ef- fect. SECTION IV. Should any section, clause or provision of this ordinance be de- clared by a court of competent jurisdiction to be invalid, such shall in no way affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be 'invalid. SECTION V. That this ordinance shall be in full force and effect from and after the date it is adopted and published as required by law.
