AN ORDINANCE PROVIDING THAT A PORTION OF THE ALLEY IN BLOCK 37, ROSEN HEIGHTS ADDITION, SECOND FIL- ING, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EF- FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the portion of the alley in Block 37, Rosen Heights Addition, Second Filing, an addition to the City of Fort Worth, Tarrant County, Texas, from the northwest right of way line of 28th Street northwest to a point twenty (20) feet southeast from the northwest line of Lot 18 of said block, be and the same is hereby vacated, closed and permanent- ly abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owner of the fee as provided by law, save and except that easements are retained for exist- ing utilities, including a twenty foot wide easement for an existing sanitary sewer line and an easement for existing fa- cilities of Texas Electric Service Company located in the northeast ten feet of said portion of the alley adjacent to Lots 1 and 2 of said Block 37. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. City Attorney Mr. Brownlee City of Fort Worth, texas Mr. Thelin ($) Mr. Hardy (4) Mr. Buckman Mayor and Council Communicat �r , DATE REFERENCE SUBJECT: Proposed Alley Abandonment in the PAGE NUMBER Rosen Heights Addition 11/4/65 PZ-156 1 of 1 Safeway Stores Incorporated, owner of Lots 3-7 and 18-24, Block 37, Rosen Heights Addition, has requested the abandonment of the alley in Block 37, Rosen Heights Addition, from the northwest right-of-way line of 28th Street, northwest to a point twenty feet southeast from the northwest line of Lot 18, Block 37, Rosen Heights Addition, as shown on the attached map. Closing of the alley will permit construction of a new store building at the inter- section of 28th Street and Azle Avenue. Sinclair Refining Company, the other property owner adjacent to the portion of the alley requested to be abandoned, has signed a petition agreeing to the proposed abandonment. Safeway has agreed to replat the subject property and dedicate a 20 foot alley along the southeast line of Lot 17, from 26th Street to the subject alley, to preserve traffic circulation, and a necessary drainage easement requested by the Public Works Department. Private utility companies, the Public Works, Water, Traffic Engineering and Planning Departments have reviewed the request and do not object to the aban- donment. The Water Department, however, requests that the full width of the alley be retained as an easement for an existing sanitary sewer line. Texas Electric Service Company also requested that the northeast ten feet of the alley adjacent to Lots 1 and 2 be reserved as an easement for existing facil- ities. Safeway has agreed to retaining the easements. The City Plan Commission has reviewed the request and recommends adoption of the ordinance that has been prepared abandoning the alley, subject to retain- ing the required easements, replatting the property and dedicating the neces- sary drainage easements and new alley-way.
