RAILWAY CWANY, A CORPORATION, AND ALL PER-
SONS, FIRM, CORPORATIONS AND ASSOCIATION OF
PERSONS WHICH ARE OWNERS, LESSEES, OR CLAIM
ANY INTEREST IN AND TO ANY PROPERTY ADJACENT
TO THE TRACKS OF SAID RAILWAY COMPANY IN WEST
LANCASTER AVENUE, FROM THE WEST LINE OF HOUSTON
STREET TO THE EAST LINE OF CHERRY STREET, AIM
ALL PERSONS, YMS, CORPORATIONS AND ASSOCIATION
OF PERSONS OWNING, LEASING, USING OR CLAIMING
ANY INT%RHST IN ANY LOADING DOCKS, BUILDINGS,
STRUCTURES OR OTHER OBSTRUCTIONS IN SAID STREET,
BETWEEN THE WEST LINE OF HOUSTON STREET AND THE
EAM LINE OF CHERRY STREET, TO SHOW CAUSE ON A
&DATE GM IN WHY SAID RAILWAY TRACKS, LOADING
DOCKS, BUILDINGS, STRUCTURES AND OTHER OBSTRUC-
TIONS SHOULD NOT BE REMOVED FROM SAID STREET;
SETTING A DATE FOR HEARING; AND PROVIDING THAT
SAID HEARING SHALL CONTINUE UNTIL ALL INTERESTED
PARTIES SHALL HAVE HAD A FULL OPPORTUNITY TO PRE-
SENT SUCH TESTIMONY AND EVIDENCE PERTINENT TO THE
MATTER UNDER CONSIDERATION AS THEY MAY DEW PROPER
AND MW*
WHEREAS, West Lancaster Avenue is a public street and thoroughfare
in the City of Fort Worth extending from the city limits on the east to Sum-
mit Avenue on the west; and,
WHEREAS. necessary arrangements have been made to extend said street
and thoroughfare west across the Clear Fork of the Trinity River, making a
direct connection with Federal Highway No. 80 and State Highway No. 1, which
will become the main thoroughfare east and west across North Texas; and,
W MMO, necessary funds have been provided to widen, improve and
extend the said West Lancaster Avenue by paving, building curbs and side-
walks and drains, and constructing tunnels, overpasses and bridges with the
aid of the state and national governments so as to make it a complete project
in all essential details, under the supervision of the most competent engineers
and contractors available; and,
WHEREAS, between the west line of Houston Street and the east line
of Cherry Street, there is now being maintained by the Texas and Pacific
Railway Company railway tracks comaonly Down as "house tracks' on which are
placed railway cars which are left and caused to remain there many hours
during the day and night; and,
WHEREAS, a number of buildings and structures in the nature of
loading docks have been built and constructed and are now being maintained
in said street; and,
WHEREAS, the said railway tracks and the cars and engines that are
necessarily switched back and forth daily and caused to be left in said
street, and the presence and maintenance of said buildings, structures and
loading docks, each and all of them have resulted in creating obstructions
to the orderly processes of traffic, both vehicular and pedestrian, along,
in and through said thoroughfare, and have further resulted in the creation
of a serious menace to such traffic, creating dangers and hazards to the pub-
lic that cannot be prevented except by the removal of said obstructions; and,
W EREAS9 the further maintenance of said obstructions in said street
and thoroughfare will seriously impede the necessary improvement of said
street and interfere with the development of a national and state thorough-
fare; and,
WHEREAS, there exists an imperative necessity, and the public inter-
ests require in subserving safety, convenience and general welfare, that the
above described obstructions should be removed from said street, NOW, THERE-
FORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTS, TEXAS:
SECTION 1.
That the Texas and Pacific Railway Company, a corporation with an
agent in the City of Fort Worth, Texas, on whom service of citation may be
had for the purposes herein, and Mrs. Winfield Scott, a widow, Morrison Sup-
ply Company, Ino., Hinckley-Tandy Leather Company and Yellow Transit Company,
Lessee, F. M. Fillingim and E. A. Shotts, Tr., Lienholder, W. Montgomery and
Fort Worth Wholesale Grocery Company, Lessee, T. M. Leonard, 0. P. Leonard
and Fort Worth Wholesale Grocery and Produce Company, Lessee, T. W. Myers,
Texas Warehouse Company, Mrs. Mary T. Shear, a widow, and W. C. Stripling
Company, Lessee, Worth Realty Corporation, Tea-O-Kaa Flour Mills Company,
Garter Publications, Inc., Norwell-Wilder Supply Company, Garter Publica-
tions, Inc., and National Supply Company be cited and ordered to appear be-
fore the City Council of the City of Fort Worth, Texas, at the City Hall in
said city, at 1:30 P. M., on,Aa/'�� '5*-y the ;'I day of Tuly,
A. D. 1937, to show cause why an order providing an appropriate penalty
should not be entered by this Council directing that said railway traoks,
structures, buildings, loading docks and all other obstructions should be
removed from West Lancaster Avenue between the west line of Houston Street
and the east line of Cherry street.
SECTION 2•
That the City Council on the date aforesaid shall sit as a committee
of the whole in the Council Chamber at the City Ball in the City of Fort
Worth and hear any testimony or evidence that any interested party may de-
sire to present relevant to the matter of removing railway track&, loading
docks, buildings, structures and other obstructions in West Lancaster Avenue
between the west line of Houston Street and the east line of Cherry Street,
and shall continue its deliberations until each and every one of said inter-
ested parties has been given a full opportunity to be heard*
SECTION 3.
The City Secretary is hereby authorized and directed to serve and
cause to be served upon each of the above named persons, firms, corporations
and association of persons a notice and citation notifying each of them to
appear before said City Council at the time and place aforesaid for the pur-
poses herein stated.
SECTION 4.
This ordinance shall take effect and be in full force and effect
from and after the date of its passage and it is so ordained.
