AN ORDINANCE AMENDING ORDINANCE NO. 3011, THE COM- PREHENSIVE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BY AUTHORIZING A USE APPLICABLE TO APPROX MATELY 106.446 ACRES OF LAND AND ZONING THE SAME OFFICIAL RECORD FOR EDUCATIONAL PURPOSES; PRESCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN FIVE CITY SECRETARY DOLLARS ($5.00) NOR MORE THAN TWO HUNDRED DOLLAR WORTN, TEX.($200.00) FOR VIOLATION HEREOF AND THAT EACH DAY V A VIOLATION EXISTS SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011 be amended so that the use permitted in the following described area be altered, changed and amended from "A" One-Family Residential to "Educational Purposes" and restricted to educational purposes: Parts of the Adam Vogt Survey, Abstract No. 1585, the James Smith Survey, Abstract No. 1382, and of the Thomas B. Taylor Survey, Abstract No. 1539, situated about 4 miles south 25 degrees west from the Courthouse in Fort Worth, in Tarrant County, Texas, and embracing the tract conveyed to the City of Fort Worth by a deed recorded in Vol. 798, p. 314, of the Deed Records of Tarrant County, Texas, and also embracing a portion of the 106-4/10 acres tract conveyed to the City of Fort worth by a deed recorded in Vol. 777, p. 455, of said Deed Records: Beginning at a galvanized iron rod in the south line of said A. Vogt Survey and 500-6/10 varas from its southeast corner, and being the southwest corner of said 106-4/10 acres tract and the west corner of the tract conveyed to the City of Fort Worth by said deed recorded in Vol. 798, p. 314, of said Deed Records of Tarrant County; Thence north 0 degrees 07 minutes east along the most westerly west line of said 106-4/10 acres tract 847-2/10 feet to an iron rod; Thence north 14 degrees 53 minutes east 67-9/10 feet to an iron rod; Thence north 24 degrees 20 minutes east 80 feet to an iron rod; Thence north 34 degrees 09 minutes east 100 feet to a stake; Thence north 18 degrees 34 minutes east 54-5/10 feet to an iron rod; Thence north 9 degrees 28 minutes east 50 feet to an iron rod; Thence north 1 degree 47 minutes east 300 feet to an iron rod; Thence north 7 degrees 35 minutes east 50 feet to an iron rod; Thence north 35 degrees 06 minutes east 25 feet to an iron rod; Thence north 59 degrees 08 minutes east 25 feet to an iron rod set in the westerly north line of said 106-4/10 acres tract and 182 feet from its west-northwest corner; Thence south 89 degrees 40 minutes east along said line 2443-5/10 feet to a stake, a reentrant corner of said 106-4/10 acres tract; Thence north 0 degrees 20 minutes east 352-2/10 feet to a galvanized iron rod, the north-northwest corner of said tract; Thence south 89 degrees 40 minutes east 298 feet to a one inch iron rod set in the northerly north line of said tract; Thence south 1202-4/10 feet to an iron rod; Thence south 3 degrees 01 minutes west 100 feet to an iron rod; Thence south 7 degrees 50 mir-etas west 100 feet to an iron rod; Thence south 13 degrees 46 minutes west 100 feet to an iron rod; Thence south 15 degrees 22 minutes west 56-7/10 feet to an iron rod; Thence south 49 degrees 44 minutes west 36-5/10 feet to a galvanized iron rod; Thence south 0 degrees 16 minutes west 76 feet to an iroi, rod; Thence south 3 degrees 58 minutes west 67-9/10 feet to an iron rod; Thence south 17 degrees 53 minutes west 190 feet to a galvanized iron rod in the north line of the T. B. Taylor Survey, the most easterly corner of the tract conveyed to the City of Fort Worth by said deed recorded in Vol. 798, pa 314, of the Deed Records of Tarrant County; Thence along a curve to the right with a radius of 57-36/100 feet a distance of 72-46/100 feet to the end of said curve; - Thence north 89 degrees 44 minutes -west 2685-3/10 feet to a galvanized iron rod, the beginning of a curve to the right with a radius of 40 feet; Thence along said curve 62-7/10 feet to the place of be- ginning, and containing 106.446 acres of land. -2- SECTION 2. That the use hereby permitted for Educational Purposes by the owner of the above described real property shall be and is hereby conditioned upon the observance of the following re- striction: That no building shall be constructed within twenty- five (25) feet of the present boundary line of the property hereinabove described and hereby zoned for Educational Purposes, and further that no building in excess of one-story or fifteen (15) feet in.height shall be constructed within seventy-five (75) feet of such present boundary line. SECTION 3. That the use for Educational Purposes hereby expressly per- mitted on the above described tract has been created and is here- by specially permitted in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the gen- eral welfare of the community; that the use for Educational Purposes hereby specially permitted of the property hereinabove described and the conditions restricting the location and con- struction of buildings are designed to lessen congestion in the streets, to secure safety from fire, panic, flood and other dangers, to provide adequate light and air, to prevent over- crowding of land, to avoid undue concentration of population, and to facilitate the adequate provision of transportation, water, sewerage, parks and other public requirements; and .that the use permitted of the hereinabove described property specially for Educational Purposes and the conditions imposed restricting the location and height of buildings have been made after full =3- and complete public hearing, with reasonable consideration, among other things, of the character of the tract herein de- scribed and its peculiar suitability for the particular use for Educational Purposes, and with a view of conserving the value of property and encouraging the most appropriate use of land throughout the corranurity, SE,'MON 4, That this ordinance shall be cumulative of all other ordi- nances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 5. Should any section, clause or provision of this ordinance be declared by a court of competent, jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be invalid. SECTION 6. That the use for Educational Purposes 'hereby specially per- mitted on the 106.446 acre tract of land hereinabove described shall. be, and the same -.s herdnv declared to be, more restric- tive than uses, classifications or districts currently existing under the provisions of ordinance No.. 3011, as amended. SEA7TION 7. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with, or who resists the en- -4- forcement of, any of the provisions of this ordinance shall be fined not less than Five Dollars ($5.00) nor more than Two Hun- dred Dollars ($200.00) for each offense; and that each day a violation is permitted to exist shall constitute a separate offense.
