V­aa P AN ORDINANCE ESTABLISHING CERTAIN RULES AND REGULA- TIONS FOR PARK AND RECREATION AREAS FOR THE CITY OF FORT WORTH LOCATED OUTSIDE THE CORPORATE LIMITS OF SAID CITY; PROVIDING FOR THE ENFORCEMENT OF SAID RULES AND REGULATIONS; PROVIDING A PENALTY FOR VIO- LATIONS HEREOF; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES REGULATING PARK AND RECREATION AREAS; PROVIDING A SAVINGS CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The following rules and regulations shall be in force in all parks or recreation areas of the City of Fort Worth located outside the cor- porate limits of said City: 1. It shall be unlawful for any person to cut, deface or mark any park property, or to handle, pluck or injure any flower, shrub or tree, or to injure or damage any natural or artificial improvement in any park or rec- reation area. 2. It shall be unlawful for any person to use those park and recreation facilities for the use of which a fee is charged, without first having paid said fee. 3. It shall be unlawful for any person to frighten, annoy or injure, or attempt to frighten, annoy or injure, any animal or bird in said park or recrea- tion area. 4. It shall be unlawful for any person to deposit paper, glass, metal or trash of any description on any lawn, driveway, path or other place in said park and rec- reation area except in receptacles provided therefor. 5. It shall be unlawful for any person to display any advertising matter by signs of any character within the park and recreation area. 6. It shall be unlawful for any person to sell or offer for sale any goods, wares or merchandise without permission of the Park and Recreation Board. 7. It shall be unlawful for any person to practice golf in any portion of a park or recreation area not des- ignated for that purpose; provided, however, that the practice of golf with knit or plastic balls shall be permitted in any open area not specifically designed or designated for some other specialized activity. 8. It shall be unlawful for any person to use any boisterous, insulting or profane language or to con- duct himself in a disorderly, lewd or lascivious manner in said park or recreation area. 9. It shall be unlawful for any person to enter any portion of a park or recreation area which is desig- nated as restricted, or to enter any area during the hours of the day when said area is not open to the public. Hours during which the area is open to the public shall be posted by the Director of Parks and Recreation. 10. It shall be unlawful for any owner or person in con- trol of any dog to keep or permit the same in or about any park or recreation area unless such dog is kept under restraint at all times by means of a leash. 11. Traffic regulations: A. It shall be unlawful for any person to drive or propel any vehicle in, over or through any park or recreation area except along and upon park drives, parkways or boulevards or other areas designated for driving purposes. - 2 - B. It shall be unlawful for any person to op- erate a motor vehicle upon any parkdrive, parkway, boulevard, street or other vehicu- lar thoroughfare at a speed greater than that which is reasonable and pertinent un- der the conditions then and there existing. C. The City Traffic Engineer is hereby author- ized to establish prima facie speed limits in park or recreation areas after engineer- ing and traffic surveys as required by law. D. The existence of signs or markers designat- ing speed limits, parking restrictions and other traffic controls shall be prima facie evidence that such signs, markers or controls were erected and placed by and at the direc- tion of the City Traffic Engineer in accord- ance with law. SECTION 2. Should any section, clause or provision of this ordinance be declared by a court of competent ,jurisdiction to be invalid, the same shall not affect the validity of this ordinance as a whole or any part thereof other than the part so declared to be invalid. SECTION 3. That this ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumula- tive except as to such ordinances or portions thereof as are expressly repealed hereby. - 3 - a � SECTION 4. That any person who violates, disobeys, omits, neglects or re- fuses to comply With any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). SECTION 5• That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by lay. APPROVED AS TO FORM AND LEGALITY; City Attorney
